APPLICATION OF CIVIL SERVICE. The parties acknowledge that prior to June 1, 1996 neither party to this Agreement or the employees covered by this Agreement acted in accordance with the rights and responsibilities of the parties and employees as specified in the City of Xxxxxxx Civil Service Ordinance and Civil Service Rules and Regulations ("Civil Service"). Pursuant to the authority contained in RCW 41.56 the parties agree pursuant to this Agreement that effective June 1, 1996 the employees in the bargaining unit shall be subject to Civil Service except as otherwise specifically provided herein. The City, RPA and the employees hereby waive any past failure prior to June 1, 1996 to comply with Civil Service and agree to take no action against the other parties hereto based on such failure to comply, including, but not limited to dismissing an employee on the basis that they were not hired in a manner consistent with Civil Service, challenging promotions on the basis that they were not made in conformance with Civil Service procedures, or challenging any discipline, discharge or other employee action by the City on any basis related to Civil Service.
APPLICATION OF CIVIL SERVICE. Section 1. Except for the continued applicability of those subjects prohibited from negotiations by the provisions of Ohio Revised Code (ORC) Chapter 4117, no section of the civil service laws contained in ORC sections 124.01 through 124.56 shall apply to bargaining unit employees. The parties further declare it is their intent to waive the applicability of ORC sections 9.44 and 4111.03, and the Ohio Administrative Code (OAC) Chapter 123 to this agreement.
APPLICATION OF CIVIL SERVICE. Section 36.1. Except as may be expressly provided for in this Agreement or specifically prohibited by applicable law, Sections 9.44, 124.01 through 124.56, 325.19, and 4111.03 of the Ohio Revised Code, Chapters 123 and 124 of the Ohio Administrative Code, and any other civil service laws or provisions related to a matter addressed within this Agreement, shall not apply to Employees within the bargaining unit and are specifically preempted by the parties. Further, Section 124.57 ORC shall continue to apply to bargaining unit Employees.
APPLICATION OF CIVIL SERVICE. Section 42.1: It is the intent of the parties that this Agreement shall govern all matters relating to bargaining unit employeesterms and conditions of employment which were previously covered by Ohio Revised Code Sections 124.01 through 124.56. To the extent permitted by ORC 4117, any term or condition of employment addressed in whole or in part by this Agreement shall supersede and replace in its entirety any civil service provision relating to the same subject or any provision of law which may conflict with the provisions herein. It is expressly understood that all regulations of the Ohio Department of Administrative Services requiring the Employer to report personnel actions are hereby superseded and replaced by the provisions herein. It is further agreed that the Ohio State Personnel Board of Review shall have no jurisdiction regarding appeals by employees included in the bargaining unit. Where this Agreement is silent, on any subject, applicable law shall govern.

APPLICATION OF CIVIL SERVICE. Section 44.1 It is the intent of the parties that this Agreement shall govern all matters relating to bargaining unit employees' terms and conditions of employment. To the extent permitted by Chapter 4117, Revised Code, any term or condition of employment expressly addressed by this Agreement shall supersede and replace in its entirety any civil service provision relating to the same subject.
