Relationship with other Industrial instruments. 1.7.1 Where there is an inconsistency between this Order and a state award, this Order shall prevail over the award to the extent of any inconsistency;
1.7.2 Where there is an inconsistency between this Order and a federal award, a federal or state certified agreement, or an Australian workplace agreement (AWA) the award, certified agreement or Australian workplace agreement shall prevail over this Order to the extent of any inconsistency;
1.7.3 A Queensland workplace agreement (QWA), during its period of operation, operates to the exclusion of this Order.
Relationship with other Industrial instruments. This Agreement shall be read and interpreted as a stand-alone document.
Relationship with other Industrial instruments. 3.1 This Agreement is intended to cover all matters pertaining to the employment relationship and represents a complete statement of the mutual rights and obligations between GenesisCare and the Employees to the exclusion of any other award or agreement including, without limitation, the Health Professionals and Support Services Award 2020 (Award).
3.2 Where there is any inconsistency between the terms of this Agreement and the NES in the FW Act, the NES will apply to the extent that it provides a more favourable outcome for an Employee.
Relationship with other Industrial instruments. (a) This AWA shall be read in conjunction with the Casual Employee’s “Employment of Casual General Staff” Form (SAL11) which will specifically refer to those periods during which work is available under this AWA and the type of work offered to the Casual Employee.
(b) Other than the offer of employment referred to in clause 5(a) above, this AWA determines the Casual Employee’s terms and conditions of employment, and supersedes and overrides all other employment contracts or employment agreements that the Casual Employee may have with the University prior to the execution of this AWA.
(c) This AWA will prevail over the terms of any agreement which would otherwise apply to the Casual Employee, including any agreement which comes into operation after the commencement of this AWA.
(d) This AWA will operate to the exclusion of any State or Federal Award including all protected award conditions as that term is defined by section 354 of the Act.
(e) In the event of any inconsistency between the provisions of this AWA and any applicable legislation, this AWA will prevail.
Relationship with other Industrial instruments. 8.1 The Agreement completely regulates the employment conditions of the employees subject to the Agreement and operates to the exclusion of any award or any industrial instrument that would otherwiseapply.
8.2 For the avoidance of doubt, this Agreement shall supersede and replace all previous agreements applying totheemployees coveredbythis Agreement.
Relationship with other Industrial instruments. This agreement will be read and interpreted in conjunction with the National Employment Standards (NES). Where there is an inconsistency between this Agreement and the NES, and the NES provides a greater benefit, the NES provision will apply to the extent of the inconsistency. This Agreement operates to the exclusion of, and overrides, any Industrial Instrument that would otherwise apply to the Company and the Employees. The Company acknowledges that there is a dispute as to whether the Employees (or some of them) are eligible to be members of the Coal LSL portable long service scheme. If the dispute is resolved (including on appeal) on a basis that establishes that the Employees are eligible to be members of the scheme, consideration will be given as to whether the Mining Industry Award 2010 or the Black Coal Award 2020 shall apply in future.
Relationship with other Industrial instruments. This agreement stands alone and replaces any other Award, Notional Agreement Preserving State Award (NAPSA) or Agreement. Therefore, any clause or term in any other industrial instrument referring or relating to protected award conditions, as defined in the Workplace Relations Act 1996 (the Act), are hereby expressly excluded from applying at all times throughout the life of this Agreement. By agreement with the majority of employees, these conditions have been adequately addressed or compensated for elsewhere in this Agreement.
Relationship with other Industrial instruments. This agreement shall operate to the exclusion of any and all other Notional Agreement Preserving State Awards [“NAPSAs”]. The provisions of the following NAPSAs are superseded by this Agreement: - • Health Services Employees Award (South Australia) • Private Hospitals, Convalescent and Benevolent Homes (Northern Territory) Award 2003
Relationship with other Industrial instruments.
(a) This Agreement replaces all previous agreements.
(b) The Agreement applies to the exclusion of all modern awards which would otherwise apply to employees covered by this Agreement.
Relationship with other Industrial instruments. This is a comprehensive Agreement that stands alone and applies to the exclusion of any other industrial instrument that covers, or would otherwise apply to, employees.
