Court Standby. Off-duty employees who are placed on approved telephone standby for a court/hearing appearance shall receive a lump sum of $200.00 per day. If an employee on telephone standby is instructed to appear in person at a time consecutive to the standby, the employee will be paid at the employee’s contractual overtime rate from the time standby began until the appearance has concluded. Court Standby. Court standby shall extend to justice, district and municipal courts. Employees on court standby on a duty day but not during duty hours (swing shift or graveyard officers only) shall receive one (1) hours pay at the employee's regular hourly rate for scheduled court appearances during the morning and/or one (1) hours pay at the employee's regular hourly rate for scheduled court appearances during the afternoon hours. Employees on court standby on a scheduled off-duty day shall receive two (2) hours pay at the employee's regular hourly rate for scheduled court appearances during the morning and/or two (2) hours pay at the employee's regular hourly rate for scheduled court appearances during the afternoon hours. No employee shall receive more than one hour's pay for any one hour period when two or more court appearances are scheduled for the same one hour period.
Court Standby. Off-duty officers required by the court to stand by beyond 11:00 a.m. are to be reimbursed for 4 hours of overtime at a straight hourly rate. Eligible officers must remain available to report within 1 hour of call to appear. This time begins upon notification to the department by court or District Attorney's office. Officers are encouraged to respond to the courtroom in the shortest possible time it takes to travel from their home. In no event shall the response time exceed 1 hour from the time the department is notified. This benefit is not applied if a court appearance is made any time that day. Officers will receive 2 hours of credit at a straight hourly rate for all off-duty court standby prior to 11:00 a.m., for which they are not requested to appear. If more than one subpoena requires standby on the same day, only one credit is provided.
Court Standby. Employees required to standby for court time will be compensated in accordance with the following conditions and requirements:
Court Standby. Employees covered by this Agreement shall receive $50.00 per day when they are on court standby or their actual pay for time required to be in court, whichever is greater.
Court Standby. Members placed on court standby without appearing in court will receive (2) hours of court appearance premium pay only if they are off duty the entire call-in period indicated on the subpoena. Court Standby. Employees who are required by the Employer or the court to stand by for testimony in a case arising from their duties performed for the Employer, shall be paid one (1) time their regular straight-time rate of pay for each hour on standby with a two (2) hour minimum. Standby pay shall terminate automatically at 1800 hours each day or when cancelled by the Employer or the court, whichever first occurs. The two (2) hour minimum pay provisions of this section shall apply whenever a court duty standby directive is cancelled after 1800 hours on the day preceding court. Employees are required to verify Standby with Prosecuting Attorney or designee on date of Standby by 0900 hours for morning standby and 1300 hours for afternoon Standby. Standby pay shall not be provided on any day such employees actually report for court proceedings as directed.

Court Standby. An employee required to standby at home on the employee’s non-work day awaiting to be called to Court pursuant to a subpoena to testify in a criminal prosecution will receive one hour of vacation accrual for each hour of waiting at home, rounded to the nearest quarter hour. This accrual shall begin at 8:00 AM on the day of the Court standby and shall end when the employee is either called to leave home to go to Court commencing callback pay or is informed that the employee will not have to report to Court that day. Court standby vacation accrual shall not overlap callback pay.
Court Standby. Sworn employees off-duty and under subpoena for a criminal case shall receive 2 hours of overtime standby pay at the rate of time and one-half of the employee’s straight time rate of pay (including premiums expressed as a percentage of base pay) if they are off-duty during the entire time court is in session. For the purpose of this issue, court is deemed to be in session starting at 9 am and concluding at 5 pm. Members placed on standby status by the district attorney are required to have the subpoena renewed after five court days if they are still on stand-by status. Members under subpoena in a civil matter must require the Attorney of record on the subpoena to deposit the required funds in the form of a cashier’s check to the City of East Palo Alto to cover the five days in advance of the court date.
Court Standby. Employees required to be on standby for a court appearance during other than their scheduled working hours shall receive a minimum of two (2) hours their regular rate of pay for each morning and afternoon court sessions.
