Requirement to work on a public holiday. 4.7.2.1 For the purpose of this clause ordinary working day means a day on which the employee is normally rostered to work.

In determining whether the Employee has reasonable grounds for refusing a request to work on a public holiday, the Employer will have regard to all the circumstances, including but not limited to the following: ⚫ the nature of the work performed by the Employee; and ⚫ the type of employment (for example, whether full-time, part-time, casual or shift work); and ⚫ the nature of the Employer’s workplace or enterprise (including its operational requirements); and ⚫ the Employee’s reasons for refusing the request; and ⚫ the Employee’s personal circumstances (including family responsibilities); and ⚫ whether the Employee is entitled to additional remuneration or other benefits as a consequence of working on the public holiday; and ⚫ the fact that this workplace agreement and employee's contracts of employment contemplates that the Employer might require work on public holidays, or particular public holidays; and ⚫ whether the Employee has acknowledged or could reasonably expect that the Employer might require work on public holidays, or particular public holidays; and ⚫ the amount of notice in advance of the public holiday given by the Employer when making the request; and ⚫ the amount of notice in advance of the public holiday given by the Employee in refusing the request; and ⚫ whether an emergency or other unforeseen circumstances are involved; and ⚫ any other relevant factors.

  • Annual Leave Exclusive of Public Holidays The period of annual leave prescribed by this clause is exclusive of any public holidays, and if any such holiday falls within an employee’s period of annual leave and is observed on a day which in the case of that employee would have been an ordinary working day, there will be added to the period of annual leave time equivalent to the ordinary time which the employee would have worked if such day had not been a holiday.

  • Public Holiday Work (a) For Employees other than Shiftworkers, double time and a half must be paid for any Public Holiday Work with a minimum payment of four hours.
