Publication and Availability of Information. 1. Each Party shall ensure that its laws, regulations, procedures, and administrative rulings of general application governing customs matters are promptly published on the Internet. 2. To the extent possible, each Party shall publish in advance any regulations of general application governing customs matters that it proposes to adopt and provide interested persons within its territory with the opportunity to comment before adopting them. 3. Each Party shall establish, and maintain one or more inquiry points to address inquiries from interested persons pertaining to customs matters, and shall make available on the Internet information on such inquiry points. 4. For greater certainty, nothing in this Article or in any part of this Agreement shall require any Party to publish law enforcement procedures and internal operational guidelines including those related to conducting risk analysis and targeting methodologies.

Each Party shall designate, establish, and maintain one or more enquiry points to address enquiries from interested persons pertaining to customs matters and shall endeavour to make available publicly through electronic means information concerning procedures for making such enquiries. 3. Nothing in this Article or in any part of this Agreement shall require any Party to publish law enforcement procedures and internal operational guidelines, including those related to conducting risk analyses and targeting methodologies. 4. Each Party shall, to the extent practicable, and in a manner consistent with its domestic laws and legal system, ensure that new or amended laws and regulations of general application related to the movement, release, and clearance of goods, including goods in transit, are published, or information on them is made otherwise publicly available as early as possible before their entry into force, so that interested parties have the opportunity to become acquainted with the new or amended laws and regulations.

Each Party shall promptly publish the following information in a non- discriminatory and easily accessible manner, in order to enable interested persons to become acquainted with them: (a) importation, exportation and transit procedures (including port, airport and other entry-point procedures) and required forms and documents; (b) applied rates of duties and taxes of any kind imposed on or in connection with importation or exportation; (c) rules for the classification or the valuation of products for customs purposes; (d) laws, regulations and administrative rulings of general application relating to rules of origin; (e) import, export or transit restrictions or prohibitions; (f) fees and charges imposed by or for governmental agencies on or in connection with importation, exportation or transit; (g) penalty provisions against breaches of import, export or transit formalities; (h) appeal or review procedures; (i) agreements or parts thereof with any country or countries relating to importation, exportation or transit; and (j) procedures relating to the administration of tariff quotas. 2. Each Party shall make available, and update to the extent possible and as appropriate, the information stipulated in paragraph 1 through the internet. 3. The Parties shall endeavour to make the information in paragraph 1 available through the internet in the English language. 4. Each Party shall, in a manner consistent with its laws and regulations, provide opportunities and an appropriate time period for interested persons to comment on the proposed introduction or amendment of laws and regulations of general application related to the movement, release and clearance of goods, including goods in transit. 5. Each Party shall designate inquiry points to address inquiries by interested persons concerning customs and trade facilitation matters. Such inquiries, if made in the English language, shall be replied in the English language.

Each Party shall, to the extent practicable, and in a manner consistent with its domestic law, TFA commitments and legal system, ensure that new or amended laws and regulations of general application related to the movement, release, and clearance of goods, including goods in transit, are published or information on them made otherwise publicly available, as early as possible before their entry into force, so that interested parties have the opportunity to become acquainted with the new or amended laws and regulations. Such information and publications shall be available in the English language, to the extent possible. 5. Changes to duty rates or tariff rates, measures that have a relieving effect, measures the effectiveness of which would be undermined as a result of compliance with paragraph 4, measures applied in urgent circumstances, or minor changes to domestic law and legal system are each excluded from the obligations in paragraphs 1 and 4.

Each Party shall endeavour to make public new laws, regulations and customs procedures, relating to the requirements for the import, export and transit of goods prior to their application, as well as changes to and interpretations thereof. 3. Each Party shall, to the extent possible, ensure there is a reasonable time period between the publication of amended or new laws, regulations and customs procedures, fees or charges and their entry into force. 4. Each Party shall make available, and update as appropriate, the following through the internet: (a) a description of its importation, exportation and transit procedures, including appeal procedures, informing of the practical steps needed for the import and export, and for transit; (b) the forms and documents required for importation into, exportation from, or transit through the territory of the Party; and (c) contact information of enquiry points. 5. Each Party shall, subject to its available resources, establish or maintain enquiry points to answer within a reasonable time enquiries of governments, traders and other interested parties on matters covered by paragraph 1. Each Member shall promptly publish, through printed or to the extent possible through electronic means, all measures of general application relating to the supply of a service, in a non- discriminatory and easily accessible manner so as to enable governments, service suppliers and other interested parties to become acquainted with them.
