Xxxxx, Ontario, save and except yard xxxxxxx, office/store assistant manager, the secretary to the manager, and persons above those ranks. 2.02 No employee outside the bargaining unit shall perform work normally performed by employees in the bargaining unit, with the understanding that flexibility will be exercised dependant upon customer needs and requirements.

BARGAINING UNIT JURISDICTION. The members covered by this agreement shall not be required to perform more than incidental work which properly comes under the jurisdiction of another bargaining unit and/or classification, unless properly compensated for such temporary work assignment.
BARGAINING UNIT JURISDICTION. 2.01 The Union is recognized as the sole and exclusive bargaining agent for all the employees of the Animal Shelter for Huntsville in the Town of Huntsville save and except supervisors, persons above the rank of supervisors, and office and clerical employees. 2.02 The jurisdiction of this agreement extends over all work normally performed by employees within the bargaining unit; such work will not be assigned to anyone outside said unit except in a situation hazardous to the person or to property, or on those occasions when a supervisor, or person above the rank of supervisor is called upon to meet the public in the Shelter, or is required to perform office or clerical duties normally performed by employees covered by this agreement. (a) The use of volunteers shall not result in a lay-off or a reduction of the scheduled working hours of the employees covered by this agreement.
BARGAINING UNIT JURISDICTION. It is the intent of the parties that no reserve, special, private security services, or any other named law enforcement personnel shall be used to take away or replace a regular police officer in the regular or outside details requested through the Police Department, except where all regular officers are unavailable or have refused the detail.

BARGAINING UNIT JURISDICTION. 2.01 The Employer recognizes the Union duly certified by the Ontario Labour Relations Board since September 16, 2003 as the sole and exclusive Bargaining Agent for all the employees of the Carveth Nursing Home Limited in the Municipality of Gananoque, save and except supervisors, maintenance supervisor, persons above the rank of supervisor, Registered and Graduate Nurses, office, clerical and sales staff, and students employed during the summer school vacation period. 2.02 Employees excluded from the bargaining unit shall not perform duties normally performed by employees in the bargaining unit which shall directly result in the layoff or reduction in hours of work of an employee in the bargaining unit or prevent the recall of an employee who has been on layoff and is entitled to be recalled to work in accordance with the collective agreement.

This Agreement creates no fiduciary or other special relationship between the parties, and no such relationship otherwise exists. No presumption in favor of or against any party in the construction or interpretation of this Agreement or any provision hereof shall be made based upon which Person might have drafted this Agreement or such provision.

  • Bargaining unit members shall earn their salary at the Equalized Daily rate. A bargaining unit member’s Equalized Daily Rate of Pay shall be calculated based upon dividing the annual salary by the number of paid days in the bargaining unit member’s work calendar. Upon termination, bargaining unit members shall be paid through their last day worked at the Equalized Daily rate.

  • Collective Bargaining Unit 1.1 The Company recognizes the Union as the sole bargaining agent for all regular, part-time and temporary employees1, including technicians of the construction field forces and security employees but excluding: (a) Employees now represented by other bargaining agents. (b) Persons above the rank of working supervisor. (c) Persons who exercise managerial functions in accordance with the Ontario Labour Relations Act. (d) Persons employed in a confidential capacity in matters relating to labour relations in accordance with the Ontario Labour Relations Act. 1.2 The grievance/arbitration procedure may be used to challenge any unreasonable, arbitrary or bad faith action taken by the Company which results in the exclusion of any employee or position from the bargaining unit. The parties will attempt to resolve disputes expeditiously. 1 "Employees" are employees pursuant to the Labour Relations Act for Ontario SO, 1995, c.1 Schedule A, as amended. 1.3 When an employee is removed from normal duties to act in a vacated position or relieve for an incumbent or perform a temporary assignment, the following shall apply: (a) When the length of time involved is known to be three months or less, the employee will retain his/her present jurisdictional status. (b) When it is expected that the length of time will be longer than three months, the employee will be excluded or included at the commencement of his/her new responsibilities. However, in the event the period is actually less than three months: (1) in exclusion cases, the Union will be reimbursed the dues which would have been paid; (2) in inclusion cases, the Union will reimburse the employee the dues which have been paid. (c) When the length of time is unknown, the employee will retain his/her present jurisdictional status up to the three month period. If the period extends beyond three months, the employee will then be either included or excluded.
