Other Access. In the event that an employee does not have a scheduled orientation within the first ninety (90) days of newly joining a PSE-represented bargaining unit, the University will permit the Union chapter president or designee to meet with the employee for thirty (30) minutes to discuss the Agreement and Union representation under the Agreement. The meeting will occur during the new employees work time, and the Union chapter president or designee will be granted release time for his/her participation in the meeting. The Union will schedule such meetings in advance through the University’s Labor Relations staff. University representatives shall not be present during the Union’s presentation.

Other Access. (1) Subject to any security regulations promulgated by the Company or the United States government (customer/client), the Union's Business Representative or other authorized business representatives of the Union as the Company's Project Manager may approve in advance, will be granted access to such areas of the Company's premises and for such purposes and at such times as the Project Manager may approve.
Other Access. In the event of an emergency that gives rise to imminent danger to persons or property at the data centers housing Customer Data, Data Trustee may grant access to emergency responders (e.g., police, ambulance personnel, fire fighters) solely as and for the time period reasonably necessary to respond to the emergency situation. Data Trustee will supervise the access by such responders to ensure it does not include access to Customer Data. Microsoft may deploy anti-spam and anti-malware updates to the German Online Services without supervision of the Data Trustee, provided such updates do not provide Microsoft with access to Customer Data. Disclosure of Customer Data Data Trustee will not disclose Customer Data to third parties except (1) as Customer directs, (2) as described in this Data Trustee Agreement, or (3) as required by German law. Data Trustee will not disclose Customer Data to law enforcement unless required by German law. If compelled to disclose Customer Data to law enforcement, then Data Trustee will promptly notify Customer and provide a copy of the demand unless legally prohibited from doing so. Upon receipt of any other third party request for Customer Data (such as requests from Customer’s end users), Data Trustee will promptly notify Customer unless prohibited by German law. If Data Trustee is not required by law to disclose the Customer Data, Data Trustee will reject the request. If the request is valid and Data Trustee could be compelled to disclose the requested information, Data Trustee will ask the third party to request the Customer Data from Customer. If a data subject requests access to its data, Data Trustee will forward such request to the Customer. Subject to the above, Data Trustee will not provide any third party: (1) direct, indirect, blanket or unfettered access to Customer Data; (2) the platform encryption keys used to secure Customer Data or the ability to break such encryption; or (3) any kind of access to Customer Data if Data Trustee is aware that such data is used for purposes other than those stated in the request. In support of the above, Data Trustee may provide Customer’s basic contact information to the third party. Location of Data Processing All processing of Customer Data performed by Data Trustee shall take place within Germany. Other Access. You will be considered a Non-Paying Organization in the event You have capability to access or use the Oracle Aconex Cloud Services without participating in any active System Projects or are not receiving an online archive service under Section 2.2 above (“Non-Active NPO”). Your aforementioned access capabilities or usage will be governed by the latest version of the Project Agreement (incorporating the latest version of these Terms of Use, which may be updated at Oracle’s discretion). For the avoidance of doubt, as soon as You cease to be a Non-Active NPO, the Project Agreement under this Section will be terminated. Without prejudice to any of Oracle other rights under the Project Agreement or otherwise, Oracle reserves the right to terminate the Non-Active NPO’s Project Agreement and/or such party’s access to the Oracle Aconex Cloud Services at any time and without notice.

All activities of Buyer under this 4.3 will be conducted in accordance with all applicable Laws and Buyer's activities under this Section 4.3 shall be at Buyer's sole risk, cost and expense, and Buyer shall release Seller from and shall fully protect, indemnify and defend Seller, its respective officers, agents, employees and Affiliates and hold them harmless from and against any and all Claims relating to, arising out of, or connected, directly or indirectly, with Buyer's exercise of its access rights under this Section 4.3, including without limitation, Claims relating to (a) injury or death of any person or persons whomsoever, (b) damage to or loss of any property or resource, (c) common law causes of action such as negligence, gross negligence, strict liability, nuisance or trespass, or (d) fault imposed by statute, rule, regulation or otherwise.
