Five weeks accrual - Employees shall accrue five weeks of vacation annually after the completion of 520 full-time biweekly pay periods (20 years) of continuous employment, up to a maximum balance of ten weeks.
Five. At the latest, within the sixty days following each quarter after the initiation of the commercial production of the Properties and of the first sale of Mineral Products, RCR will present to the Shareholders of the Offeror - applying in section 6.4 of the sixth clause above- a reasonably detailed statement, (recovery, grades, production, cost and other relevant for the determination of the NSR) on the last day of the quarter immediately preceding or that of the reinitiating of commercial production and first sale of Mineral Products in the case of the first payment, of the calculation of the Royalty to be paid to the Offeror with respect to the pertinent quarter; Six) Any adjustment of calculation of the Royalty that could have its origin in accordance with what has been exposed, as for example, as a result of a quarterly statement to which reference is made in number Eight of this clause, shall be effected in the immediately following quarterly statement; Seven) For the purposes of the calculation of the amount of the Royalty, if RCR should sell a Mineral Product to one of its related, subsidiary or affiliated companies, without having negotiated their sale price in an equal manner, in such case, and only for he purposes of the calculation of the NSR and regardless of the actual amount of the pertinent sale price, RCR must add to the actual amount of such sale price, the sum that is sufficient so that such sale price constitutes a net reasonable sale price of the Mineral Product, as if it had been negotiated in an equal manner, after considering all the pertinent circumstances (including without limitation, the market conditions then prevailing with respect to the Mineral Product concentrates or other materials or products similar to the corresponding product). Through notification RCR will inform the Offeror about the amount of the reasonable sale price and if the Offeror does not object to it within the sixty days following the receipt of such notice, such amount will be definitive and compulsory for the purposes of this clause;
Five. (5) additional days' leave shall be granted for Death in the Immediate Family (immediate family is considered the same as sub-section a hereinabove), plus mother-in-law and father-in-law. Three (3) days leave shall be granted for the death of the employee’s grandparent. Said bereavement days are separate and distinct and shall not be charged as either sick leave (Section A) or personal leave (Section B.1) set forth herein.
Five. (5) days shall be allowed for the death of a member of the immediate family. (Immediate family shall be defined as mother, father, spouse, child, sister, brother, mother-in-law, and father-in-law, or the family unit living in the Administrator's household.) Three (3) additional days may be allowed if necessary and charged to sick leave. Two (2) days shall be allowed for death of an Administrator's grandchild, grandparent, brother-in-law, sister-in-law, son-in-law, or daughter-in-law and shall be charged to personal leave. Leave days may be non-consecutive and must be used within an eight (8) day period following the death unless there are extenuating circumstances. One (1) day leaves may be granted for funerals of others than those persons defined above and will be charged to sick leave. These leave days will be the non- weekend days following the death. If any part of this leave occurs during a non-paid break such as summer, those leave days will be non-paid.
Five. (5) working days notice for each full year of service except that the minimum notice will be 20 working days and the maximum will be 125 working days.
Five. (5) days of personal leave shall be granted to each full-time certified employee which can be utilized as follows:
a. In the event of death or illness of a close friend or relative.
b. For any business or any emergency.
c. All personal leave may be taken in hour, ½ or full day increments.
Five. (5) days per school year leave with pay to those individuals who are duly elected local, political office holders such as city commissioners or members of the county board of commissioners. The teacher will pay the cost of the substitute.
Five. (5) days’ notice will be given by the Union before leave for such Union business is taken, unless waived by the Employer.
Five. The Arbitration Court may, if it so understands and is requested by any of the parties, to decree precautionary measures or measures to conserve rights, with respect to the adversary principle. Filing a request for arbitration will have a suspensive effect, except in relation to payments of any type, by force of law or the Concession Contract.
