Converting to One Break per DayApplicable to Monday to Friday work only. Clause 36.1, clause 36.2, clause 36.4 and clause 36.5 shall not apply to an employee that is working in accordance with clause 36.6. 36.6.1 If only one (1) break is taken, employees will work in accordance with one (1) of the examples below or hours agreed between the employer and the employee that are similar to those provided in the examples. Employee Starts Work at 6.00 am. Between 10.00 am and 10.30 (paid break). Employee Ceases Work at 1.45 pm.‌‌‌ Overtime would be payable from 1.45 pm. Employee Starts Work at 6.30 am. Between 10.30 am and 11.00 (paid break). Employee Ceases Work at 2.15 pm.‌‌‌ Overtime would be payable from 2.15 pm. Employee Starts Work at 7.00 am. Between 11.00 am and 11.30 (paid break). Employee Ceases Work at 2.45 pm.‌‌ Overtime would be payable from 2.45 pm. 36.6.2 An employee will be paid and accrue entitlements as if they had worked an eight (8) hour day. 36.6.3 The paid one break shall be a duration of 30 (thirty) minutes.

Converting to One Break per Day. If only one break is taken at the employers direction per day any time worked after seven and a half hours will be deemed as overtime and appropriate penalties will apply. For example: Start Time 6.00am – One Break – penalties apply after 1.30pm Start Time 7.00am – One Break – penalties apply after 2.30pm. 37.5 Overtime rest breaks (a) When an employee is required to work two (2) hours or more of overtime after working ordinary hours, the employee will be allowed to take without deduction of pay, a rest break of twenty (20) minutes in duration immediately after such ceasing time and thereafter, after each four (4) hours of continuous work, the employee will be allowed to take also, without deduction of pay, a rest break of thirty (30) minutes in duration. (b) In the event of an employee remaining at work after the usual ceasing time without taking the rest break of twenty minutes and continuing at work for a period of two hours or more, the employee will be regarded as having worked twenty minutes more than the time worked and be paid accordingly. For the purpose of this clause usual ceasing time is at the end of ordinary hours inclusive of time worked for accrual purposes as prescribed in clause 31Hours of work. (c) When an employee is required to work overtime on a Saturday or Sunday, the employee will be allowed to take without deduction of pay: i. a rest break of ten (10) minutes in accordance with subclause 36.4; and ii. a rest break of twenty (20) minutes in duration for each completed four (4) hours of overtime worked by the employee. (d) In the event of an employee continuing to work without taking the rest break in accordance with subclause 36.5(b)(i), the employee will be regarded as having worked twenty (20) minutes more than the time actually worked and be paid accordingly. (e) Subclauses 36.4 – Daily rest breaks and 36.5 – Overtime rest breaks will not be applicable in the case of an employee who is allowed the rest periods prescribed in Appendix A for Hot work or Cold work. (f) Where an agreement is reached pursuant to subclause 31.2, the agreement may make provision for the variation of work breaks to suit the arrangement of hours of work. 37.6 Breaks between working days (a) An employee who works so much overtime between the termination of his/her ordinary work on one day and the commencement of his/her ordinary work on the next day that the employee has not at least ten (10) consecutive hours of...
