Rights and Obligations of the University a. University personnel will enter your room at any time in the event of an emergency and at any time for any reasonable purpose, including, without limitation: inspection, preventive maintenance, routine maintenance requests, or investigation of violations of University Regulations. By signing the Contract, you specifically agree to be bound by the University Regulations as they now exist or may hereafter be amended and acknowledge the rights and obligations of the University.
b. Any duty of the University to remedy or repair conditions materially affecting the physical health or safety is as established by applicable law. You will give written notice to the University specifying such conditions upon your discovery of such conditions.
c. The University is not responsible for loss or damages to personal property by theft, fire or other casualty, whether such losses occur in your room, public areas, or elsewhere. Items left in your room or items temporarily stored by you in a University storage area when you check out will be disposed of by the University in accordance with University policies then in effect. It is recommended that the student should obtain renter’s insurance as the university will not reimburse or cover the loss of personal property
d. In the event the University is prevented from completing the performance of any obligations under this Contract by an act of God or other occurrence whatsoever which is beyond the control of the University, the University shall be excused from the performance of such obligations to the full extent of the law.

C. The University is not responsible for loss or damages to personal property by theft, fire or other casualty, whether such losses occur in your room, public areas, or elsewhere in the residence hall. Items left in your room or items temporarily stored by you in the University’s storage areas when you check out will be disposed of by the University in accordance with University policies then in effect.
D. To maintain security standards, the University will install, change or rekey a security device on any exterior door or window of your room. A charge for labor, materials, overhead and extra keys provided by the University shall be paid by you if the University deems you responsible for those costs.
E. The University may terminate or temporarily suspend performance of any part of this contract without notice in the event of an emergency or exigency that would make continued operation of student housing not feasible.
F. In the event that the University is prevented from completing the performance of any obligations under this Contract by an act of God, disaster, or other occurrence whatsoever which is beyond the control of the University, the University shall be excused from the performance of such obligations to the full extent allowed by law.
G. The University may refuse to offer or cancel a housing contract or room assignment to an individual whose demands for housing are unable to be met.

d. At your request, the University will install, change, or recode a security device on any exterior door or window of your room. You agree to pay a charge for all labor, materials and overhead associated with such installation, change, or recoding promptly upon delivery of a statement for same from University.
e. In the event the University is prevented from completing the performance of any obligations under this Contract by an act of God or other occurrence whatsoever which is beyond the control of the University, the University shall be excused from the performance of such obligations to the full extent of the law.
f. The University reserves the right to maintain the safety of the premises by any means, including but not limited to temporarily or permanently removing the Student from university housing.
Rights and Obligations of the University a. The Contract may not be amended or supplemented except in writing signed by the parties and must be accepted as written. The Contract and all documents incorporated in it contain the entire agreement of the parties. No oral understanding or agreement not incorporated into the Contract shall be binding on either of the parties.
b. By entering into this Contract, University does not waive its sovereign immunity under Texas law. The Contract shall be construed under and in accordance with the laws of the State of Texas. For students residing in Brownsville, Texas all obligations of the parties created by the Contract shall be performed in Cameron County, Texas. For students residing in Edinburg, Texas all obligations of the parties created by the Contract shall be performed in Xxxxxxx County, Texas. If any one or more of the provisions contained in the Contract shall for any reason be held invalid, illegal or unenforceable in any respect, such invalidity, illegality or unenforceability shall not affect any other provision thereof and the Contract shall be construed as if such invalid, illegal, or unenforceable provision had never been contained therein.
c. Capitalized words or phrases used in these terms and conditions have the respective meanings assigned to them in the Contract, unless the context clearly indicates otherwise.
d. University personnel may enter Student’s room at any time in the event of an emergency and at any reasonable time for any reasonable purpose, including, without limitation, inspection, maintenance or investigation of violations of University Regulations. Rights and Obligations of the University. (1) The University shall implement the curriculum as approved by AQ Austria. The University reserves the right to make changes to the curriculum (for instance, to comply with national regulations or EU regulations) or to the teaching staff as long as such changes do not undermine the learning outcomes.
(2) In the event that the University is unable to (or not anymore able to) implement the curriculum for any reason, the University must help the Student with the transfer of credit to other study programmes in accordance with the European Credit Transfer System (ECTS) for the credits awarded by the University until that moment.
(3) The Student grants unlimited usage rights to the University for every work or research result produced within the context of the study programme, at no cost. Theses or dissertations are forwarded to the University library to be included in the library’s public catalogue.

You must pay a charge for labor, materials, overhead and extra keys provided by The University if the work is caused by misuse, loss or damage by you, your family member, or a guest. Once installed, a secured device becomes a fixture of University Housing and Dining and may not be removed without written permission from the University.
D. The University is not responsible for loss or damages to your, your family member, or your guest’s personal property. Items left in your apartment after you vacate will be removed at your expense. You will be given thirty (30) days to claim the items. If no response is received within the thirty-day deadline, The University will dispose of these items in accordance with existing University policy.
E. In the event that The University is prevented from completing the performance of any obligations hereunder by an act of God or other occurrence whatsoever which is beyond the control of the parties hereto, then The University shall be excused from any further performance of obligations and undertakings under this contract, to the full extent allowed by applicable Texas laws. All costs associated with necessary repairs to the premises will be your responsibility if you do not take all due care to protect the interior and exterior from weather damages.

Student will be notified before inspections begin. Student must report incidental or accidental damage to the Assigned Housing Unit or any portion of Student Housing. Damage to an Assigned Housing Unit and/or any University property may result in repair charges to the Student, and disciplinary action up to and including termination of the Contract and/or expulsion from University.
B. University shall remedy or repair conditions present at Student Housing that are materially affecting the physical health or safety of Student. Student shall give written notice to the University specifying such conditions upon Student's discovery of such conditions.
C. University is not responsible and/or liable for loss or damages to personal property within Student Housing, including yet not limited to arising from theft, fire, flood or other casualty, whether such losses occur in Student's Assigned Housing Unit, University public areas or elsewhere in Student Housing. University insurance does not cover the loss or damage to Student personal property.
D. Student is not required by University to buy renters or liability insurance, but renters insurance is strongly recommended for losses due to theft, fire, water, pipe leaks, and similar occurrences.
E. University will re-key a security device on any exterior door or window of Student's unit after receiving a written request from Student. The University will automatically re-key a security device if Student loses an assigned key. All applicable costs and expenses arising for the re-key, replacement and/or extra keys shall be paid by Student promptly upon delivery of a statement for same from the University. If payment is not promptly made, a charge on Student’s GOLDMINE account may be imposed by University to cover such costs and expense.
F. In the event that University is prevented from completing the performance of any obligations under this Contract by Force Majeure, Acts of God, and/or circumstances beyond the control of the University, University shall be excused (released) from the performance of such obligations ...
