DAILY GUARANTEES. On snow days or hazardous weather days, if an employee reports to work, and is working; and the Company closes the plant - the employee will receive a minimum of four (4) hours pay. This Article shall not apply when the Employer is unable to afford four (4) hours of work or less because of an Act of God or other emergency.

The implementation of a daily guarantee will be reviewed on a regular basis by the National Air Committee to determine if Local conditions exist that would permit the Employer to provide for or adjust a daily guarantee. Further, the parties agree that in those areas that do not currently have a daily guarantee, the following procedure shall apply: If eighty percent (80%) of the employees reporting to a shift work three (3) or more hours for thirty (30) working days within a forty (40) day period, except for peak season, such shift shall be entitled to a three (3) hour guarantee. The Employer may also provide a higher daily guarantee to the extent it does not conflict with the overtime rules in the applicable Supplement, Rider or Addendum.

C. When a vessel is working at a container terminal and a bus or van driver is required, the watchman will not be shifted to other work while the vessel is still working and there are also individuals to be transported on the terminal to and from the vessel to the outside gate. When a gangway watchman is employed, he will not be shifted to other work until the gangway is raised. Torpedo watchmen will not be shifted until the duties are completed in accordance with the Navy’s requirements. Detainee or cabin watchmen shall not be shifted until the vessel departs or the detainees are removed from the outside gate of the facility.
D. Individuals who are absent because of jury duty in the State of California shall have their jury duty days Monday through Friday credited and counted as qualifying hours and years toward pension, and vacation. Verification of jury duty service and pay shall be presented to PMA in order to receive this benefit.
