Entitlement to compassionate leave. A full-time or part-time Employee is entitled to: (a) Two (2) days paid compassionate leave upon the death of a member of the Employee’s immediate family or a member of the Employee’s household, a baby in their immediate family or household is stillborn; or the Employee or their spouse or de facto partner has a miscarriage, to be taken up to and including the day of the funeral. (b) An additional three (3) days paid compassionate leave upon the death of the Employee’s spouse (including de facto spouse and same sex partner), parent, child (including step child) or sibling, to be taken up to and including the day of the funeral. (c) Two (2) days paid compassionate leave (either as a continuous period or as single shifts of leave) for the purposes of spending time with a member of the Employee’s immediate family or a member of the Employee’s household who has contracted or sustained a personal illness/injury that poses a serious threat to his or her life. (d) An additional two (2) days paid compassionate leave if interstate or international travel is required to attend a funeral. (e) In circumstances where the leave is approved and a funeral is delayed, the dates of the leave are able to be changed prior to taking the leave upon notification to the Employer.

(d) The two days’ compassionate leave does not need to be taken consecutively. (e) Compassionate leave taken by casual Employees is unpaid.
Entitlement to compassionate leave. (a) An Employee is entitled to three (3) days of compassionate leave for each occasion (a permissible occasion) when: (i) a member of the Employee’s Immediate Family, or a member of the Employee’s household: A. contracts or develops a personal illness that poses a serious threat to their life; B. sustains a personal injury that poses a serious threat to their life; or C. dies; or (ii) a child is stillborn, where the child would have been a member of the Employee’s immediate family, or a member of the Employee’s household, if the child had been born alive; or (iii) the Employee, or the Employee’s current spouse or de facto partner, has a miscarriage. This sub-clause does not apply if the miscarriage results in a stillborn child. (b) An Employee shall furnish proof that would satisfy a reasonable person that the compassionate leave is taken for the specified reason.

Entitlement to compassionate leave whilst on leave
Entitlement to compassionate leave. Compassionate leave is available for Employees who need leave to spend time with a member of their household or immediate family (as defined in clause 20.2) who is suffering from a life threatening illness or injury, or after the death of a member of the Employee's household or immediate family. Employees are entitled to a period of two days' paid compassionate leave on each relevant occasion, save that an Employee will be entitled to: (a) up to five days' leave on the death of the Employee's partner, child (or the child of the Employee's partner), parent or guardian; and (b) up to three days' leave for the death of the Employee's (or the Employee's partner's) brother, sister, parent, guardian, grandparent or grandchild. Additional leave may be granted by mutual consent between the Employee and the Company where cultural obligations or travel requirements necessitate. The Company will consider favourably an Employee's request for access to annual leave or SDOs of up to three days upon the death of a person with whom the Employee has a close association. Compassionate leave does not accrue and is not payable upon termination of employment.

(b) An Employee is entitled to two days' compassionate leave per occasion when a member of the Employee’s Immediate Family, or a member of the Employee’s household: (i) contracts or develops an illness or sustains an injury that poses a serious threat to their life; or (ii) dies, provided that the Employee provides any evidence that the Employer reasonably requires of the illness, injury or death. (c) The two days’ compassionate leave does not need to be taken consecutively. (d) In addition to clause 15.1(b) a Permanent Employee is entitled to an additional day of paid compassionate leave (i.e. total of three days) where the Employee is travelling overseas to attend the funeral of a member of the Employee’s Immediate Family or household. (e) Compassionate leave taken by casual Employees is unpaid.
