INDEX OF FACILITATIVE PROVISIONS. 1.1 This schedule contains facilitative provisions, which allow agreement between an employer and employees on how specific schedule provisions are to apply at the workplace or enterprise level. Facilitative provisions are not to be used as a device to avoid schedule obligations nor should the provisions result in unfairness to an employee or employees covered by this schedule. Facilitative provisions in this Award are contained in the following clauses: Payment of wages 20 Hours of work - day workers 22.1.3 Meal allowance 21.5 Time off in lieu of overtime 24.7 Shift work - variation by agreement 25.5 Public Holidays - substitute days 31.8 (See ss.113A and 113B of the Act) Where an employer or employees wish to pursue an agreement at the enterprise or workplace about how the award should be varied so as to make the enterprise or workplace operate more efficiently according to its particular needs the following process shall apply: • A consultative mechanism and procedures appropriate to the size, structure and needs of the enterprise or workplace shall be established. • For the purpose of the consultative process the employees may nominate the UWU or another to represent them. • Where agreement is reached an application shall be made to the Commission.

9.3 Where facilitative provisions contained in this Agreement are used the employee may request to be represented by a representative including a representative of a union, in meeting and conferring with the employer about the implementation of the facilitative provisions and if so requested, the employee representative must be given a reasonable opportunity to participate in negotiations regarding the proposed implementation of a facilitative provision. The representative’s involvement does not mean that the consent of the representative is required prior to the introduction of the agreed facilitative arrangements.
