The Administrator may grant or refuse a request for a leave of absence without pay for extenuating personal reasons, provided that he receives at least one month's notice in writing, unless impossible, and that such leave may be arranged without undue inconvenienceto the normal operationsof the nursing home. (a) After the completion of two (2) years continuous employment with the Employer, a full-time or part-time leave of absence without pay of up to one (1) year may be granted to an employee. An employee must submit a written request to the Superintendentof Human Resources or designate setting out the start and end dates of the leave and the reason for the leave. of absence without pay may be renewed for a second consecutive year upon the mutual agreement of the Employer and the employee. The employee shall provide at least four (4) weeks notice of a request to renew a leave of absence without pay. The four (4) week requirement may be waived with the mutual agreement of the Employer and the employee. Subject to the Layoff and Recall provisions of this Collective Agreement, an employee returning from a leave of absence without pay of up to two (2) years shall be reinstated to the occupied prior to the leave or to a comparable position if that position no longer exists. An employee may, at the discretion of the Employer, return early from a leave of absence without pay upon giving four (4) weeks notice of the new date of return. Except as specified in this Agreement, all benefits, except Long Term Disability, held by an employee at the commencement of a leave without pay may be continued during such leave by the employee with the employee paying of the premium costs by debit. Leaves of personal : The Home may grant leave of absence, writing, and without pay to any nurse for personal reasons. A nurse who has received such permission to be absent will continue to accumulate seniority during her absence up to, but not beyond forty-five (45) continuous calendar days Association Business: The Home may grant leave of absence without pay or loss of seniority up to two (2) nurses at any one time to attend Association conventions or educational sessions. Such leave must be applied for at least two (2) weeks advance, and all leaves for all nurses shall not exceed thirty-five (35) working days per year. If a nurse's absence without pay from the Home exceeds forty-five (45) continuous calendar days, she will not accumulate service for purposes of vacation entitlement and sick leave benefits for the period of the absence. In addition, the nurse will become responsible for full payment of subsidized employee benefits in which she is participating for the period of the absence in excess of forty-five (45) continuous calendar days.
