Total Salary. Employee shall receive total annual compensation in an amount set by the Board from time to time throughout the Term (the “Total Salary”). The Total Salary will be accrued on a daily basis and payable in installments consistent with Company’s normal payroll schedule, subject to applicable withholding and other taxes. As of the Effective Date, Employee’s Total Salary is $400,000. Employee’s Total Salary may be increased during the Term, but shall not be decreased without Employee’s written consent provided, however, that Employee’s Total Salary may be reduced without Employee’s consent by the same proportion as other Company employees if and to the extent that the Board imposes a Company-wide reduction in salary on substantially all of Company’s employees.

Total Salary. An employee who works in supervisory duties or is responsible for production or works as an independent expert and can decide on his or her working time arrangements, can agree on a total salary with his or her employer. In this case, the total salary covers the basic salary element (hourly or monthly salary) and the fixed monthly compensation including possible Sunday bonuses, on-call and standby time and other compensation related to the working time. The scope and times of on-call and standby duty must be agreed in advance in writing. The fixed monthly salary also covers on-call and stand-by compensations in accordance with the collective agreement (see Section 18 On-call duty).

The base salary, automobile lease and automobile running cost components of Total Salary will be accrued on a daily basis and payable in installments consistent with Company’s normal payroll schedule, subject to applicable withholding and other taxes. As of the Effective Date, Employee’s Total Salary is $265,300. Employee’s Total Salary may be increased during the Term, but shall not be decreased without Employee’s written consent. The Total Salary for Employee shall be paid in a manner mutually agreed between Employee and Company and may include, but will not be limited to, cash salary, automobile leasing and running payments and spousal travel. The initial allocation of the Total Salary is set forth in Exhibit A. Employee and Company may, from time to time, agree to change the allocation of Total Salary in Exhibit A by written agreement signed by both Company and Employee. The full amount of the spousal travel component of Total Salary, if any, will be available at any time during the calendar year to reimburse Employee’s spousal travel expenses upon the presentation of related expense documentation to Employee in accordance with related Company policies and procedures. To the extent that Employee is not reimbursed for the full amount of the spousal travel component of Total Salary on or before December 31 of the calendar year in which it first became available, Company will pay him the remaining amount no later than March 15 of the calendar year following the calendar year when such amount first became available to him. However, if Employee’s employment is terminated, the spousal travel component of his Total Salary shall be treated as being accrued on a daily basis during the period beginning on January 1 and ending on the last day of his employment.

CHAPTER 2-0.00 FIELD OF APPLICATION AND RECOGNITION‌ 2-1.00 FIELD OF APPLICATION‌ 2-1.01 The agreement shall apply to every teacher covered by the accreditation and employed by the Board to teach students in preschool, elementary- and secondary-level classes. 2-1.02 Without limiting the scope of the foregoing, the agreement shall apply to head teachers and department heads but shall not apply to management personnel including centre directors, principals and vice-principals, professional personnel, administrative personnel, technical personnel, secretarial personnel, nor to the personnel of auxiliary and community services or the school equipment service. 2-1.03 Notwithstanding clause 2-1.01, only the clauses in which they are expressly referred to as well as the procedure for settling grievances for these same clauses shall apply to the following persons covered by the accreditation: 1) casual supply teacher; 2) teacher-by-the-lesson; 3) the teacher employed by the Board who is teaching outside Québec following an agreement approved by the Minister between the teacher, the Board, the Government of Canada, the government of another province or the Government of Québec. 2-1.04 This agreement shall not apply to teachers coming from abroad or from another province and who teach for the Board following an agreement between the Board, the Government of Canada or the Government of Québec and another provincial government or a foreign government. In applying the provisions of Chapter 8-0.00, the Board shall undertake to consider the teacher as if he or she were one of its other teachers. 2-1.05 Notwithstanding clause 2-1.01, only Chapter 11-0.00 shall apply to teachers covered by the accreditation and employed directly by the Board to teach adults within the framework of the adult education courses under the authority of the Board by virtue of the authorization of the Minister prescribed in the Education Act for Cree, Inuit and Naskapi Native Persons (R.S.Q., c. I-14). 2-1.06 Unless the context indicates otherwise, the replacement teacher shall benefit from the same rights and obligations as the part-time teacher under the agreement.
