LEAVE OF ABSENCE ADMINISTRATION. A. Leave of Absence requests shall be submitted in writing to the Township Administrator stating: 1. Reason for Leave of Absence; 2. Date Leave of Absence is to begin; and 3. Date Leave of Absence is to end. B. Leave of Absence may not commence or end on the day preceding or following Vacation Leave. C. An Employee that obtains a Leave of Absence for a reason other than the one stated at the time the request was made may be terminated from his employment solely at the discretion of the Township. D. An Employee may not return to work prior to expiration of requested Leave of Absence without the express prior approval of the Township Committee. E. Failing to return to work on the date scheduled without proper authorization for an extension shall be cause for termination of employment a the sole discretion of the Township. F. Time absent from duty by an Employee on Leave of Absence without Pay shall not be considered as continuous service. G. Upon return of an Employee from a Leave of Absence without Pay, Employee shall be re-employed at work generally similar to that which he did last and at the prevailing rate of pay for that job, if available.

LEAVE OF ABSENCE ADMINISTRATION. A. We agree to assist you with the tracking and administration of leaves of absences for Staff by: i. documenting and tracking Staffs’ time away from work while on an approved leave of absence as reported to us by you or Staff; ii. notifying eligible Staff of their leave rights and applicable leave designations; iii. providing eligible Staff with information regarding filing a claim for state disability or family and medical leave and with respect to such claims filed by Staff, responding to inquiries from the applicable state administrators; iv. providing eligible Staff with coverage under our New York State Disability and Family leave policy and information to those Staff regarding filing a claim under such policy; and v. providing eligible Staff with coverage under our Hawaii state disability policy and information to those Staff regarding filing a claim under such policy. B. Notwithstanding the foregoing, you are responsible for compliance with FMLA and state and local leave Laws, and you further agree to the following: i. to review and submit leave of absence requests to Insperity’s Leave Self-Service Portal timely, but no later than two (2) business days after Staff has begun an approved leave of absence; ii. to timely report any changes to Staff’s initial leave request to Insperity’s Leave and Disability Administration team, respond to requests for additional information, provide at least monthly updates following the expiration of any certifications provided by Staff, and comply with our business rules made known to you for temporary layoffs; iii. you will initiate the return-to-work process at the end of Staff’s leave of absence; and iv. you will return Staff to work at the end of the leave of absence in accordance with applicable leave Laws.

Xx Employee failing to return to work on the date scheduled shall be cause for termination of employment at the sole discretion of the Township without recourse to the Grievance procedure over such termination. F. Time absent from duty by an Employee on a Leave of Absence Without Pay shall not be considered continuous service. G. Upon return of an Employee from Leave of Absence Without Pay, Employee shall be re-employed in a capacity generally similar to that which Employee was last employed and at the prevailing rate of pay for that position, if available. H. Any Employee who has been away from work on a Leave of Absence Without Pay longer than six (6) months will be subject to a Fitness for Duty Examination and a background check to ensure the Employee’s ability to resume their employment.

  • Educational Leave of Absence Leaves of absence may be granted up to six (6) months under the above provisions only if the course would be beneficial to both the University and the employee.

  • Military Leave of Absence Upon application, a military leave of absence without pay will be granted to employees who are inducted through Selective Service or voluntary enlistment, or those called through membership in the National Guard or reserve component into the Armed Forces of the United States. Credited service for military service shall be determined by the retirement plan.

  • Approved Leave of Absence With Pay During Vacation When an employee is qualified for bereavement leave, sick leave or any other approved leave with pay during her vacation period, there shall be no deduction from the vacation credits for such leave. In the case of sick leave, this section shall only apply when the period of illness or injury is in excess of two (2) days and a note from a physician may be required. The period of vacation so displaced shall be taken at a mutually agreed time. An employee intending to claim displaced vacation leave must advise the Employer and provide necessary documentation within seven (7) days of returning to work.

  • LEAVE OF ABSENCE 12.01 Employees requesting leave of absence shall make written application to their Location Manager giving at least seven (7) working days· notice. The Company may, at its discretion, grant such leave of absence for a period of up to three (3) months provided the services of the employees are not immediately required and there is an employee available who has the qualifications to perform the work. Such leave of absence shall be granted in writing, with a copy to the Local Chairperson. Leaves of absence will not be granted during the month of September. The Company's response to the request shall be given in writing within seven (7) days of the· Company receiving the employee's written request. 12.02 Leave of absence may be extended in writing by the Company upon application in writing from the employee, provided such application is received at least seven (7) calendar days prior to the expiration of the leave of absence. 12.03 An employee who fails to report for duty on or before the expiration of a leave of absence shall forfeit his seniority and his name will be removed from the seniority list. In the case of an employee being granted an extended approved unpaid leave 6f absence, the employee may not be permitted to sign for a regular school run and/or the run vacated by the employee may be posted. 12.04 Absolute proof of illness preventing return upon expiration of leave of absence shall excuse an employee's failure to return at that time. 12.05 Leave of absence shall not be granted to enable an employee to work outside the Company's service. Leave of absences or illness longer than five (5) working days will be posted as a temporary position. 12.06 An employee elected as a full-time representative of the Union shall be granted leave of absence without pay while so engaged. 12.07 Upon written request of the National Representative, Local President and/or Local Chairperson, employees delegated and attending general business of the Union shall be granted leave of absence without pay for that purpose. As much advance notice as possible will be given by the National Representative and/or Local Chairperson prior to the effective date of the requested leave of absence. The Company will pay lost time for regular scheduled work for all union leaves under this article to employees at their regular rate of pay and such rate of pay will be reimbursed by Unifor Local 195. 12.08 The name of an employee who is on authorized leave of absence shall be retained on the seniority list and shall continue to accumulate seniority. School bus drivers on an approved leave shall be returned to their scheduled work on the scheduled return date. 12.09 An employee wishing to return from leave of absence prior to the expiration of his approved period of leave must advise his Supervisor at least seven (7) days in advance of the date upon which he wishes to return to work. The Supervisor will, if such leave is due to illness, make every effort to change the work schedule to accommodate the returning employee, but if this is not possible, the employee shall return at the earliest possible date following the receipt of such notification by the Supervisor. If the leave were for other reasons, the employee will resume his duties at a time specified by the Company.

  • Medical Leave of Absence Where you have a medical leave of absence due to any medically determinable physical or mental impairment that can be expected to result in death or can be expected to last for a continuous period of not less than six months, and you have not returned to employment with the Company or an Affiliate, a Separation from Service has occurred on the earlier of: (A) the first day on which you would not be considered “disabled” under any disability policy of the Company or Affiliate under which you are then receiving a benefit; or (B) the first day on which your medical leave of absence period exceeds 29 months.

  • Leave of Absence for Union Functions It is agreed that official representatives of the Union be granted leave of absence, without pay, to attend Union Conventions or perform any other function on behalf of the Union and its affiliations, provided not more than ten (10) Union representatives shall be away at any one time. Such leave of absence shall not affect the employee's seniority and/or benefits contained in this Agreement.

  • Union Leave of Absence An employee on an unpaid Union leave of absence shall have her wages, benefits and seniority continued by the Employer, and the Union agrees to reimburse the Employer for the costs of such wages and benefits. Such leave (including travelling time) shall be granted to attend preparatory negotiating meetings, to conduct negotiations, and to participate in mediation, industrial inquiry commissioner hearings and arbitrations. D) selected by the Union or its members as a delegate to attend the Provincial Bargaining Conference. E) selected by the Union or its members as a delegate to attend regional Bargaining Conference.

  • Sick Leave During Leave of Absence (F/T) When an Employee is given leave of absence without pay for any reason, or is laid off on account of lack of work, he/she shall not continue to accumulate sick leave and shall not be entitled to receive pay for sickness for the period of such absence, but shall retain his/her cumulative credit, if any, existing at the time of such leave or lay-off.

  • Return from Leave of Absence (a) Before a Nurse may return to work from a leave granted under Article 9.00, she or he must provide a minimum of four (4) weeks written notice of the specific date of his or her return to work, or such shorter time as mutually agreed. (b) Upon return from an approved Unpaid Leave of Absence, a Nurse shall be reinstated to her or his former position unless the position has been discontinued, in which case the Nurse shall be appointed to an equivalent position. (c) This clause requiring four (4) weeks written notice, does not apply to other leaves granted by an express provision of this Collective Agreement with different requirements for written notice.

  • Leave of Absence With Pay 1. A leave of absence with pay shall be granted to any employee who serves on a jury or as a witness for the federal government, the State of Nevada, or a political subdivision thereof. The employee shall be paid his/her regular salary while on court leave and retain any witness or jury duty fees, when summoned for jury duty or serving as a witness in any case. When an employee, serving in his/her official capacity as a County employee and as part of his/her required duties, serves as a witness in any case, he shall not receive witness fees. Per diem and transportation costs may be paid by the requesting jurisdiction, considering such variables as whether or not the case is a criminal or civil matter, whether it is in State or out-of-state, the length of time the employee is required to stay away from the job and who receives ultimate benefit from the County employee’s testimony. Court leave shall not be charged to any employee’s annual leave balance. 2. When it is impractical for a registered voter to vote before or after his/her normal working hours, an employee will be granted sufficient time to vote.
