Obligation of the User. 2.1 You agree that the User shall be responsible for proper; tamper proof and damage proof packing of the products.
2.2 You agree that you shall use good quality tapes, duly engraved with your trademark/name, etc. and not generic tapes for the packaging/sealing of the goods/shipments. In case generic (xxxxx/plain) tapes are used in the packaging/sealing of the goods/shipments, BFRS shall have no responsibility of any kind, in case of pilferage/damaged/alteration/tapering/leakage etc. of the goods/shipments. In such a scenario, the entire responsibility shall be of the User.
2.3 User shall be ready with the packed order when the courier person comes to receive the shipment, all pick-ups should be logged before the cut off time as directed by the customer support team of BFRS, and no pick up beyond the cut-off time of the logistics partner shall be possible. User agrees that they shall contact the Courier Company personnel for the pickup arrangements.
2.4 User shall collect receipt(s) of the signed copy of the shipping manifest; it is the proof of handover of shipment to the courier companies.
2.5 User shall strictly only use the automated system for generating the pickup and move the shipment only on the Airway Xxxx number generated from the ShipRocket administration panel provided during signup by the User for shipping services. If the User moves the shipment through the physical shipping docket or physical airway xxxx number – then damages of INR. 1000/- (Indian Rupees One Thousand) only shall be charged per airway xxxx number issued. In addition, User shall not book/ship two or more shipments against a single AWB number or send multi packet shipments, and any breach of this condition by the User (whether intentional breach or not) shall give right to BFRS to claim the concerned expenses (including the freight amount of all the shipments) and liquidated damages of upto Rs. 10,000/- per incident/shipment (and applicable GST amount) from the User. However, this restriction shall not be applicable if the User has activated MPS (multi packet shipments) services with BFRS.
2.6 User should properly paste and insert the invoice, in and on the package.
2.7 User shall agree that the Service is only for locations already registered on User’s user panel i.e. the orders will be picked by the courier companies from only such locations which have been registered by the User.

Obligation of the User. The User shall be obligated to the following, besides the matters mentioned in the previous articles at the time of receiving the Service.
(1) The User must use the electronic certificate only for the purpose set out in the Agreement and others.
(2) The User must view the website and others regularly to obtain information regarding the Service.
(3) The User must bear responsibility and the cost for preparation of the equipment, software and internet access and other necessary devices in order to use the Service.
(4) The User must make a responsible decision under the previous items for usage of electronic certificate.
Obligation of the User. 18.1 Obligation of tracking financial flows The User commits to fulfilling all the obligations regarding the traceability of financial flows for which he is responsible, and to inform SWAG OÜ of each Wallet he owns; the User is obliged to indemnify and hold harmless SWAG OÜ from any responsibility and/or prejudice and/or claims of third parties directly or indirectly connected to and/or resulting from the violation of the aforementioned obligation.

The company merely provides instructions for the proper use of the equipment for whatever indication is prescribed by the physician. Exogen may terminate this agreement if the User attempts, or allows any other party to attempt to make any unauthorized use, inspection, repair, or adjustment to, or to make available to any other party the content, design, or mechanism of the equipment. The User understands that the equipment is intended only for their personal use. The User agrees to handle and use the equipment with reasonable care. CAUTION: Federal law restricts this device to be used on the prescription of a physician. Use is restricted to the individual for whom it is prescribed.

Obligation of the User. The User undertakes the designing, constructing, erecting, testing, commissioning and completing the power project in accordance with Applicable Law and Grid Code and shall observe, fulfill, comply with and perform all its obligations set out in this Agreement or arising here under;
i. The User undertakes to pay one-time Non-refundable land charges (in case of generator) to the KPTCL in case the space is provided by the KPTCL for installation/ Erection of connection works equipment/dedicated transmission line of the User in its substation premises. In case, the space for the connection works equipment is arranged by the User, and the User wishes to handover the land along with equipment installed therein to the KPTCL for the sole purpose of carrying out operation and maintenance, the User after signing a separate O&M agreement, shall pay the O&M charges to KPTCL as per KERC Orders/ Regulations/KPTCL Corporate Orders issued from time to time.
ii. The User undertakes to erect dedicated transmission line or service line, as the case may be, from the point of Generator’s switchyard or Bulk Consumer’s substation to the KPTCL’s Substation/switching station at its own cost in line with evacuation scheme letter of KPTCL/ Power sanction letter of ESCOMs.
iii. The User undertakes to execute connection works required at the Inter-connection point with its dedicated transmission line/service line as the case may be, at its cost to get connected to Transmission system of the KPTCL in line with the CEA (Technical Standards for construction of Electrical Plants and Lines) Regulation- 2010 and as amended from time to time.
iv. The User undertakes to pay the applicable charges as demanded by the KPTCL from time to time.
v. The User (in case of Bulk consumer) undertakes to submit a current and enforceable Service Connection Agreement in place with an Electricity supply company for the supply of electricity to the Facility and to comply with any other obligations which are required to be satisfied prior to Connection, as set out in the Power sanction letter.
Obligation of the User. The User undertakes:
8.1 to use the Practice Number in accordance with the provisions of this Agreement, the BHF’s codes of conduct and policies relating to the use of the PCNS and/or Practice Number;
8.2 to use the Practice Number exclusively for such purposes as set out in clause 5;
8.3 not to reproduce, copy and/or disclose any part of the PCNS for purposes other than those set out in clause 5 without the BHF’s prior written consent;
8.4 not to allow any third party who does not have a Practice Number to log onto the PCNS with the User’s login details, and/or to use the PCNS on behalf of the User, unless such third party is duly authorised by the User to use the User’s Practice Number for the purposes as set out in clause 5;
8.5 not to allow any fraudulent use of the User’s Practice Number;
8.6 to immediately notify the BHF of any unauthorized use of the User’s Practice Number;
8.7 to immediately notify the BHF of any security breach of the User’s profile on the PCNS;
8.8 to supervise and control the use of the Practice Number in accordance with the terms of this Agreement;
8.9 to make use of the necessary communications equipment required for accessing the PCNS;
8.10 to immediately notify the BHF in writing of any problems that the User may experience while using the PCNS; and
8.11 to ensure that the User’s information on the PCNS is always current and updated.
Obligation of the User. The “User” undertakes to construct, maintain and operate any User’s Equipment, and when applicable the Generation Facilities, connected to the Connection Point in compliance with the Grid Code.
