When an employee dies after a period of continuous employment of not more than six (6) months, hisher estate shall, in lieu of earned vacation leave, be paid an amount equal to four per cent (4%) of the total of the pay and compensation for overtime received by the employee during hisher period of employment. Subject to clause when an employee dies or otherwise ceases to be employed, after a period of continuous employment of more than six (6) months, the employee or hisher estate shall, in lieu of earned but unused vacation, be paid an amount equal to the product obtained by multiplying the number of days of earned but unused vacation by the daily rate of pay applicable to the employee prior to the termination of hisher employment. An employee whose employment is terminated by reason of a declaration that abandoned hisher position is not entitled to receive the payment referred to in clause unless requests it within six (6) months the date upon which hisher employment is terminated.
