Services Disclaimer. The Product evaluation by the Listing Agency is limited to the evaluation of the information regarding the Product provided by the Client in the Registration Form, and does not include actual evaluation of the Product itself. In providing the Services, the Listing Agency does not in any way take the place of designers, contractors, manufacturers, producers, importers or sellers of the Products, who, notwithstanding Listing Agency’s actions (direct, indirect, willful or inadvertent), are not released from any of their obligations. The Listing Agency does not fulfill the role of an insurer or a guarantor in respect of the adequacy, quality, merchantability, fitness for purpose, performance of the Products. The listing on the Catalogue covers only those products specifically covered under the scope of the Services agreed with the Client in the Registration Form. Clients remain solely liable for any defect in the Products and shall defend, protect and indemnify the Listing Agency from any and all defects, claims or liability arising from said Products. The Client’s release of any third party from its liabilities, obligations and duties with respect to the Products will not cause the liability to Listing Agency to increase and the Client shall assume and undertake as its own such liabilities, obligations and duties, including unfulfilled liabilities of a third party. Unless specifically agreed to the contrary between the Parties and incorporated into the scope of the Services under the Agreement, any documents provided by the Client, including but not limited to BIS certification or ISO certification, images of the Product provided to the Listing Agency, shall be considered to be for information only, without either extending or restricting Listing Agency’s scope of Services or obligations under the Agreement. Listing on the Catalogue is based only on the documents and other information provided to the Listing Agency and actually reviewed by the Listing Agency for the performance of the Services. The Listing Agency cannot be held liable for any error, omission, or inaccuracy in the Catalogue to the extent that Listing Agency has been given erroneous or incomplete information by the Client or its Representatives or otherwise. The listing of the Product on Catalogue does not exempt Clients from their legal obligations in respect of delivery of the products or any services to their clients. Services Disclaimer. Landlord shall not be liable for damages for failure, interruption or slow-down of: (i) heat, (ii) hot or cold water, (iii) air conditioning, (iii) sewer service, (iv) electric current, (v) gas, or (vi) any other service -- caused by reason of: (1) breakdown or interruption of plant, equipment, or apparatus, (2) shut-down of any services for necessary repairs or alterations, (3) unavailability of fuel, water or any other substance or utility, (4) war or civil disturbance, (5) strike or lockout, (6) fire, flood or casualty, (7) governmental regulations, or (8) any other conditions beyond Landlord's control. Notwithstanding the foregoing, if any failure to supply services or utilities to the Demised Premises due to Landlord's fault or for reasons within Landlord's control shall render the Demised Premises effectively unusable by Tenant for a period of seventy-two (72) hours, then Minimum Rent shall be abated during such time in excess of seventy-two (72) hours as Landlord is unable to supply services or utilities to the Demised Premises due to Landlord's fault of for reasons within Landlord's control. Any security measures that Landlord may elect to undertake in and about the Project are understood to be for the protection and preservation of the Building and Real Property only and shall not be relied upon by the Tenant far the protection in either its person or property or that of its guests, invitees or employees, and no liability shall be imposed on the Landlord, its agents or employees in connection therewith.

Service requests which fall outside the scope of this Agreement may be billed at prevailing hourly rates with prior Lessee authorization. Failure to authorize Repair or Services may result in suspension or termination of this Agreement.

Equipment damage due to abuse/misuse, alteration or modification, 3rd party interference, use of non-standard parts, improper installation, usage beyond recommended operating parameters, theft, neglect, fire, water, casualty, or other natural force are not covered under this Agreement. Component replacement or equipment Repair is not a part of the scope of Preventative Maintenance. Repairs or Preventative Maintenance requests which fall outside the scope of this Agreement may be billed at prevailing hourly rates with prior Buyer authorization. Failure to authorize repair and/or services may result in suspension or termination of this or any other Agreement between ECS and the Buyer.
Services Disclaimer. TeamSnap shall only be responsible for services described in Article 2. TeamSnap will provide its services in good faith, but makes no guarantees on the impact such services will have on Client‘s business or sales.

KsFiberNet makes no warrantees, guarantees, or representations, express, or implied that i) WAN Services will protect the Customer’ customers from intrusions, viruses, Trojan horses, worms, time bombs, cancelbots or other similar harmful or destructive programming routines; ii) any security threats and vulnerabilities will be prevented or detected; or, iii) the performance by KsFiberNet of WAN Services will render Customer’ systems invulnerable to security breaches.

Notwithstanding any KsFiberNet recommendation, referral or introduction in connection with Network Design and/or Network Discovery (collectively “Recommendations”), Customer is responsible to independently investigate and test Recommendations including, without limitation, Recommendations related to KsFiberNet or third party products and services. Customer will have sole responsibility for determining suitability for use of any Recommendations. KsFiberNet has no liability with respect to claims related to or arising from Recommendations including the use of third-party products and services, except to the extent of its negligence or willful misconduct.
