Maintenance, Warranty and Exclusions. 8.3.1 X-on will use all reasonable endeavours to make the service available 24 hours a day, 7 days a week. 8.3.2 Support working hours as described in the Service Level Agreement (SLA) in section 4 are between 8.00am and 5.30pm Monday to Friday, excluding public and bank holidays. All other hours are classed as being outside working hours. 8.3.3 Customer requested X-on engineer site visits will be charged at the daily rate as stated in Appendix A except where X-on support staff have deemed it necessary to rectify a problem in line with the SLA. 8.3.4 Fault responses are graded according to criticality of the fault reported and the Customer service Agreement level. 8.3.5 Planned maintenance to the Customer's service will only take place after prior notification to a Customer's nominated representative and at hours that cause the minimum disruption to service. Planned maintenance is an exceptional event since X-on operates three independent data centres, each of which can support all customer services and maintenance will only be performed on one data centre at any given time. 8.3.6 Planned maintenance is excluded from service availability commitment calculations. 8.3.7 X-on reserves the right to charge a fee based on the maintenance support outside of Agreement as per the rates stated in Appendix A, for faults reported in working hours, that are as a result of misoperation or failure of Customer premise or third party network termination equipment. 8.3.8 X-on will always charge a fee based on the maintenance support outside of Agreement rates stated in Appendix A for faults reported out of working hours, that are as a result of misoperation or failure of Customer premise or third party network termination equipment. 8.3.9 The service level availability commitment is calculated based on the following formula: The total number of minutes available in the month, less the total number of minutes available in the month multiplied by the service level availability. For example the calculation for May would be 31 days x 24 x 60 = 44,640 (available minutes) x 99.99% (service availability commitment for Gold) = 44,635.54 minutes of service level availability commitment for May. 8.3.10 The service is deemed to be available if it is operational without critical problems 8.3.11 Should X-on fail to meet the stated service availability level, it will raise a service credit against the next month's due charges of 20% of the standard monthly rental charge for each 1% it fa...

  • Warranty Exclusions The Limited Warranty in clauses 1.2 and 1.3 does not apply: a) if the Product was not purchased and installed in Australia; b) if You do not grant BYD or BYD Partner access to the performance data of the Product over the Internet upon request after reporting the warranty claim and/or manipulate such data; c) to wear and tear in the appearance of the Product (including but not limited to any scratches, stains, mechanical wear, rust or mould) which does not impair its function; d) to any damage to property or personal injury arising from any defect if the state of scientific and technical knowledge at the time when the Product is sold to Original Buyer was not such as to enable the defect to be discovered; e) if the invoice for the Product and the information listed in clause 4 below is not provided with the warranty claim; or f) if the serial number on the Product can no longer be identified or has been modified.

  • Limited Warranty and Limitation of Liability Veeam warrants that it has the right and authority to grant the License under this XXXX. Veeam will defend or, at its option, settle any action against End User based upon a claim that its use of the Software infringes any patent, copyright or other intellectual property right of a third party, and will indemnify End User against any amounts awarded against End User as a result of the claim, provided Veeam is promptly notified of the assertion of the claim and has control of its defense or settlement. Veeam warrants that the Software, in its unmodified form as initially delivered or made available to End User, will perform substantially in accordance with the Documentation for a warranty period of ninety (90) days from the date the Software is delivered to End User. In the event the Software fails in a material respect to operate in accordance with the Documentation during the warranty period and Veeam is unable to correct the defect, Veeam’s sole and exclusive liability and End User’s sole and exclusive remedy shall be a refund of the License fee, if any, paid by End User for the Software. In the event a reported problem with the Software is End User’s fault, End User agrees to reimburse Veeam for its correction efforts in accordance with its then standard rates. The foregoing limited warranty will not apply if failure of the Software is the result of damage or misuse caused by End User.
