Hours of Work - Day Workers. 12.1 The ordinary working hours of Day Workers shall be 38 per week to be worked Monday to Friday, inclusive, between the hours of 6:00am and 6:00pm.
12.2 However, the spread of hours may be altered by mutual agreement.
12.3 Ordinary hours shall not exceed 10 on any day.
Hours of Work - Day Workers a) For Supervisor Evacuation Equipment, the normal hours of work per day shall be eight (8) consecutive hours of work inclusive of one half hour paid lunch break. The days of work shall be Monday to Friday and days off shall be Saturday and Sunday.
b) For Plant Maintenance Supervisor, the normal hours of work per day shall be eight (8) consecutive hours of work inclusive of one half hour paid lunch break. The days of work shall be Saturday to Wednesday and days off shall be Thursday and Friday. Where operational requirements permit, days of work shall be Monday to Friday and days off shall be Saturday and Sunday. Subject to operational requirements such as planned work periods, this position may be required to work shift work. When shift work is operationally required, the department manager will consult the incumbent and when requested their union representative.
c) For all other employees (day workers) the normal hours of work per day shall be eight and one half (8 1/2) consecutive hours of work inclusive of one half hour paid lunch break and on half hour unpaid lunch break. The days of work shall be Monday to Friday and days off shall be Saturday and Sunday.
d) For vacancies and newly created positions hours of work will be scheduled in accordance with operational requirement.
e) For Assistant Terminal Managers (ATM) and Customer Service Supervisors (CSS), the normal hours of work per day shall be eight (8) consecutive hours of work inclusive of one half hour paid lunch break.
f) The shift schedule shall be established in accordance with operational requirements.
g) Marine Atlantic Inc. will make every reasonable effort:
Hours of Work - Day Workers. (a) The ordinary hours of work for day workers shall be an average of 38.0 hours per week at an average of 7.6 ordinary hours per day, which may be worked within a spread of hours of 4am to 6:30pm Monday to Friday.
(b) A roster of daily working hours, including the meal period, of each employee shall be as determined by the Company provided that the employer shall not alter the working hours of any employee until that employee has had 48 hours notice or has agreed otherwise.
(c) The Company shall, within the limits of the hours above prescribed, have the right to fix starting and ceasing times, which shall be posted in a conspicuous place but such times shall not be altered unless the employees so affected are given seven days prior notice of such alteration; provided that in the event of a machinery breakdown, the Company may upon giving the employees a minimum of twelve hours' notice alter the commencing times of sufficient employees to enable the regular service to be maintained.
Hours of Work - Day Workers. 12.1 The ordinary hours of work for all full-time employees will be an average of 38 per week but not exceeding 152 in 28 days. Ordinary hours will be worked on no more than 5 days in each 7-day period.
12.2 The ordinary hours of work for day workers may be worked between the hours as follows: Hospitality/Catering stream 6am to 7pm Monday to Sunday Cleaning Services stream 6am to 6pm Monday to Friday Recreation stream 6am to 8pm Monday to Sunday The spread of hours may be altered by one hour at either commencement or finish, by agreement between management and the majority of the employees concerned. Agreement may also be reached with an individual employee where the individual requests the alteration.
12.3 Subject to the terms of this Clause and broken shifts, such ordinary hours will be worked continuously except for meal breaks. Provided that the initial starting and finishing times of ordinary hours will be as set by the Company.
12.4 Subject to the terms of this clause the ordinary hours of work prescribed herein will not exceed ten (10) hours on any day, provided that in any arrangement of ordinary working hours where the ordinary working hours are to exceed an average of 7.6 hours on any day, the arrangement of hours will be subject to the agreement between the Company and the employee/s in the section or sections concerned. Where no agreement is reached and consultation has taken place, then the Company may change the duration of working hours (up to the 10-hour limit) and/or the starting and finishing times, by seven (7) days written notice.
12.5 By agreement between the Company and the employee/s in the work section or sections concerned, ordinary hours greater than 10 per day but not exceeding 12 on any day may be worked subject to the Company and the employee concerned being guided by the relevant occupational health and safety provisions and any relevant work safe guidance materials on fatigue and working 12 Hour Shifts.
Hours of Work - Day Workers. 12.1 The ordinary hours of work may be worked on any or all days of the week, Monday to Friday inclusive, between the hours of 6am and 6pm, at the discretion of the Company, following consultation with the local CEPU delegate. The maximum number of ordinary hours per day shall be 8, unless the company and the majority of employees in a section agree to a greater number of ordinary hours.
Hours of Work - Day Workers. 13.1 This clause applies to all Employees, except those employed as Shift Workers.
13.2 A day worker’s ordinary hours are 35 hours per week between the hours of 7 am to 7 pm (Bandwidth) between Monday to Friday.
13.3 In addition to a Day Workers’ ordinary hours as defined in 13.2, for the purpose of accruing time in lieu and/or additional hours, eligibility for paid and approved overtime, will only accrue after the completion of 38 hours worked in that week, subject to clause 15.
13.4 Professional and Technical Employees may be required to work beyond the Bandwidth and be reasonably available for after-hours emergency call in from time to time. Professional and Technical Staff may be required to work on evenings and on weekends or to represent Port Authority at functions, conferences or special events. Any of these hours worked to fulfil Port Authority requirements are reflected in the Employee's Base Salary. Time in lieu will be given as compensation for such out of normal working hours activities in accordance with clause 16.
Hours of Work - Day Workers. 16.01 The regular hours for day workers shall be 7:00 a.m. to 3:30 p.m. with a one-half hour unpaid lunch period to take place between 11:30 a.m. and 1:00 p.m.
16.02 The regular work week will be from 7:00 a.m. Sunday to 7:00 a.m. the following Sunday.
16.03 Time and one-half will be paid for all hours worked on Sunday up to eight (8) hours and double time will be paid for all hours worked in excess of eight (8) between 7:00 a.m. Sunday to 7:00 a.m. Monday. Time and one-half will be paid for all hours worked outside their scheduled shift.
Hours of Work - Day Workers. 34□1 The ordinary hours of work for Day Workers shall be averaged over a four □4□ week period on the Company's sole discretion nomination of either:
34□1 □1 7□6 hours per day between 6□00am and 6□00pm Monday to Sunday inclusive□ averaged as 38 hours per week; or
34□1 □2 7□2 hours per day between 6□00am and 6□00pm Monday to Sunday inclusive□ averaged as 36 hours per week□
34□2 The Company after consulting with affected Employees□ may implement different patterns of working ordinary hours□ including 9□ 10 or 12 ordinary hours per day or per shift□
34□3 Ordinary Hours worked on weekends shall be paid as follows:
Hours of Work - Day Workers. 6.5.1 This clause applies to all Employees of the Employer, except those employed as Shift Workers.
6.5.2 The ordinary hours of work of Day Workers shall be a maximum of 2072 per annum, worked as a minimum of 35 hours per week average over a cycle of 4, 8 or 12 weeks, to be determined by each Employer. Up to 252 ordinary hours may be worked in the terms of the sub-clause 16.6 (Additional Hours) of this Agreement.
6.5.3 Any ordinary hours will be worked on any one-day (Monday to Friday) between the hours of 6:00am and 7:00pm (known as “Bandwidth”).
6.5.4 At the instigation of a Day Worker, notwithstanding any other provision of this clause, the Day Worker(s) and the supervisor/manager may at any time agree to other arrangements provided they meet the needs of the Corporation and the minimum hours are worked within the cycle.
6.5.5 Ordinary hours will exclude meal breaks which will be a minimum of 30 minutes and a maximum of two hours taken having regard to service levels and operational requirements. Time taken for a meal break will not count as hours worked.
6.5.6 One refreshment break is to be taken on the job at a convenient time, having regard to service levels and operational requirements. Time taken for such break will count as hours worked.

Assistant Terminal Managers including Customer Service Supervisors the normal hours of work per day shall be eight (8) consecutive hours of work inclusive of one half hour paid lunch break. The shift schedule shall be established in accordance with operational requirements. Marine Atlantic Inc. will make every reasonable effort: not to schedule the commencement of a shift within twelve (12) hours of the completion of the employee's previous shift; to avoid excessive fluctuations in hours of work; not to schedule more than five (5) consecutive days of work. and to schedule at least two (2) consecutive days of rest at a time. to post schedules of work at least fifteen (15) calendar days in advance of the starting date of the new schedule. An employee who is a shift worker and whose scheduled hours of work are changed by Marine Atlantic without forty-eight (48) hours prior notice shall be compensated at the applicable overtime rate for the first full shift worked on the new schedule. With approval of the employer in accordance with operational requirements and provided sufficient advance notice is given, an employee may exchange if there is no increase in cost to the employer. The employee shall be paid as if no exchange had occurred.
