INVOLUNTARY TRANSFERS AND REASSIGNMENTS. X. Xx involuntary transfer or reassignment will be made only after a meeting between the employee involved and the appropriate site administrator, at which time the employee will be notified of the considerations for the transfer and reassignment. If the decision stands following the employee/administrator meeting, the final assignment and considerations shall be summarized in writing.
B. In the event that an employee objects to the transfer or reassignment discussed at the meeting, upon his/her written request, the Superintendent will meet with him /her.
C. Whenever involuntary transfers occur, volunteer(s) shall first be sought (an employee who volunteers for an involuntary transfer will be given the same considerations in determining the school transfer as is given to other voluntary transfers). If no volunteers are identified, factors such as certification, experience, and subject matter expertise will be considered.
D. When a site administrator or supervisor is considering an involuntary transfer or reassignment, they shall discuss the possibility with the affected employee as soon as the information is available, but no later than July 15, if possible. After July 15, the proper administrator will meet with the employee and provide the employee the considerations for any change. If the decision stands following the employee/administrator meeting, the final assignment and considerations shall be summarized in writing.
X. A unit member transferred involuntarily out of his/her certificated/licensed area will not be reduced in salary.
F. An employee being involuntarily transferred or reassigned shall have the right to apply for any vacancy for which he/she is properly certificated.
G. Employees involuntarily transferred or reassigned have the right to request to return to the school from which they were transferred should a position for which they are qualified open prior to the first duty day for employees.
H. A teacher who is transferred involuntarily after the beginning of the school year will be given at least two full days without students or other assignments in order to perform some of the professional responsibilities required to adequately prepare for his/her transfer.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS a. Teachers shall be involuntarily transferred and involuntarily reassigned only for sufficient educational reasons in the best interest of all students. Involuntary transfers and involuntary reassignments shall not be used by any administrator for punitive or disciplinary action. Involuntary transfers will be initiated by consideration of teacher performance based on written evaluation.
b. A decision to involuntarily transfer or reassign a teacher will involve face-to-face collaboration with the building principal and the teacher involved as early as possible to ensure notification no later than April 1st. Upon request of the teacher a meeting shall be arranged between the teacher involved and the Superintendent and/or his designee, at which time the transfer or reassignment will be discussed along with the reasons for the transfer or reassignment. The teacher may choose a representative to be present at such a meeting.
c. Involuntarily transferred or reassigned teachers will be assigned prior to filling vacancies.
d. In the event of unforeseen circumstances or changing economic realities that occur after the April 1st notification period, and after collaborative discussions with the building principal and potentially affected teacher(s), an involuntary transfer or reassignment will be acted upon in a timely manner in the best interest of all students. No teacher shall be disciplined, reprimanded in writing, reduced in rank or compensation without just cause. Any such action asserted by the Board or any agent or representative thereof shall be subject to the grievance procedure herein set forth. Teachers will be notified of contemplated changes or additions in Board policies affecting teacher work conditions, and invited to provide input and discuss such changes prior to any Board action.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. A. Notice of an involuntary transfer or reassignment shall be given to such employee as soon as practicable, and except in cases of emergency not later than July 1.
B. An employee's area of competence, major or minor field of study, length of service, and the best interests of the school system will be considered in determining which employee is to be transferred or reassigned. No employee shall be transferred without the employee's consent solely for the purpose of making open a position for another employee being involuntarily transferred.
C. An involuntary transfer or reassignment shall be made only after a meeting between the employee and the appropriate administrator, at which time the employee shall be notified of the reason therefore. In the event that an employee objects to the transfer or reassignment at this meeting upon the employee's request, the Superintendent or the Superintendent's representative shall meet with him/her. The employee may, at the employee's option, have an Association representative present at all such meetings.
D. A list of positions possible for the employee to be transferred shall be made available in order that the employee may indicate any preference.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. The District shall have the authority to make involuntary transfers and reassignments. Involuntary Transfers and Reassignments are defined as an involuntary change in assignment initiated by the District.
a. Involuntary Transfers or Reassignments will not be arbitrary or capricious, as defined by legal definition.
b. Involuntary Transfers or Reassignments shall not change bargaining unit member’s anniversary date, seniority date within classification, and accumulated leaves/vacation.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. A. Notice of an involuntary transfer or reassignment shall be given to Department Supervisors within one (1) calendar week of the decision.
B. In the event that a Department Supervisor objects to the transfer or reassignment, upon the request of the Department Supervisor, the Superintendent or his/her designee shall meet with him/her. The Department Supervisor may, at his/her option, have an Association representative present at such meeting.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. A. Definition
1. An involuntary transfer is a transfer instituted by the Administration.
2. When circumstances dictate a reduction in position(s) other than a districtwide reduction in force, the Board shall first solicit volunteers from among the group or class to be reduced or transferred. Those who volunteer to transfer shall be treated in accordance with the provisions of Article 7. Should further reduction be necessary, the Board shall transfer remaining employees to positions for which they are deemed qualified elsewhere in the district.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. A. Notice of an involuntary transfer or reassignment shall be given to each teacher involved as soon as possible, and except in cases of emergency, not later than June 15th.
B. An involuntary transfer or reassignment shall be made only after a meeting between the teacher involved and the Principal and Supervisor, at which time the teacher shall be notified of the reasons therefor. In the event that the teacher objects to the transfer or reassignment at this meeting, upon request of the teacher, the Superintendent shall meet with him or her. The teacher may, at his/her request, have an Association representative present at the meeting.
C. Except in cases of emergency, the Superintendent shall notify the staff of all vacancies which occur or the creation of any new positions by posting notice of same on a bulletin board in the school. The Association shall also be notified by sending a copy of the posted notice to the Association President. Except in cases of emergency, no vacancy, reassignment or involuntary transfer shall take place for at least two (2) weeks after posting of notice to allow volunteers time to apply for the position. If someone shall apply or volunteer to fill the vacancy or take the assignment, the Superintendent shall, in his sole discretion, determine whether or not the volunteer may fill said vacancy or be given the assignment. The Superintendent need not give the reason for his decision. The decision of the Superintendent shall not be the subject of an appeal or grievance beyond the level of the Board of Education notwithstanding any language to the contrary contained herein.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. A. In those cases where vacancies as defined in Article 13 can be filled by means of voluntary transfer, requests of qualified teachers for a voluntary building transfer, grade or subject reassignment shall be given consideration before an involuntary transfer is made.
B. Notice of an involuntary building transfer, grade or subject reassignment shall be given in writing to teachers as soon as practicable and, except in cases of emergency, not later than the second Wednesday in June. After the meeting with the Superintendent, if the teacher is dissatisfied with the decision, he/she may indicate in writing that the transfer is involuntary. Backup materials which go to the Board of Education shall contain a copy of this signed statement. The Association shall also be given a list of the teachers who have signed such a statement.
C. 1. In those cases where involuntary transfer is being made under A. above, the building principal shall meet with the teacher affected and inform him/her of the transfer or reassignment. In the event that a teacher objects to the transfer or reassignment at this meeting, upon request of the teacher, the Superintendent shall meet with him/her. The teacher may at his/her option have an Association representative with him/her at such meeting. After the meeting with the Superintendent, if the teacher is dissatisfied with the decision, he/she shall indicate in writing that the transfer is involuntary. Backup materials which go to the Board of Education shall contain a copy of this signed statement. The Association shall also be given a list of the teachers who have signed such a statement.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. A. Involuntary transfers shall be accomplished as follows:
1. Definition - Transfers shall be construed as grade level, subject areas, and/or building assignments.
2. In the event of an involuntary transfer or reassignment, the employee shall have the right to a conference with his building principal, or nonprofessional supervisor, and the Superintendent. This conference shall be to discuss the best reassignment possible and the employee shall have the right to request a statement in writing of the reasons for such involuntary transfer.
3. As much advance notice shall be given as possible before any transfer.
INVOLUNTARY TRANSFERS AND REASSIGNMENTS. The Chancellor or his/her designee may involuntarily transfer employees when, in the Chancellor’s or his/her designee’s judgment, such transfers are necessary for the efficient operation of the District.
