Temporary Contract Employees. It is the intent of the District that temporary 33 contract employees with satisfactory performance evaluations be offered regular contracts as 34 soon as possible. Temporary Contract Employees. Temporary contract employees are those hired by the Employer on a temporary contract basis with a termination date or expected date of termination established at the time of hire. Temporary contract employees are generally hired to replace an employee absent on leave and may be scheduled to work either full time or part time hours. Temporary contract employees may be terminated from employment at the end of the contract term with no further entitlement under this Agreement to notice, lay off, recall or otherwise.

5 A. The intention of this Article is to provide that the District retains all rights, powers, 6 authority, duties and responsibilities to direct, manage, and control conferred upon 7 and vested in it by the Laws and Constitution of the United States and the State of 8 California. In delineating the reserved rights of the District, it is not the intention of 9 the parties to detract from or diminish in any way the statutory right of the 10 Association to represent unit members under the Act. 11
12 B. It is agreed that all matters which are beyond the scope of negotiations as provided in

For the purpose of this agreement, a new temporary contract employee is defined as a person who replaces a bargaining unit employee who is absent from work, and such employment shall be terminated upon conclusion of the situation which created the need for the replacement. Such temporary employees are subject to Union dues deductions from date of hire. A temporary position shall not be in excess of twelve (12) months without the express written consent of the Union. The Union shall be provided with a list of all temporary employees, as defined within this clause, on a monthly basis. The list shall include the start date, and expected end date of each temporary employee.
