Shutdown Period Sample Clauses

The SHUTDOWN PERIOD clause defines a specific timeframe during which operations, services, or activities are temporarily halted, often for maintenance, upgrades, or compliance with regulatory requirements. In practice, this clause may specify the exact dates and duration of the shutdown, outline the responsibilities of each party during the period, and address how essential services or communications will be managed. Its core function is to provide clarity and predictability for all parties by formally scheduling downtime, thereby minimizing disruptions and ensuring that all stakeholders can plan accordingly.

Employees may take the shutdown time as banked overtime or vacation (to the extent the employee still has such time unused).

In the event that a shutdown is confirmed, the dates of the shutdown will be announced, and employees will be advised as to whether or not they will be required to work at least thirty (30) days prior to the beginning of the shutdown.
Shutdown Period a) The Company agrees to close the plant for a period of Two (2) to Four (4) weeks at a time most suitable to the business, during the months of July and August (“Annual Shutdown”). Notice of the date of the annual shutdown will be posted on April 1st of each year, and prompt action will be taken to schedule the vacation of employees. Except for those whose services are required during the shutdown, employees who are entitled to a vacation will take their vacation during the shutdown period. Additional vacation beyond the designated shutdown week(s) for those so qualifying must be taken in agreement with the Plant Manager, but may be taken at any agreeable time between January 31st and the end of the calendar year. Consideration will be given to take such additional vacation between January 1st and January 31st subject to management agreement. b) In the case where two employees choose the same date(s) for vacation, the senior employee requesting the vacation will be given preference, subject to the other provisions of this article XIII. c) In addition to the Annual Shutdown, the Company, at its sole discretion, can set additional full plant or partial plant shutdown periods during the year (“Additional Shutdowns”). By June 1st of each year, the Company shall announce all Additional Shutdowns for the remainder of the calendar year. By October 1st of each year, the Company shall announce all Additional Shutdowns for the period covering January to June of the following year.
