Piecework. A. It is further agreed that the employees will not contract, subcontract, work piecework, or work less than the scale of wages established by the Agreement. The EMPLOYERS agree not to offer and\or pay, and the employees will not accept, a bonus on specific performance on any individual job.
B. The EMPLOYER agrees not to use, rent or lease any welding machine or other such equipment from an employee or member of an employee’s family.
Piecework. A. The parties recognize that the piecework method of payment of wages frequently makes it impossible to calculate the hours worked by the employee; that the effect is to render it difficult, if not impossible, to enforce this contract so as to insure that employees working there under are receiving the proper negotiated rate and/or that the contractually required contributions are being made as to all hours required to be paid for. Such methods frequently result in the payment of wages to employees below the negotiated levels and the withholding from the Trust Funds and their participants of substantial amounts of contributions, all to the jeopardy of the fiscal integrity of the Trust Funds and the employee benefit programs they support.
B. When it is impossible to determine the number of hours worked because of the piecework method of payment, it is agreed that such employee shall be deemed to have worked a minimum of eight (8) hours per day and/or forty (40) hours per week straight time hours during such week.
C. Any evidence that the employee's earnings by the piecework method exceed those payable in accordance with the negotiated hourly rate is deemed irrelevant and inadmissible in any proceeding before a competent tribunal whether Board of Arbitration or Court.
D. Where an employee is paid an amount equivalent to or greater than the appropriate weekly wage of the area work week, a full work week of contributions shall be paid the Trust Funds, plus any actual hours of overtime worked.
E. Where employees are paid an amount less than the equivalent of the appropriate wage rate times the straight time hours of the area work week, the gross compensation paid such employees shall be divided by the appropriate hourly wage rate, and the quotient from that calculation shall be multiplied by the fringe benefit amounts required by the Agreement, and shall be deemed the amounts owed to the Trust Funds. If it is determined that employees actually worked more hours than reported, additional wages may be due as well as fringe benefits.
Piecework. 12.1 Piecework is defined as work done and paid for by the piece i.e. a limited portion or quantity. The nature of the work performed will be defined according to the particular agreement as set out at subclause 12.2 of this Clause.
12.2 An employee covered by this Agency Specific Agreement, subject to prior written agreement, is permitted to undertake piecework subject to the following provisions:
a) Hours worked on piecework on a rostered day of duty, will be counted as a part of the ordinary hours to be worked, as prescribed in Clause 13 – Hours of the Government Officers Salaries, Allowances and Conditions General Agreement 2006 and Clause 9 – Hours of Duty, of this Agreement;

c) Payment for piecework will not be made at an hourly or daily rate but paid in lieu of the normal rate of payment.
d) Where piece work is performed on a rostered or accrued day off duty, the employee will be paid on the basis of completed units or part thereof, in addition to receiving their normal ordinary hours rate of pay for that day.
e) Where piece work is performed on a normal rostered day of work the employee will be paid no less than they would normally have been paid for that day.
Piecework. General rules
Piecework. There shall be no limitation on the amount of work an employee shall perform during the day, or of the use of machinery or tools, and the Employer shall not, directly or indirectly, establish a quota for the employee to fulfill in the performance of work.
Piecework. Employees shall not contract, subcontract, work piecework, or work for less than the scale of wages established by this Agreement. The employer shall not offer and/or pay, and employees shall not accept, a bonus based on specific performance on any individual job. The Union prohibits piecework of any description.
Piecework. In the case of piecework, refer to the provisions in Supplementary Agreement III to the Main Agreement.
Piecework. If an agreement is made for piecework for an assignment, the piecework pay must include salary and all allowances in relation to the collective agreement.
Piecework. It is agreed that (insert) cents per tonne shall be paid and an additional (insert) cents per tonne on the weekend (if applicable). Note: For Piecework arrangements a copy of this Agreement must be given to the employee and to an Employee’s agent when advised by the employee.
Piecework. The Company and the employees may come to an agreement on piecework rates which enable the average competent employee engaged in piecework to earn no less than 15% above the minimum hourly rates set out in Table 1, Rates of Pay. Such piecework rates shall be paid in lieu of the ordinary hourly rates of pay set out in Table 1.
