PAYROLL DEDUCTIONS AND DUES. A. During the term of this MOU, Association dues and such other deductions as may be properly requested and lawfully permitted will be deducted by the City Controller biweekly in twenty-four increments annually from the salary of each Unit employee who files with the City Controller a written authorization that such deductions be made. B. Remittance of the aggregate amount of all dues and other proper deductions made from the salaries of employees covered hereunder shall be made to the Association by the City Controller within thirty working days after the conclusion of the month in which said dues and/or deductions were deducted. C. A fee of nine cents ($.09) per deduction shall be assessed by the City Controller for the processing of each payroll deduction taken. The City Controller will deduct the aggregate amount of said fees on a biweekly basis.

PAYROLL DEDUCTIONS AND DUES. The City shall provide funds to subsidize the cost of dental plan premiums for the spouse, minor dependents and dependent children of any employee who dies while on active duty from injuries incurred while performing his or her job duties or who dies as a direct cause of such injuries. The maximum amount of the subsidy shall not exceed the amount provided to active members covered by this MOU. These provisions are not applicable to members who are not on duty or who have not completed Drill Tower training at the time of the injury which results in their death. For minor dependents the subsidy shall cease upon their attaining the age of 18 years; or until age 25 if unmarried and attending an accredited school on a full-time basis; or dependent children when they cease to be dependent as defined in Charter Section 1406. Only a spouse and/or dependents covered under a member's plan at the time of death shall be eligible for the subsidy. Upon application by a spouse or dependent for this benefit, a Committee comprised of representatives of the Personnel Department, XXXXX, and the Fire Department shall jointly determine whether the circumstances of the member's death qualify the member's spouse and/or dependents for the benefit provided under this Section. The decision of this Committee shall be final and binding, and not subject to further appeal.

For each pay period, the City Controller shall provide the Union with an electronic report itemizing each deduction for each employee. Such fee shall not be applicable to health benefits provided by UFLAC or the Los Angeles Firemen's Relief Association or to dental, life insurance and long-term disability insurance benefits provided by UFLAC. Except for errors caused by the City, the Union agrees to indemnify and hold harmless the City for any loss or damages arising from the operation of this Article.
