CLEARANCE REQUIREMENTS. CONTRACTOR shall comply with the requirements of California Education Code sections 44237, 35021.1, 35021.2, and 56366.1 including, but not limited to: obtaining clearance from both the California Department of Justice (hereinafter referred to as “CDOJ”) and clearance from the Federal Bureau of Investigation (hereinafter referred to as "FBI") for CONTRACTOR’s employees and volunteers who will have or likely may have any direct contact with LEA students. CONTRACTOR hereby agrees that CONTRACTOR’s employees and volunteers shall not come in contact with students until CDOJ and FBI clearance are ascertained. CONTRACTOR shall certify in writing to LEA that none of its employees, and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with students, or subcontractors who may come into contact with students have been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite the employee’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). Contractor shall certify to LEA that they have successful background checks and enrolled in subsequent arrest notification service for all employees who may come into contact with students. Notwithstanding the restrictions on sharing and destroying criminal background check information, CONTRACTOR, upon demand, shall make available to the LEA evidence of a successful criminal background check clearance and enrollment in subsequent arrest notification service, as provided, for each owner, operator, and employee of the NPS/A. CONTRACTOR is required to retain the evidence on-site, as specified, for all staff, including those licensed or credentialed by another state agency. Background clearances and proof of subsequent arrest notification service, as required by California Penal Code section 11105.2, for all staff shall be provided to the LEA upon request.

CLEARANCE REQUIREMENTS. You must ensure that any human experimentation is conducted in accordance with the current requirements of the NHMRC Statement of Human Experimentation and Supplementary Notes. You must provide to Us evidence of such experimentation (including any variations to the scope of that experimentation from time to time) being acceptable to the Ethics Committee of the relevant institution.

CONTRACTOR shall provide written verification of compliance with Section 44237(i) or j). In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2.
CLEARANCE REQUIREMENTS. 45.1 As a condition of providing services to LEA, CONTRACTOR shall provide LEA with completion of Certification of Criminal Background Clearance, Tuberculosis (TB) Clearance and Credential Verification (“Exhibit B”) for CONTRACTOR’s employees and volunteers who will have or likely may have any direct contact with LEA students.

Such CDOJ and FBI clearance shall include a determination that any such person has not been convicted of a violent or serious felony as those terms are defined in California Education Code section 44237(h), unless despite such person’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code section 44237 (i) or (j). In addition, CONTRACTOR shall make a request for subsequent arrest service from the CDOJ as required by California Penal Code section 11105.2 with respect to each such person. CONTRACTOR shall certify in writing to SCUSD that CONTRACTOR has at all times complied with this section of the Master Contract. CONTRACTORS employing or staffing current SCUSD or other school district’s employees must obtain clearance from the CDOJ verified with CONTRACTOR’S ORI (Originating Reporting Agency Identification) number.

CONTRACTOR shall certify in writing to LEA that, to the best of its knowledge, none of its employees, and volunteers, unless CONTRACTOR determines that the volunteers will have no direct contact with students, or subcontractors who may come into contact with students, have been convicted of a violent or serious felony as those terms are defined in California Education Code §44237(h), or who has been convicted of or entered a plea of nolo contender to charges of any sex offense as defined in Education Code §44010, unless despite the employee’s conviction of a violent or serious felony, he or she has met the criteria to be eligible for employment pursuant to California Education Code §44237 (i) or (j). Clearance certification shall be submitted to the LEA. The passage of AB 389 amends Education Code §44237 and §56366.1 as to the verification that the CONTRACTOR has received a successful criminal background check clearance and has enrolled in the subsequent arrest notification service, as specified, for each owner, operator, and employee of the NPS/A. Further this bill deletes the exemption for applicants possessing a valid California state teaching credential, or who are currently licensed by another state agency that requires a criminal record summary, from submitting two (2) sets of fingerprints for the purpose of obtaining a criminal record summary from the Department of Justice and the Federal Bureau of Investigation.
