Involuntary Transfer and Reassignments. A. Notice of an involuntary transfer or reassignment to another school building shall be given to employees and simultaneously to the Association in writing as soon as practical. B. An involuntary transfer or reassignment to another school building shall be made only after a face to face meeting between the employee involved and the immediate supervisor, at which time the employee shall be notified in writing of the reason thereof. The Association shall receive a copy of these reasons. In the event that an employee objects to the transfer or reassignment to another school building at this meeting, the employee may, at his/her option, have an Association representative present at such meeting. C. A list of open positions in the school district shall be made available to all employees being involuntarily transferred or reassigned. Such employees may request the positions, in order of preference, to which they desire to be transferred. D. Such request shall be considered prior to final determination. An employee being involuntarily transferred or reassigned to another school building shall be placed only in a position which does not involve reduction in total compensation. E. The Board reserves sole right to determine assignment of unit members.

Involuntary Transfer and Reassignments. A. Involuntary transfers and reassignments shall be based upon whether or not the involuntary transfer or reassignment serves the educational needs of the District, as determined by the Superintendent. Primary consideration for such transfers or reassignments shall be as follows: District or school site programs, skills and abilities which support a community of learners, and/or special programs to meet the needs of the students. Involuntary transfers shall be based on the following criteria:

Prior to this meeting, however, the employee in question shall receive at least two (2) days advance written notice of the meeting including the reason for which the meeting is called. The employee at his/her option may have up to three (3) Association representatives at such meeting. C. A list of open positions in the school district shall be available to all employees being involuntarily transferred or reassigned. Such employees may request the positions, in order of preference, to which they desire to be transferred. D. The Superintendent’s decision to involuntarily transfer or reassign an employee shall be final and binding and not subject to the grievance procedure.

An employee being involuntarily transferred or reassigned shall not be reduced in rank. Such employees will be given an opportunity for interviews in positions for which they qualify, or can achieve qualifications within thirty (30) days.
