CLEARANCE REQUIREMENTS. CONTRACTOR shall comply with the requirements of California Education Code sections 44237, 35021.1, 35021.2, and 56366.1 including, but not limited to: obtaining clearance from both the California Department of Justice (hereinafter referred to as “CDOJ”) and clearance from the Federal Bureau of Investigation (hereinafter referred to as "FBI") for CONTRACTOR’s employees and volunteers who will have or likely may have any direct contact with LEA students. CONTRACTOR hereby agrees that CONTRACTOR’s employees and volunteers shall not come in contact with students until CDOJ and FBI clearance are ascertained. CONTRACTOR shall certify in writing to LEA that none of its employees, and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with students, or subcontractors who may come into contact with students have been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite the employee’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). Contractor shall certify to LEA that they have successful background checks and enrolled in subsequent arrest notification service for all employees who may come into contact with students. Notwithstanding the restrictions on sharing and destroying criminal background check information, CONTRACTOR, upon demand, shall make available to the LEA evidence of a successful criminal background check clearance and enrollment in subsequent arrest notification service, as provided, for each owner, operator, and employee of the NPS/A. CONTRACTOR is required to retain the evidence on-site, as specified, for all staff, including those licensed or credentialed by another state agency. Background clearances and proof of subsequent arrest notification service, as required by California Penal Code section 11105.2, for all staff shall be provided to the LEA upon request.

CLEARANCE REQUIREMENTS. You must ensure that any human experimentation is conducted in accordance with the current requirements of the NHMRC Statement of Human Experimentation and Supplementary Notes. You must provide to Us evidence of such experimentation (including any variations to the scope of that experimentation from time to time) being acceptable to the Ethics Committee of the relevant institution.

CONTRACTOR shall provide written verification of compliance with Section 44237(i) or j). In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2.
CLEARANCE REQUIREMENTS. 45.1 As a condition of providing services to LEA, CONTRACTOR shall provide LEA with completion of Certification of Criminal Background Clearance, Tuberculosis (TB) Clearance and Credential Verification (“Exhibit B”) for CONTRACTOR’s employees and volunteers who will have or likely may have any direct contact with LEA students.
45.2 CONTRACTOR shall provide the LEA with the verified dates of fingerprint clearance, Department of Justice clearance and Tuberculosis Test clearance for all employees, approved subcontractors and/or volunteers prior to such individuals starting to work with any student.
CLEARANCE REQUIREMENTS. “All employees, volunteers and contract/vendor personnel who work within the department or have access to departmental facilities, staff, clients, systems or confidential and/or financial information are required to undergo a background investigation. The level of scrutiny varies between subject groups and includes a range of evaluative tools designed to ensure the highest degree of confidence be maintained in our workforce, volunteers and contract/vendor service providers.
CLEARANCE REQUIREMENTS. 1. CONTRACTOR shall comply with the requirements of California Education Code sections 44237, 35021.1, and 35021.2, including, but not limited to: obtaining clearance from the California Department of Justice (hereinafter referred to as “CDOJ”) and tuberculosis (“TB”) clearance for CONTRACTOR’S employees, volunteers, and independent contractors prior to providing service to any SCUSD student, unless CONTRACTOR determines that the employees, volunteers, and independent contractors will not be onsite and thus unable to have contact with SCUSD students. Such CDOJ and FBI clearance shall include a determination that any such person has not been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite such person’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2 with respect to each such person. CONTRACTOR shall certify in writing to SCUSD that CONTRACTOR has at all times complied with this section of the Master Contract. CONTRACTORS employing or staffing current SCUSD or other school district’s employees must obtain clearance from the CDOJ verified with CONTRACTOR’S ORI (Originating Reporting Agency Identification) number.
2. CONTRACTORS with employees who are residents of other states in the United States shall comply with the above identified statutory requirements by obtaining criminal record histories for their employees through the employee’s state of residence equivalent to the CDOJ including subsequent arrest information or by obtaining annual FBI criminal records histories for their employees.
3. If CONTRACTOR’S services, as specified in the ISA, are limited to online services, contact with SCUSD students shall also include electronic contact, and CONTRACTOR shall comply with the requirements for CDOJ and FBI clearance described in this section. In such cases, employees having electronic or telephone contact only with any SCUSD student shall not be required to obtain TB clearance.

CLEARANCE REQUIREMENTS. 9.1. Participation in the clinical or non-clinical program by School and/or each instructor or Student of School is contingent on those entities or individuals, as applicable:
9.1.1. The school, Instructor or Student not being listed on the OIG List of Excluded Individuals and Entities (LEIE), the General Services Administration (GSA) list of debarred contractors, or other federal and state exclusion lists,
9.1.2. The Student shall consent to a background check from an approved contracted vendor of Palomar Health to perform a background check, including OIG, LEIE, and criminal activities, and authorize the sharing of any positive or flagged results on the background check with Palomar Health. If the School already uses a Palomar Health approved vendor to conduct background checks on their Students for their academic program, the Student shall authorize the School to share the background check with Palomar Health. Palomar Health reserves the right to deny access or entry by a Student / Instructor to Palomar Health’s premises / facilities for purposes under this Agreement based upon the results of that background check revealing that those individuals are not safe or suitable to be in a patient care environment, and must be completed prior to any Student entering a clinical or non-clinical area.
9.1.3. The Student or Instructor shall consent to a 10-panel urine drug screening from an approved contracted vendor of Palomar Health. If the School already uses a Palomar Health approved vendor to conduct a drug screening on their Students or Instructors for their academic program, the Student or Instructor shall authorize the School to share the results on the drug screening with Palomar Health. Palomar Health reserves the right to deny access or entry by a Student or Instructor to Palomar Health’s premises / facilities for purposes under this Agreement based upon the results of that drug screening revealing that those individuals are not safe or suitable to be in a patient care environment, and such drug screen must be completed prior to the Student or Instructor entering a clinical or non-clinical area.
9.1.4. The School / Student / Instructor, as applicable, shall demonstrate acceptable proof of TB and required immunizations for the Student or Instructor prior to such Student or Instructor entering a clinical or non-clinical area.
