Penalty Pay. (All Coalitions Except ODOT)
Penalty Pay. “Penalty pay” shall be at the straight-time rate of pay and shall be paid in addition to whatever rate of pay (straight-time or overtime) is being paid when penalty work is performed. The penalty rate of pay shall be paid as specified in the penalty provisions of this Agreement.
Penalty Pay. Except in the Security Department, vacancies that are to be filled in two (2) or three (3) shift operations shall be filled on the basis of seniority of qualified employees within a work unit and within a job classification. Employees must express their preference for implementation of this Section. Except as limited by this Article, management shall not be precluded from exercising its rights under Article 9 - Employer Rights of this Agreement.
Penalty Pay. Section 1( A). Call Back Compensation. “Call-back” is an occasion where an employee has been released from duty and is called back to work prior to his/her normal starting time. On such occasions, the employee’s scheduled or recognized shift shall be made available for work, except that the university shall not be obligated to work the employee more than twelve (12) consecutive hours and the employee may choose not to work more than twelve (12) consecutive hours, excluding meal periods, of combined call-back time and regular shift time.
Penalty Pay. If the employee does not receive the paycheck on payday or within twenty-four (24) hours of the close of business on payday, the employee shall be entitled to penalty pay of forty dollars ($40.00) for every day thereafter that the check is late, provided the employee files notice with the Employer on forms provided by the Employer within the next regular business day. Failure to provide notice to the Employer within the specified time period shall forfeit claim for penalty pay until such notice is given. In no case may penalty pay exceed four hundred dollars ($400.00) for any single incidence of late pay. Verified pay shortages shall be paid no later than fifteen (15) days after verification of a written complaint. However, verified pay shortages of one hundred dollars ($100) or less shall be paid on the next regular semimonthly warrant. If not paid as provided in this paragraph, the penalties set forth above shall apply.

An employee will be paid one (1) hour ofpay at their regular rate ofpay for each shift their meal or rest period(s) were taken late, missed, or interrupted due to work reasons, or not duty-free. 2831.000/1710444.1 12. "Penalty Pay" hours as described in this Article do not qualify as hours worked in the calculated overtime. The language in this Article is meant to conform to California law regarding meal and rest periods and nothing stated herein will be interpreted to reduce rights an employee has to meal and rest periods under state law.

In no case may penalty pay exceed four hundred dollars ($400.00) for any single incidence of late pay.
