A Dependent Contractor (which, for the purpose herein, shall include Owner Operator) is the owner and/or purchaser of equipment supplied for the services pursuant to this Article, Appendix and the attached Letter of Understanding. The title to the equipment may be in the name of the Company or for registration and licensing purposes only and the Company has no financial interest other than as required by the Motor Carrier Act.

Section Definition. Seniority shall be the length of regularly scheduled continuous work with the Employer in the department at the store in the bargaining unit. Date and time of hire shall determine relative seniority. Credit shall be given to all employees hired for such work prior to certification from the most recent date of hire. Employees shall have seniority in accordance with the above on either the full-time regular employee seniority list, or the part-time regular employee seniority list. In the event that a part-time employee becomes a full-time employee, his seniority as a full-time employee shall start from the date upon which he achieves full-time status, except for the purposes of determining relative seniority i n the case of a lay off, in which case the employees' company seniority shall apply. Similarly, full-time employees who have converted to part-time status may use their company seniority in the case of a layoff. Section Seniority Lists Seniority lists will be established for each of the departments in the store. The Employer agrees to provide the Union with current departmental seniority lists for employees once every four (4) months. There shall be two (2) seniority lists, one (1) for full-time regular employees, and one (1) for part-time regular employees.

The Company will remit dues on behalf of casual employees in accordance with the following however no other terms and conditions of this agreement shall apply to a casual employee. A casual employee may be either a casual or a supplemental casual. Casuals shall not have seniority status and shall not be discriminated against for future employment. Replacement casuals may be utilized by the Company only to replace regular employees for a period of ninety (90) calendar days when such regular employees are off due to illness, vacation or other absences, and then the Company must hire a regular full time employee. In the case of maternity or parental care leaves, the Company may employ a replacement casual in a full time capacity in order to provide adequate coverage for the leave. This replacement casual will not be held to the hour rule and the Company shall not be forced to hire the person should these hours be exceeded. All regular full time employees will be provided the first opportunity, according to seniority; to replace illness related absences of greater than ten (10) days. Supplement casuals may be used to supplement the regular work force as provided for herein:

Supplement casuals may be used to supplement the regular work force as provided for herein: Supplement casuals may be used over and above the bid complement for a total of one hundred twenty (120) hours per calendar month: If the Company uses supplement casuals in excess of that which is provided in part a) above, the employer will add one (I)probationary employee for each one hundred twenty (I20) hour violation. A monthly list of all casual employees used during the month shall be submitted to the Local Union by the tenth day of the following month. Such list shall include: The name and address of each casual and the monthly dues; The Social Insurance Number of the Casual; The hours worked by the Casual; Whether the casual worked as a replacement or supplemental. Laid off full time employees shall have the first opportunity for casual work and the regular hourly rate shall apply.
