Penalty Charges. The lessee shall pay a fee for any late payment or returned check issued by the lessee as follows:
Penalty Charges. Party B agrees to pay to Party A the penalty charges as set out in Schedule 3 (Penalty Charges) which forms an integral part of these general terms and conditions. Party A reserves the right to make changes to Schedule 3 from time to time without providing any prior notification. The amended Schedule 3 is effective from the date they are notified to Party B. Party B’s continued use of Party A’s services and/or placement of the Products on HKTVmall shall represent Party B’s unconditional acceptance of the latest version of Schedule 3. For the avoidance of doubt, the penalty charges in this clause do not affect the application of clauses 9 (termination) and 12 (indemnification). Party B shall not offer to sell any restricted or prohibited goods / services, including but not limited to the followings:
1. any infringing goods / services of whatsoever nature arising from or in relation to any infringement or alleged infringement of any intellectual property rights;
2. any used articles and stolen goods;
3. dutiable commodities;
4. obscene and indecent articles;
5. explosives, firearms and ammunition, and prohibited weapons;
6. strategic commodities;
7. animals and plants;
8. controlled and hazardous chemicals, and infectious goods;
9. dangerous drugs, pharmaceutical products and medicine, and proprietary Chinese medicines and Chinese herbal medicines; and
10. any goods / services prohibited by law or regulated by licence or permit. Party B (“Merchant”) agrees to pay to Party A (“HKTVmall”) the penalty charges as set out in this Schedule 3 (Penalty Charges) which forms an integral part of the Merchant Agreement General Terms and Conditions. Xxxxxxxx agrees that any penalty charges and price of any refunds shall be deducted by HKTVmall in the transaction report of the following month. The contractor is required to ensure 98% operational efficiency.Every month, a sample size of 500 street light points will be randomly selected by inspecting authority and % operational efficiency of sample size will be taken as overall operational efficiency for entire project area. Operational efficiency in %=((500-No. of points found non- operational)*100)/500 Penalty clause for poor operational efficiency: • Operational effi. Greater than or equal to 98%,no penalty • Operational effi. less than 98%,deduction of 2% amount(of monthly bill amount for 100% operational efficiency) for every percent less than 98% Failure to provide the desired up time, the following penalties shall be levied.
Penalty Charges. The Supplier / Service Provider shall ensure that the uptime for the MPD supplied is at least 99 %. Penalty charges will be recovered from the supplier /service provider at the rate of Rs 300 per nozzle per day, if the down time exceeds 1%. This will be calculated on quarterly basis for all the nozzles put together in a RO for the quarter and will be deducted from the Bill. Calculation will be as under; Downtime (%) = (Total downtime of all the nozzles put together, for the RO in days for the quarter) x100 Total no of nozzles at the RO x 90 days Downtime means the time elapsed between logging a call /placing of service request and satisfactory resolution /rectification of nozzles from which sales are closed. Please refer a case study “B” represented below for 20 nozzles at one RO” for calculating and recovering the penalty charges for the down time of Nozzles from the Supplier/Service Provider. The concept of calculation and recovery of the penalty charges as shown in the case study would be applicable during Service Level Contract for Maintenance of MPDs. A Case study is represented below for 20 nozzles at one RO. Permitted total down time ( i.e. 1 % ) for the quarter, put together for all the nozzles will be ( 20 x 90) /100 = 18 nozzle days Example 1: Say- total down time for the quarter is 21 nozzle days. Therefore, down time is more than 1 % and hence penalty of (21 – 18) x 300 = Rs 900/- will be recovered from the supplier/service provider for this particular RO. Example 2: Say – total down time for the quarter is 17. Since it is less than permitted down time nozzle days of 18 days, no penalty will be levied for this particular RO.

Penalty Charges. If I fail to make timely payment of any or all of my scheduled tuition and fees payments on or before the close of business on the date due, AU will add and I will pay a late payment fee, and/or a late registration, which will be added to my outstanding balance. Additionally, any amount collected by Licensee from customer for any such booking. In the event wherein, negligence is observed in up-keeping & maintenance for the below listed infrastructure (on standalone basis); INR 7,500/- per incident. INR 20,000 per incident - Drinking water system - Lawn, plantation, green spaces - Electrical fittings - Plumbing system - Drainage system - Pathways, lobbies, roads within the premises In such of event where more than one of the infrastructure systems are not maintain in good and working condition Note: If more than 03 incidents recorded/observed during in a year during the operational phase of the License period, amount equivalent to 5% of the respective year’s Confession Fee shall be payable by Licensee or shall be deducted as penalty from Security Deposit. In the event of any complaint received against Licensee for Nuisance activity like Loud Music, illegal activities etc. INR 10,000 per incident Use of fire-crackers within the Convention Hall/Station Building Premises. Rs. 25,000/- per incident In the event Licensee fails to handover the rightful possession of project to Maha-Metro within 45 days of the expiry of the License period. Amount equivalent to 50% of the Security Deposit shall be retained from such deposit as Penalty charges
Penalty Charges. A. Performance parameters of the O&M contractor on the following parameters shall be calculated by the system. Presently the DHBVN has filed an application before the HERC for imposing of the reliability surcharge @ 0.50 paise per unit to the consumer pertaining to the project area for providing 24X7 quality power supply to the consumers. However the decision on the reliability surcharge is still to be decided. As such any penalty on the following parameters as well as in case of reliable power supply imposed by the HERC shall be passed on to the contractor. Apart from this any modifications in the standards of performance on mutual agreed basis as well as penalty imposed by the regulator shall be under the scope of the contractor.
