CALCULATION OF SENIORITY - PART TIME REGULAR EMPLOYEES. (a) Notwithstanding Article 6.02(d), Part Time Regular employees shall, except in the circumstances set out in item 6.05(b) below, only accumulate seniority on the basis of time worked. (b) Part Time Regular employees shall accrue seniority when absent from work only in the following circumstances: i) while laid off to the recall list. ii) while absent from work on sick leave. iii) while absent from work and in receipt of Long Term Disability benefits. iv) while absent from work and in receipt of Workers’ Compensation benefits. v) while absent from work on maternity leave. vi) while on approved leave of absence. Seniority shall be calculated on the basis of the average number of hours worked over the ten week period immediately prior to the commencement of the absence for any of the reasons listed above.

CALCULATION OF SENIORITY - PART TIME REGULAR EMPLOYEES. (a) Seniority for Part Time Regular Employees shall be calculated on a pro-rata basis in accordance with the proportion of full time equivalent hours worked. (b) The seniority of any Part Time Regular Employee who is absent from work due to annual vacation, sick leave, leave due to Workers’ Compensation or any other approved leave of absence shall continue to accrue during such absence. The employee who is laid off and recalled during the applicable recall period shall continue to accrue seniority throughout the period of such absence from work, subject to the provisions of Clause 17.09. For this purpose, such absence from work shall be deemed to be time worked and seniority shall accrue based on the average number of hours worked by the Part Time Regular Employee during the six (6) full calendar months worked immediately prior to commencement of the absence from work, pro-rated in accordance with the proportion of full time equivalent hours worked. (c) Overtime hours shall not be included for seniority calculation.

(b) For the purposes of Clause 9.02(d) above, any applicable absence from work by a Part Time Regular Employee shall be deemed to be time worked and seniority shall continue to accrue based on the average number of hours worked, per work day and work week, by the Part Time Regular Employee during the six (6) month period immediately prior to commencement of such absence, pro-rated in accordance with the proportion of full-time equivalent hours worked.

Calculation of service and seniority shall be in accordance with the following: 1. The accredited service and seniority calculations for PTR employees will be calculated as at December 31 each year. This calculation will include hours worked plus AV entitlements for that calendar year. 2. An employee’s total hours worked per Art. 6.05 (b) for the previous calendar year will be determined after the end of the last pay period of that year. Total hours worked, including the current year’s AV entitlement, will be divided by 163.0435 hours and rounded up. If the employee’s total hours worked plus credit for AV entitlement exceeds 1957.5 total working hours in the year, the employee will only be credited with 1 year of service/seniority for that year. The rounded result is the accredited service and seniority for the current year, which will be added to the accumulated total for accredited service and seniority of previous years.

(b) For the purposes of Clause 15.02(c) above, any agreed upon absence from work as specified in Clause 15.02 (c) by a Part Time regular Employee shall be deemed to be time worked and seniority shall continue to accrue based on the average number of hours worked, per work day and work week, by the Part Time Regular Employee during the six (6) month period immediately prior to commencement of such absence, pro-rated in accordance with the proportion of full-time equivalent hours worked.

CALCULATION OF SENIORITY - PART TIME REGULAR EMPLOYEES a) Seniority for Part Time Regular Employees shall be calculated on a pro-rata basis in accordance with the proportion of full-time equivalent hours worked, or deemed to have been worked. For the purposes of this calculation, it is agreed that the “full-time equivalent” hours on an annual basis shall be 2080. For the purpose of this Clause 13.03, deemed hours worked shall include layoff; Statutory Holidays; banked overtime taken as time off work; vacation; any leave of absence including, but not limited to, with respect to illness, injury, disability or other medical condition or Workers’ Compensation; or any other approved time off work pursuant to this Agreement, for the duration of any such absence from work, subject to the provisions of Clause 27.06. b) For the purposes of Clause 13.03 (a) above, any applicable absence from work by a Part Time Regular Employee shall be deemed to be time worked and seniority shall continue to accrue based on the proportion of full-time equivalent hours worked or deemed to have been worked in accordance with the established work schedule. For the purposes of this calculation the average number of hours worked or deemed to have been worked shall be re-calculated every six (6) months.

  • Regular Employees Service credit shall be the period of employment with the Company and any service restored as per Part A, Item 5.3.

  • Regular Part-Time Employees A regular part-time employee is one who works less than full-time on a regularly scheduled basis. Regular part-time employees accumulate seniority on an hourly basis and are entitled to all benefits outlined in this Collective Agreement. Regular part-time employees shall receive the same perquisites, on a proportionate basis, as granted regular full-time employees.

  • Regular Employee Seniority for a regular employee is defined as the length of the employee’s continuous employment (whether full-time or part-time) from the date of commencement of regular employment, plus any seniority accrued, while working as a casual employee of the Employer.

  • Leave of Absence for Union Business 20.1 On reasonable notice in writing and where operational requirements permit the Employer may grant a leave of absence without pay to an Employee who is elected or selected: (a) as a member of the Board of Directors of the Union for the attendance at Board meetings; (b) as a delegate to attend special conventions, conferences and/or educational programs of the Union and affiliated bodies including the National Union of Public and General Employees Canadian Labour Congress and the Nova Scotia Federation of Labour; (c) as members of standing Committees of the Union for the attendance at meetings of the standing Committees; (d) as members of the Bargaining Union negotiating committee of the Local for attendance at Committee meetings; (e) as members of the Executive to attend Executive Meetings of the Nova Scotia Government and General Employees Union and the Nova Scotia Federation of Labour; or (f) for such other Union business as may be authorized by the Union. Such leaves will not be unreasonably refused. Such leaves shall be without pay but without loss of benefits or seniority during the period of the leave. The Employer will continue the salary and benefits of an Employee, who is granted leave without pay for Union business, and will invoice the Union for the Employee's salary and benefits. 20.2 On reasonable notice in writing and where operational requirements permit, an Employee who is seconded for a position with the Union or anybody with which the Union is affiliated may be granted a leave of absence without loss of seniority and benefits during the period of the leave. Such leave shall not be unreasonably refused. The Employer will continue the salary of an Employee who is seconded without pay and will invoice the Union for the Employee's salary and the Union shall reimburse the Employer for all pay or benefits during the period of the leave.
