SENIORITY AND LONGEVITY. A. Seniority 1. Seniority of employees will be based upon classification and length of continuous full-time service with the City Colleges of Chicago. 2. Conflicts in seniority between employees in a particular classification who have identical periods of service with the Colleges will be resolved in favor of those who have the greatest number of years of continuous full-time service with the Colleges. With respect to Project Employees, this Paragraph shall apply only as between Project Employees with similar titles in the same department. 3. Seniority shall he used to determine work schedule assignments, transfers, and selection of vacation periods as between employees of the same classification who are equally competent to perform the work. Longevity Longevity for vacation entitlement shall be determined on the basis of length of continuous full-time service with the City Colleges of Chicago An approved leave of absence, whether with or without pay, shall not be considered a break in service but all resignations or discharges not followed by reinstatement within one (1) year shall interrupt continuous service and shall result in the loss of all prior service credit toward longevity. Absences on leave without pay for more than sixty (60) days, all suspensions, time after layoff for more than sixty (60) days prior to reinstatement and absences without leave shall be deducted in computing total longevity. SENIORITY AND LONGEVITYSection 1. Seniority means an employee's length of continuous service in a classification (title and grade) in the bargaining unit. When length of continuous service is identical, the tie shall be broken with a coin toss. Seniority shall not be interrupted by reclassification, involuntary transfer, or an employee transferring to another classification in the bargaining unit because his or her position is scheduled for elimination. Section 2. Seniority shall be considered unbroken for: a. layoff not exceeding one year; b. leaves without pay not in excess of 15 days except when such leave is granted in cases of personal illness or for the pursuit of further education or training which permit an extension of leave time; c. military service as defined by State law and Department of Administrationrulings; and d. paid leaves provided for in this Agreement or worker's compensation leave of 60 days or less. Section 3. Whenever experience, qualifications, and abilities are similar, seniority at the Intensive Behavior Center shall be the determining factor in filling new or vacated positions within the bargaining unit. Section 4. Employees subject to layoff shall be given 21 calendar days advance notice except for temporary layoffs caused by emergencies. In selection of employees for layoff, seniority within a classification shall be the determining factor, provided said employee has the needed qualifications, and has necessary endorsements, licenses, or other occupational requirements at the time of layoff. When all the above factors are equal, the employee's work record may be utilized as the tiebreaker. Section 5. Recall from layoff shall be in accordance with the considerations outlined in Section 4 above. The Employer shall notify the employee to return to work and furnish the Federation a copy of such notification. If the employee fails to notify the Employer within 10 calendar days of their intention to return to work, such employee shall be considered as having forfeited their right to return to work. Section 6. No permanent employee shall be laid off while temporary, part-time, or probationary employees in the same skill are retained. Section 7. The Employer and the Federation agree that if the Employer determines to lay off any bargaining unit member(s) during this contract term, the parties shall meet at the request of either party to discuss issues germane to that layoff.

SENIORITY AND LONGEVITY. 3.3.1 The seniority of an employee within the bargaining unit shall be established as of the date on which the employee began regular employment in a bargaining unit position or in a position subsequently included in the bargaining unit. Employees who leave the bargaining unit will not maintain their seniority. Employees who are on leave to fill a temporary position in the District shall be subject to the provisions of Article IV, Section 4.1.1. 3.3.2 Employees designated surplus through the staffing process who choose to accept continuing employment as a substitute in lieu of a regular position shall continue to maintain their bargaining unit seniority for up to eighteen (18) months. 3.3.3 The seniority rights of an employee shall be lost for the following reasons: resignation, discharge for just cause, and retirement. Seniority rights shall not be lost but shall not accrue for the following reasons: authorized, unpaid leaves of absence and involuntary layoff. Seniority rights shall continue to accrue for the following reasons: absence due to industrial injury; paid, authorized absence covered by the leave provision of the agreement; and holidays and vacations. 3.3.4 By March 15, of each year, the District will print and distribute to all employees in the Association, a seniority list ranking each employee from greatest to least seniority within the bargaining unit.

SENIORITY AND LONGEVITY. 1. Seniority means the length of continuous service with the Department of Transportation or its predecessor agency since the employee's last date of hire. Second, to laid-off employees in the same classification in any geographic location. c. Third, to laid-off employees in a higher graded classification in the same class series in any geographic location. Recall rights in all cases shall be for a period of two years from the date of layoff. 5. In addition to recall, a laid-off employee will receive a preference for reemployment with the bargaining unit for a period of up to two years following the date of layoff. Any bargaining unit member in RIF status who applies for a position within the bargaining unit will have five percentage points added to their final score on a scored selection procedure provided, however, they meet minimum qualifications and receive passing scores on each step of the selection process. 6. In addition to recall, a laid-off employee shall receive a preference for reemployment with the Transportation Department Non-Maintenance bargaining unit for a period of up to two years following the date of layoff. A laid-off employee who is subsequently reemployed by the Transportation Department shall retain their seniority and employment benefits including, but not limited to longevity. 7. A laid-off employee who is rehired, pursuant to Section 4 above, in a position at a lower grade than the position held by the employee at the time of layoff, shall still be entitled to his recall rights as set forth in Article 13, Sectio...

The Employer will comply with the provision of the Uniformed Services Employment and Reemployment Rights Act (USERRA), 38 U.S.C. §§ 4301 et seq. and the Montana Military Service Employment Rights Act, §§ 10-1-1001 et seq., MCA with respect to any trooper who performs duty, voluntarily or otherwise, in the uniformed services as defined in those laws. 4. A trooper’s continuous service for purposes of longevity and seniority shall be broken by voluntary resignation, discharge or retirement. 5. Time spent in a job with the Division outside the bargaining unit shall be considered lost time for purposes of seniority, however, upon a trooper’s return to the bargaining unit, previous time spent in the bargaining unit shall count toward the trooper’s seniority. 9.3 Layoffs caused by reduction in force shall be in order of seniority within the bargaining unit; that is, the trooper last hired shall be the first released. Permanent and probationary trooper who are scheduled to be released shall be given at least 10 working days’ notice. All recalls to employment shall likewise be in order of seniority within the bargaining unit; that is, the last trooper released as a result of a reduction in force shall be the first rehired when the Employer needs additional troopers. SENIORITY AND LONGEVITY. ACCRUAL A Management Crewmember will be included on the Seniority List(s), designated by title. A Management Crewmember will accrue seniority and longevity, but will not accrue sick leave or vacation in accordance with this Agreement.
