The Right to Honour Lawful Picket Lines. 9.01 The Employer agrees that any employee may individually decide to refuse to cross a picket line which has been placed on any project where the employee is or has been assigned work. The Employer agrees that such individual decisions made by the employees concerned shall not constitute an unlawful strike under the provision of the Ontario Labour Relations Act or this Collective Agreement and the Employer agrees not to bring any proceedings of any kind or nature whatsoever against any person or the Union for such conduct. In the event that employees do individually decide to refuse to cross a picket line, then they will be assigned to such other work on such other projects as is available or be deemed to be on temporary lay off until either the picket line is removed or the employees decide that they will no longer refuse to cross the picket line. This article shall only apply to such picket lines established by the Union against any employer which continues to perform work on a particular project(s) where the picket line has been established.

It is agreed that the company trucks, when heated, shall be sufficient shelter for the purpose of this Article. In co-operation with the Employer's overall programme of Accident Control and Prevention, the Union Xxxxxxx may report to the Xxxxxxx any unsafe conditions, unsafe acts or violations of safety regulations. Every employee shall, as a condition of employment, be required to wear a safety helmet of a type approved by the Construction Safety Association. Every employee shall, as a condition of employment, own and wear suitable protective footwear and other personal protective equipment required in the normal course of his duties. This does not include raincoats or other protective clothing where the employee is required to work under abnormal conditions or during inclement weather. The Right to Honour Lawful Picket Lines. In view of the grievance and arbitration procedures provided in this Agreement, there shall be no strikes or lockouts so long as this Agreement continues to operate. The employees of any Employer may refuse to cross a lawful picket line which has been placed at any project where the Employer is engaged and the Employer agrees that the refusal to cross such picket line shall not constitute an unlawful strike within the provisions of the Ontario Labour Relations Act or this Collective Agreement and the Employer agrees not to bring any proceedings of any kind or nature whatsoever against any person or the Council or its member Unions for such conduct. This Article shall only apply to picket lines established by the Council or any of its member Unions. The parties agree that the right to honour lawful picket lines established by the Council or its members shall not become effective until the passage of the enabling legislation in the Ontario Labour Relations Act.

  • Right to Refuse to Cross Picket Lines All employees covered by this Agreement shall have the right to refuse to cross a picket line arising out of a dispute as defined in the Labour Relations Code of British Columbia. Any employee failing to report for duty shall be considered to be absent without pay. Failure to cross a picket line encountered in carrying out the Employer's business shall not be considered a violation of this Agreement nor shall it be grounds for disciplinary action.

  • Right to Refuse Dangerous Work An employee shall have the right to refuse to work in situations, which can reasonably be considered dangerous.

  • STATE'S RIGHT TO STOP THE WORK 3.3.1 If the Contractor fails to correct defective Work as required by Paragraph 13.2 or persistently fails to carry out the Work in accordance with the Contract Documents, the State, by a written order signed personally or by an agent specifically so empowered by the State in writing, may order the Contractor to stop the Work, or any portion thereof, until the cause for such order has been eliminated; however, this right of the State to the stop the Work shall not give rise to any duty on the part the State to exercise this right for the benefit of the Contractor or any other person or entity, except to the extent required by Subparagraph 6.1.3.

  • STATE'S RIGHT TO CARRY OUT THE WORK 3.4.1 If the Contractor defaults or neglects to carry out the Work in accordance with the Contract Documents and fails within seven days after receipt of written notice from the State to commence and continue correction of such default or neglect with diligence and promptness, the State may, after seven days following receipt by the Contractor of an additional written notice and without prejudice to any other remedy he may have, make good such deficiencies. In such case an appropriate Change Order shall be issued deducting from the payments then or thereafter due the Contractor the cost of correcting such deficiencies, including compensation for the Architect's and the State’s additional services made necessary by such default, neglect or failure. Such action by the State and the amount charged to the Contractor are both subject to review by the Architect under Paragraph 2.2.14 of these General Conditions. If the payments then or thereafter due the Contractor are not sufficient to cover the amounts paid by the State to make good such deficiencies, then the Contractor shall pay the difference to the Owner.
