OPERATOR CERTIFICATION. All operators of public water systems on the Navajo Nation must be certified to operate such a facility. The Director shall develop by regulation a program, consistent with guidelines published by the Administrator pursuant to § 1419(a) of the SDWA Amendments of 1996 (Pub. L. 104-182), to certify all public water system operators in accordance with the standards described below. The Director shall serve as the Certification Administrator. The Director shall:
A. Implement a program requiring the certification of all operators of public water systems and requiring that such operators comply with the applicable requirements of the certification and training program;
B. Classify all public water systems and specify operator certification, renewal and re- certification procedures and requirements for each level of classification;
C. Establish minimum operator qualifications to validate skills, knowledge, ability and judgment for each level of classification, and include provisions for reciprocity for operator certifications from neighboring states;
X. Xxxxxxxxx procedures for suspension, revocation and other appropriate enforcement action for operator and owner noncompliance;
E. Establish a fee system for the examination and certification of operators;
X. Xxxxxxxxx an advisory committee for ongoing involvement in the revision and operation of operator certification; and
G. Develop a procedure to review and evaluate the adequacy of the operator certification program, including to revise the certification requirements based on revisions to applicable law and on new technology or construction techniques that change operator requirements.

As a condition of employment, newly hired Operator-in-Training employees who do not possess a Certificate of Competence will apply for an Operator-in-Training Certificate and pay any applicable fee to the State Water Resources Control Board and submit proof of such application to the Human Resources Department within ten

OPERATOR CERTIFICATION. The examination must be taken at the first opportunity upon meeting criteria. If failure on the first attempt occurs, the SOE must apply for and retake the second examination or third examination if necessary, as they are scheduled and given by the state. If the SOE fails the second examination, the Company and the Union will meet to discuss and evaluate the individual’s performance on the prior two tests to determine if taking the third examination is warranted. The employer will provide training to prepare for the examination(s) and will pay the costs of taking the examination and maintaining the certification. Preparation Testing Maintain A SOE who fails to certify as described above may be excessed from the MSA water systems group. If it is necessary to backfill the resulting vacancy, the normal procedure of LAMP will be followed. The SOE leaving the MSA water systems group would fill the first backfill vacancy subsequently created. If the LAMP procedure does not produce a candidate, the SOE may “bump” the least senior SOE within the Company. In the event of an excess and/or lay off, all SOEs in Seniority Group 005 will be treated as one classification. All SOEs in the MSA water systems group (at present or in the future) who acquire and maintain any Level 1 required state water/waste water certifications will receive $27.48/week certification pay. This action will be effective on the first Monday following receipt of notification from the state that the SOE has achieved the certification. All MSA Water and Sewer Utility SOEs who have previously attempted to obtain a certification by testing and have failed, will be grandfathered from obtaining them. The certification pay will be removed if the certification expires or becomes invalid. The pay will also be removed if the SOE is no longer employed in the MSA water systems group. Mission Support Alliance, LLC (MSA) and the Hanford Atomic Metal Trades Council (HAMTC) agree to the terms and conditions of these documents, which will continue in full force and effect during the term of this agreement.
OPERATOR CERTIFICATION. Each and every operator must have certified personnel in order to take part in the RG Nets support ecosystem. Operators are expected to maintain current certifications with the RG Nets product lines that they sell and install. The process to acquire and maintain certifications evolves with the RG Nets product lines and available training materials. As of 15-SEP-2018, basic foundation certifications require a written exam whereas trainer certifications require written and practical exams as well as demonstrations of training acumen in a live setting. The RG Nets Certification Portal allows everybody to keep track of operator personnel who have been granted certifications. The Certification Portal is a publicly accessible website that may be accessed by anybody at any time for verification of certifications at the URL xxxxx://xxxxxxxxx.xxxxxx.xxx Certified Operators with active OSAs have access to the Trouble Ticket system. The Trouble Ticket system is available 7 x 24 and is monitored by RG Nets support personnel. Trouble Tickets are submitted by authorized Operator personnel and will contain periodic updates on the Trouble Ticket resolution status. Trouble Tickets are responded to in order of severity. Products experiencing downtime or significant service interruption are responded to within 4 hours, where all others are responded to within 1 business day of the receipt of the Trouble Ticket.
