Category II. An Employee in this category will normally hold a Master’s degree, a Bachelor’s degree plus a teaching certificate or instructor’s diploma, or equivalent professional certification, which represents at least 5 (five) years of study at the college/university level.

Category II. The City shall reimburse represented employees designated by the City Administrator as Category II at the rate of three hundred fifty dollars ($350) per month. The City shall reimburse represented employees in Unit U41 at the Category II rate.

Category II. Category II undertakings are defined by NRCS Utah as small-scale undertakings that are limited in size and scope. Generally, Category II undertakings involve less than 100 acres of physical disturbance of undeveloped ground and lack extenuating circumstances that would otherwise involve additional consideration for cultural resources. Category II status is limited to those undertakings that meet the criteria listed above, and are limited to undertakings where NRCS Utah has been determined to be the lead Federal agency for the purposes of Section 106, and where the undertakings occur exclusively on privately-owned lands.
Category II. For Category II undertakings, implementation shall proceed with a determination ofno historic properties affectedin accordance with 36 CFR Part 800.4(d)(1). Implementation shall proceed once the NRCS State CRS has returned a signed copy of the NRCS Utah Cultural Resources Review Form to the Conservation Planner. Conservation Planners will maintain a signed copy of the form with the conservation plan for the undertaking, and implementation shall occur as stated in the design specifications stated in the conservation plan.

Category II. A Bank shall be in Category II if it (a) has an Average Net Composite Score of 35.0 or more, but less than 50.0, for the most recent calendar quarter for which an Average Net Composite Score is available, (b) has a Net Composite Score of 30.0 or more, but less than 45.0, for the most recent calendar quarter for which a Net Composite Score is available,(c) has a Tier 1 Leverage Ratio of 3.00% or more, but less than 4.00% for the last day of the most recent month, (d) has a Total Capital Ratio of 7.00% or more, but less than 8.00% for the period ending on the last day of the most recent month, or (e) is in Category I and has failed to provide information to the Committee as required by Article III within two Business Days after receipt of written notice from the Committee of such failure.
Category II. Development Activities That Are Minor in Either Size and/or Scope Category II projects include new and replacement/repair development activities that may include changes to the layout or design of an existing facility. In some cases, a change of facility type (e.g. – parking lot to building) may be allowed if all parameters are met. All threshold limits described below relate to impacts within the Critical Area only. Note: Early coordination with Commission staff on Category II projects is required to determine if the proposed project is eligible under the MOU, or if the project will require full Commission review and approval. If the proposed development project results in a combination of habitat impacts or includes multiple elements of projects listed in this MOU, the Commission reserves the right to decide at any time to bring a project that may appear to qualify under the MOU to the full Critical Area Commission for review and approval.
