MANAGEMENT RIGHTS AND DISTRICT POWERS. 5.1 It is understood and agreed that the District retains all powers and authority to direct and control District operations to the full extent of the law. Included, but not limited to those duties and powers, are the rights in accordance with the applicable laws and District regulations to direct the work of unit members, to determine the means and services to be provided, establish the educational philosophy and the goals and objectives of the District, school and/or other activity, to insure the rights of students, unit members, managers and Board of Education members; to determine the number and kinds of personnel required; to determine the job descriptions, to maintain the efficiency of the School District operation, to determine the curriculum with unit member consultation, to build, move or modify the facilities, to develop a budget; to develop and implement budget procedures with staff input, to determine the methods of raising revenue. In addition, the District retains the right to hire, assign, evaluate, terminate, and discipline unit members. Further, the District reserves the right to do all that is necessary to exercise the foregoing power, rights, authority, duties, and responsibilities, including but not limited to, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, and shall be limited only by the specific and express terms of this Agreement, in conformance with the laws of the State of California.

4.2 The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the Board, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and expressed terms of the Agreement, and then only to the extent that such specific and expressed terms are in conformity with the laws of the State of California.

4.2 This Agreement may be modified by the Board in cases of extreme emergency such as earthquake, fire, flood, or major civil disruption, and then only to the extent necessary to allow the District to function and to protect the health and safety of the students and staff during an emergency. The determination of the existence of an emergency in this Article shall be subject to expedited arbitration.

In addition, the Board retains the right to hire, assign, reassign, transfer, evaluate, promote, terminate and discipline employees, and to take action on any matter in the event of an emergency.
20.2 The exercise of the foregoing powers, rights, authority, duties and responsibilities by the District, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms of this Agreement, and then only to the extent such specific and express terms are in conformity with the laws of the State of California.
20.3 The Board will amend its written policies and procedures and take such other action by resolution or otherwise as may be necessary to give full force and effect to the provisions of this Agreement.
20.4 The Board of Trustees retains its right to amend, modify or rescind policies and practices referred to in this Agreement in cases of emergency. Emergency conditions would include dangers to the health and safety of the staff and/or students such as civil disorder, natural disaster, school system malfunctions (heating, plumbing, electrical, etc.).
20.5 The determination of whether or not an emergency exists is solely within the discretion of the Board and is expressly excluded from the provisions of Article 6 -- The Grievance Procedure.

Included, but not limited to, those rights are: determining the methods, means and services to be provided; establishing the educational philosophy and the goals and objectives; determining the staffing pattern, number and kinds of personnel required; determining the curriculum; and building, moving or modifying the facilities and developing the District budget.
6.2 In making the above appropriate decisions, concerned teachers will be consulted and involved, or a notification letter sent to said person.
6.3 Further rights and powers of the District include, but are not limited to, the following: insuring the rights and educational opportunities of students; determining the classification of positions; maintaining the efficiency of the District operations; and determining the methods of raising revenue and contracting out work. Additionally, the District retains the right to hire, assign, evaluate, promote, terminate and discipline employees.
6.4 The exercise of the foregoing powers, rights, authority, duties and responsibilities by the District, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms of this Agreement. In addition, the District retains the right to take reasonable action on all matters in the event of an emergency. Emergencies shall be defined as: natural disasters, national emergencies; and local occurrences of enormous gravity beyond the control of the School District and its employees.

In addition, the Board retains the right to hire, assign, evaluate, promote, terminate, and discipline employees according to the Education Code; and, to take action on any matter in the event of an emergency.

The exercise of the foregoing powers, rights, authority, duties, and responsibilities by the District, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms of this Agreement, and then, only to the extent such specific and express terms are in conformance with the laws of the State of California. Section 1: It is completely understood and agreed that the District retains all of its rights and powers and its authority to direct and control to the full extent of the law. Included in, but not limited to, those duties and powers are the right to direct the work of all of its employees; to determine the method, means and services to be provided; to establish the educational philosophy, goals, and objectives of the District; to ensure the rights and educational opportunities of the students; to determine the staffing patterns; to determine the number of kinds of personnel required; to determine the classification of positions; to maintain the efficiency of the District operations; to introduce new or improved methods or facilities; to change existing methods or facilities; to build, move, or modify the facilities; to enforce any rules, regulations, laws, or District policies, to carry out the responsibilities of the District in any legal manner, shape, or form; to determine the curriculum; to develop a budget, to develop and implement budget procedures; to determine the methods of raising revenues; and contract out work. In addition, the District retains the right to hire, assign, evaluate, promote, demote, terminate, suspend, transfer, lay off, and discipline employees and to take whatever action the District deems necessary and appropriate on any matter in the event of an emergency.
Section 2: In the exercise of the foregoing powers, rights, authority, duties, and responsibilities by the District, the adoption of policies, rules, regulations, and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and express terms of this Agreement, and then only to the extent such specific and express terms are in conformance with any Federal or State law, rules, or regulations.
Section 3: The District retains its right to amend, change, alter, or rescind policies and practices referred to in this Agreement in cases of emergency or for any other reason deemed necessary and appropriate by the District. The determination as to whether or not an emergency exists is solely within the discretion of the Board Members and is expressly excluded from Article 20 of this Agreement.
