Review of Individual Positions. An employee may obtain a review of the classification of his/her position in the following manner: The Union shall submit a request for review to the Director of the Division of Personnel and Labor Relations or designee. The request for review shall include a copy of the full position description from the On-Line Position Description system and the union will provide an analysis supporting their request. The employee shall complete a full position description describing the duties, level of authorities and responsibilities performed. The Division of Personnel and Labor Relations shall review the employee’s duty description with the employee’s supervisor as part of a position analysis. A final position description shall be completed to reflect the actual duties assigned and performed. The completed PD shall be reviewed in conjunction with existing class specifications for proper classification. Not later than sixty (60) calendar days following receipt of the request, the Director of Personnel and Labor Relations or designee shall render a decision and notify both the supervisor and the Union. A. Reallocations shall be made effective in accord with 2 AAC 07.035. If the Director or designee determines that the position should be upgraded but funds are not available the employing department shall restrict the duties to be consistent with the classification at the funded level. B. No more than one (1) request may be processed for a position under this section in any twelve (12) month period unless substantial changes in duties have occurred. C. The foregoing procedure shall be the sole and exclusive method of resolving classification disputes, notwithstanding the other provisions of Article 12.

F. No more than one (1) request may be processed for a position under this Article in any twelve (12) month period unless substantial changes in duties have occurred. G. If an individual is reclassified through the application of this Article, the employee may be granted early permanent status, subject to the provisions of Articles 11.02.A.1 and 11.02.A.2.

Review of Individual Positions. ‌ The procedures in this Section shall be the sole and exclusive method for settling any dispute concerning classification matters. A Bargaining Unit Member may obtain a review of the classification of his/her position in the following manner: A. The Association shall submit a request for review, including that portion of a position description (PD) completed by the Bargaining Unit Member, to the Director of the Division of Personnel and Labor Relations. The parties are encouraged to resolve the dispute at the lowest level possible and/or submit an updated PD for review through the normal procedures, and the Association will make reasonable efforts to do so before involving the Division of Personnel & Labor Relations. B. The completed PD will be reviewed in conjunction with existing class specifications for proper classification. Not later than sixty (60) calendar days following receipt of the request the Director of the Division of Personnel & Labor Relations shall submit a written analysis to the Association. C. If the Director of Personnel & Labor Relations fails to respond within sixty (60) calendar days, or within sixty (60) calendar days of receipt of the Director’s recommendation, the Association may advance the request to the Commissioner of the Department of Administration within ten (10) working days of the due date. D. Upon receiving the Association’s written request, the Commissioner of the Department of Administration shall review the PD in conjunction with the existing class specifications for proper allocation and the Commissioner of the Department of Administration shall render a decision and notify both the Director and the Association within sixty (60) calendar days. E. If a position is reclassified to a higher range, the effective date of the reclassification shall be the date the Association’s request for review was received by the Director of the Division of Personnel & Labor Relations. F. A single position may only be reviewed once under this Section during the life of this Agreement, and only if that position has not already been reviewed by Classification within the twelve months preceding the request.

If an individual is reclassified through the application of this Article, the employee may be granted early permanent status, subject to the provisions of the Collective Bargaining Agreement. If the Director of the Division of Personnel & Labor Relations determines that the position should be upgraded reclassified to a higher range but funds are not available the employing department will immediately restrict the duties to be consistent with the classification at the funded level. In the event that a position is determined to be reclassified to a higher range, the effective date of the reclassification will be sixty (60) days prior to the filing of an appeal under this section or the date a PDQ was submitted by the Employee requesting the reclassification whichever is shorter.

  • Health Examinations The Employer shall provide at no cost to the employee, such medical tests, health examinations and surveillance/monitoring as may be required as a condition of employment and/or as a result of regulated hazards encountered after employment.

  • Technical Objections to Grievances It is the intent of both Parties of this Agreement that no grievance shall be defeated merely because of a technical error, other than time limitations in processing the grievance through the grievance procedure. To this end, an arbitration board shall have the power to allow all necessary amendments to the grievance and the power to waive formal procedural irregularities in the processing of a grievance, in order to determine the real matter in dispute and to render a decision according to equitable principles and the justice of the case.
