University Governance. Except as expressly provided for in the Certification Order and this Collective Agreement, the parties agree: (a) to acknowledge and support the traditional role of Senate as established by statute, bylaw and practice; (b) to acknowledge and support the traditional role of the Board of Governors and the persons authorized to act on its behalf; (c) that nothing in this Collective Agreement shall be construed to deny or diminish any existing rights, privileges and responsibilities of employees, individually and collectively, to participate directly in the formation and recommendation of policy within Carleton University and its component parts, as these rights, privileges and responsibilities are provided for under existing Senate/Board documents and/or established practices. Except as modified in this article or changed by subsequent agreement of the parties, the Senate/Board policies referred to in Articles 14, 15, 16, 17 and 26, as they were on the date of signing this agreement, shall remain in force for the term of this Collective Agreement unless specifically amended by agreement of the parties. Should the Senate change or alter any of these policies during the term of this agreement, Articles 14, 15, 16, 17 and 26 shall remain in force for the term of this Collective Agreement, unless specifically amended by agreement of the parties.

University Governance. 29.5.1 Members have the right and responsibility to participate in University governance by providing counsel and advice on matters of planning and policy. Members share a right and responsibility for shaping the direction of their respective Departments and Faculties/Schools, and for serving on University-wide councils and committees. Since participation of Members in these areas is vital to academic governance, the University and all its Members have a shared responsibility to participate in University governance.

University Governance. 9.01 Except as expressly provided for in the certification order or in this Collective Agreement, the Board acknowledges the importance of participation by Members and other academic staff in the collegial process, including the internal regulation of the University and the selection of academic administrators, in accordance with arrangements approved from time to time by the Senate and the Board. 9.02 The Parties agree that before either submits a proposal to Government or to the Legislative Assembly for legislation, or before either supports any legislative proposal affecting Dalhousie University, each will advise the other and the Senate and provide both with a reasonable opportunity for consultation about their positions.

The Board of Trustees is responsible for setting priorities and long-term plans for the University. C. The Board of Trustees is legally responsible for the performance and oversight of all aspects of University operations. D. The Board of Trustees is responsible for the employment, compensation, and evaluation of all University employees, including the University President except as provided in Section V.B.
University Governance. The rights of both parties with respect to matters concerning university governance are reserved. (a) No changes in existing practices in force as of the effective date of this Collective Agreement affecting academic staff, other than those provided for in this Collective Agreement, shall be instituted without the agreement of the Association. The decision of the Board to alter such practices shall be subject to the grievance and arbitration procedures established by this Agreement. Existing practices mean practices with respect to terms and conditions of employment, which are reasonable, certain and known, in force at the date of the commencement of this Agreement or during the preceding academic year. (b) The onus of establishing an existing practice within the meaning of Clause 7:02 (a) shall rest on the party or person who alleges the existence of such existing practice. (c) The Board acknowledges a continuing responsibility to maintain a climate in which the responsibilities of the academic staff may be carried out, and undertakes, therefore, to continue to provide a reasonable level of facilities and support services consistent with this responsibility. The University will endeavour to maintain reasonable levels of working space, secretarial services, laboratory facilities, instructional aids, library and technical expertise, and support services, including telephone, computing, printing and copying. (a) The university shall indemnify and save harmless each Association member against damages and shall maintain liability insurance coverage at the current or comparable level insuring members who are acting within the scope of their employment against liability claims. (b) Access to the policies of insurance, as amended or as substituted from time to time, shall be provided to the Association at any time for their review and copying as required.

University Governance. Academic Senate and Committees – As part of their institutional support obligations, full time Faculty will serve on the Academic Senate and formal University committees and/or ad hoc committees, or meet their service obligations in other agreed upon ways in accordance with Article 10.5.
