SAFETY AND MAINTENANCE. The Landlord will ensure that the Property and its contents comply with the current fire and safety regulations. The structure of the building will be maintained by the Landlord, or the Freeholder or Superior Leaseholder if the Property is a flat. The Landlord agrees to maintain the heating and hot water systems, and his possessions within the Property, in good working order during the Tenancy, repairing or replacing as necessary. Where damage has been caused through neglect or misuse by the Tenant, they will be charged for the landlords costs incurred in remedying the damage.

10.2 Great Lakes shall have sole responsibility for the maintenance of its leased and owned aircraft, and for other equipment used in connection with the Codeshared Flights. Maintenance of such aircraft and equipment must, at a minimum, comply with the standards imposed by the relevant aeronautical authorities.
10.3 Each Party represents and warrants that each has or will have successfully undergone an IATA Operational Safety Audit (“IOSA”) at its own expense satisfactory to the other Party, and further represents and warrants that each shall maintain compliance with the requirements of such audit within the time frame required by IATA.
10.4 Each Party represents and warrants that it meets the minimum safety requirements mandated by any Competent Authority and shall maintain compliance with such requirements. Any failure to maintain compliance shall immediately be brought to the other Party’s attention along with corrective actions taken or a corrective action plan.
10.5 United shall have the right, at its own cost, to review and observe Great Lakes’ operations of Great Lakes Flights, and/or to conduct a reasonable safety and/or service review of the Great Lakes’ operations, manuals, and procedures reasonably related to the Codeshared Flights (the “United Reviews”), at such intervals as United shall reasonably request. All costs associated with this audit shall be paid for by Marketing Carrier. NOTWITHSTANDING THE FOREGOING, THE MARKETING CARRIER DOES NOT UNDERTAKE ANY RESPONSIBILITY OR ASSUME ANY LIABILITY FOR ANY ASPECT OF THE OPERATING CARRIER'S OPERATIONS, NOR SHALL THE OPERATING CARRIER BE ENTITLED TO ASSERT ANY RESPONSIBILITY OR ASSUMPTION OF LIABILITY ON THE PART OF THE MARKETING CARRIER FOR THE OPERATING CARRIER'S OPERATIONS.
8.3 The Operating Carrier shall employ prudent safety and loss prevention policies on the Codeshared Flights. The Operating Carrier has final authority and responsibility concerning the operation and safety of the aircraft and its passengers. In emergencies, the parties shall adhere to the emergency procedures for Codeshare Passengers set forth in the Procedures Manual.
SAFETY AND MAINTENANCE. It is important you care for any terminal or other equipment we provide you and to keep them in good condition and unobstructed. Liquids and dust may damage terminal components and like other electronic devices may create a safety hazard or otherwise prevent optimal performance. It’s important you regularly clean and inspect our terminals for potential hazards. Do not allow the power cables to become frayed, snagged or entangled. If these are damaged or distressed, or if you are concerned for any other reason, then you should contact us immediately. Tell us immediately if our terminal is either not working or defective and we’ll repair or replace it as soon as we can. Please use the downtime procedures until it is fixed or replaced. Do not tamper with, remove terminal housing or attempt to repair any terminals or other equipment yourself. Please call us if you have equipment that requires replacement or repair. Licensor and Licensee covenant and agree that at their own expense and at all times they will ensure that they shall install, operate, ground and maintain their respective equipment in a good and workmanlike manner in accordance with sound engineering standards and the Approved Plans.

SAFETY AND MAINTENANCE. 3.3.1 OFO will achieve and maintain ISO 4210:2014 standards for bicycles in Sheffield. The bikes will have robust maintenance and servicing regimes in place so bicycles continue to meet applicable laws and standards. As a minimum, OFO bicycles will be given a full service annually, with formal checks and repairs taking place regularly throughout the year. This will be undertaken by a qualified bike mechanic.
3.3.2 The bikes will have the following to meet legal requirements: • hand-operated brakes arranged left-hand rear and right-hand front • front and back lights on the bike so it can operate safely in low light conditions – BS EN ISO 4210:1-9 The Pedal Bicycles (Safety) Regulations 2010 and Road Vehicle Lighting Regulations 1989 • a rear red reflector and amber/yellow reflectors on the front and rear of each pedal • an individually identifiable asset number
3.3.3 OFO will comply with all applicable laws and standards for bicycles in the UK.
3.3.4 OFO will provide evidence of regular bike maintenance.
3.3.5 OFO will have operational processes in place to enable customers and members of the public to easily report bicycles that are unsafe damaged or causing an obstruction. If unsafe or damaged it is the responsibility of OFO make sure these bicycles are no longer available for hire, and are recovered within the following service response times: Where a bicycle is considered to be causing a danger or obstruction, OFO will have operations teams’ active in the city from 7am – 8pm, seven days a week. However any bicycle causing a danger or obstruction shall be removed within 90 minutes, or within the Highway Authority’s emergency response time, whichever is the quickest regardless of OFO’s operation team working hours. Where a bicycle is reported to be causing a nuisance, a maximum response time of 24 hours will be required. Where a bicycle is causing an immediate danger, the relevant Highway Authority or emergency service may remove them without prior notice. Where bikes have been removed either by a Highway Authority or emergency services, OFO will be liable to pay all associated reasonable costs.
