Non-Routine Maintenance. Xxxxxxxx shall pay its Pro Rata Share of WinStar's direct Costs for maintenance in respect of the Xxxxxxxx Connectivity other than Routine Maintenance Services, if the Cost of such work relating to any single event or multiple related events is greater than Five Thousand Dollars ($5,000.00).
Non-Routine Maintenance. WinStar shall pay its Pro-Rata Share of Xxxxxxxx' direct Costs of non-Routine Maintenance of the System, if the Cost of such work relating to any single event or multiple related events is greater than five thousand dollars ($5,000.00).
Non-Routine Maintenance. Activities that require specialized skills or training that are associated with irregular or out of the ordinary upkeep of a building, equipment, machine, plant, or system. Examples: Slurry seal, carpet and flooring replacements, appliance replacements, minor roof and gutter repairs, dryer vent cleaning.
Non-Routine Maintenance. Except as otherwise provided in the last sentence of this Section 10.1(b), User shall pay and reimburse Zayo for User's proportionate share of all Costs incurred by Zayo in connection with non‑Routine Maintenance of the Zayo System and the User Dark Fibers (including repairs required as a result of Cable cuts or natural or man‑made disasters), within thirty (30) days of User's receipt of Zayo's undisputed invoice therefore, provided such non‑Routine Maintenance (i) is not work necessitated by Zayo’s negligence or willful misconduct, (ii) is not the result of Zayo's or a third party user’s elective maintenance or repair requests, and (iii) Costs reflect reimbursements that Zayo may receive from a liable third party and such are proportionately credited to User’s proportionate cost share. User’s proportionate share of such Costs shall be determined and allocated as follows: (a) if the affected portion of the Zayo System includes any Innerduct other than the Innerduct housing the User Dark Fibers, the total Costs first shall be allocated equally among all of the affected Innerducts and the Innerducts housing other dark fiber; and then the Costs allocated to the Innerduct housing the User Dark Fibers shall be allocated based on the ratio to which the number of User Dark Fibers bears to the total number of fibers in such Innerduct; or (b) if the affected portion of the Zayo System does not consist of any Innerduct other than the Innerduct housing the User Dark Fibers, the Costs shall be allocated based on the ratio to which the number of User Dark Fibers bears to the total number of fibers within the affected portion of the Zayo System. Notwithstanding the first sentence of this Section 10.1(b), to the extent such non‑Routine Maintenance relates to (i) work necessitated by User's negligence or willful misconduct or (ii) User's elective maintenance or repair requests, User shall pay and reimburse Zayo for one hundred percent (100%) of all Costs incurred by Zayo in connection with such non‑Routine Maintenance plus a management fee for such work equal to fifteen percent (15%) of such Costs, within thirty (30) days of User's receipt of Zayo's invoice therefore.
Non-Routine Maintenance. 5.1. Upon City’s notification of interruption of City’s use of the FOC, or otherwise learning of disrepair, impairment or other need for repair or restoration of the FOC, Contractor will determine the precise location of the problem and mobilize technicians to commence necessary repair or restoration, including to have maintenance personnel at the affected site within four (4) hours after receipt of such notice with the required restoration material and equipment.
5.2. The requirement for detection of fault location “as exact as possible” utilizing test records, fiber documentations, and/or OTDR test results of the affected FOC.
5.3. When restoring a FOC that has been cut or otherwise impaired, Contractor will restore all traffic as quickly as possible. Contractor immediately upon arriving at the site of the cut or other impairment, will determine the best course of action to be taken to restore the FOC and will immediately begin restoration efforts.
5.4. Contractor’s Maintenance employees will correct or repair fiber discontinuity or damage, including the emergency repair of the FOCs. Contractor will repair the FOC’s traffic-affecting discontinuity as soon as possible after learning of the discontinuity or the service-affecting situation.
5.5. For purposes of this Exhibit B. “commercially reasonable efforts” means activities and performances consistent with prudent industry best practice, preserving Contractor Network integrity, and response times that do not jeopardize the health and safety of employees and agents of Contractor and City.
5.6. Upon completion of a FOC impacting maintenance activity that changes the Route of the Distribution Cable(s), Contractor will also deliver a map to City within ten (10) business days of completion that describes the change to the Distribution Cable(s) Route.
5.7. Contractor will ensure that it has adequate personnel and equipment capacity to respond to at least two (2) simultaneous Outages.
5.8. Subject to Force Majeure allowances listed in the Master Services Agreement, Contractor will maintain a disaster recovery plan, detailing the restoration procedures in response to natural disasters including without limitation: tornado, ice storm, flood, high wind, wildfire, and vandalism. Contractor will keep adequate labor (in-house or through contract) and materials to begin executing such plans within one (1) day at all times.
Non-Routine Maintenance. A. Structural Maintenance
1. Inspect pipe systems quarterly.
2. Remove and replace pipe systems that have eroded or rusted.
3. Earthen structures should be inspected annually. Erosion should be repaired immediately upon discovery.
Non-Routine Maintenance. AGLN shall provide telephone number(s) to the User for the purpose of reporting problems to the AGLN. When reporting a problem, the User shall provide the following information to the AGLN: · Type/nature of problem · Classification of the problem (as defined below) · Location of the problem · Any other pertinent information that may help in identifying and resolving the problem in an expedient manner. When AGLN identifies or is notified of a problem via System alarm, User, or third party notification, AGLN will initiate repair/response activities as appropriate and necessary for the type of problem being reported. Problems shall be classified according to the following definitions: Major: A major failure is defined as a failure of the AGLN System resulting in an outage condition for multiple Users (e.g., cable cut). AGLN shall have its first maintenance technician on site within two (2) hours after the time AGLN becomes aware of a major failure (whether same occurs within normal business hours or after-hours, weekend or holiday), unless delayed by circumstances beyond its reasonable control.
Non-Routine Maintenance. Arvada shall provide non-routine maintenance of AFON. Non-routine maintenance means maintenance that is needed to restore the functionality of AFON due to modification of AFON. This includes construction and expansion activities.
Non-Routine Maintenance. During the Term of this Agreement, the Landlord shall be responsible for major repair, replacement, and maintenance of the Premises for items that are not directly related to Tenant’s use and possession of the Premises and the normal wear associated with such use and possession (“Non-Routine Maintenance”), which may include repair, replacement, and maintenance such as repair, replacement, or maintenance of the Building roof, foundation, or structural soundness of the exterior. The Landlord shall act timely and diligently to provide for such Non-Routine Maintenance upon notification by the Tenant of any matters requiring such maintenance.
Non-Routine Maintenance. Emergency outlet maintenance Bank repairs Sediment removal Geotextile liner repair Improper encroachment Landscaping – Landscaping activities such as mowing, weeding/invasive species removal, pruning, fertilizing, transplanting, irrigation system monitoring and maintenance, and leaf removal should be performed on a regular basis based on proper care guidelines for the plant species selected for the project. Sports facilities – Activities such as baseball infield maintenance, baseball diamond and soccer field marker striping, court sweeping/refinishing, bocce court maintenance, and general sports equipment maintenance should be performed on a regular basis based on level of use and the resulting wear. Additionally, routine inspections should be performed to identify if any damaged equipment poses a hazard. Playgrounds – Inspection and maintenance of playground equipment, safety equipment (i.e., wood chips, padding) should be performed on a regular basis depending on the level of use and resulting wear. Optional Services include work not anticipated in the Operation and Maintenance Plan which may be required to provide for public safety or compliance with statutes or regulations within the properties and facilities owned by the EGCSD. Optional Services shall be provided only upon prior written authorization by EGCSD, and only if the cost of the work is within the indicated budget, excepting in the event of an emergency, in which case UCP may provide the response and repair services and notify EGCSD as soon as reasonably practicable. An “emergency” as used herein means only the following events: fire, flash flood, earthquake, Act of God, Act of War, and or an immediate unexpected threat to public health or safety which poses a substantial risk of serious bodily harm. Cost of services provided for such emergency services under this Agreement shall not exceed the Total Annual amount of $20,000.
