A Dependent Contractor (which, for the purpose herein, shall include Owner Operator) is the owner and/or purchaser of equipment supplied for the services pursuant to this Article, Appendix and the attached Letter of Understanding. The committee shall consist of not less than three (3) employees and not more than seven (7) employees with completed probationary period of employment with the Company who are members of the Union and they shall be selected, wherever possible, on a departmental basis. The Union will, within sixty (60) days from the date of this Agreement, notify the Company in writing of the members on the committee. The Company will remit dues on behalf of casual employees in accordance with the following however no other terms and conditions of this agreement shall apply to a casual employee. A casual employee may be either a replacement casual or a supplemental casual. Casuals shall not have seniority status and shall not be discriminated against for future employment. Replacement casuals may be utilized by the Company only to replace regular employees for a period of ninety (90) calendar days when such regular employees are off due to illness, vacation or other absences, and then the Company must hire a regular full time employee. All regular full time employees will be provided the first opportunity, according to seniority; to replace illness related absences of greater than ten (1O) days. Supplement casuals may be used to supplement the regular work force as provided for herein: Supplement casuals may be used over and above the bid complement for a total of one hundred twenty (120) hours per calendar month: If the Company uses supplement casuals in excess of that which is provided in part a) above, the employer will add one (I)probationary employee for each one hundred twenty (I20) hour violation. A monthly list of all casual employees used during the month shall be submitted to the Local Union by the tenth day of the following month. Such list shall include: The name and address of each casual and the monthly dues; The Social Insurance Number of the Casual; The hours worked by the Casual; Whether the casual worked as a replacement or supplemental. Laid off full time employees shall have the first opportunity for casual work and the regular hourly rate shall apply.
