Use of Accrued Sick Leave. 25 i. Use of accrued sick leave, without abuse of such leave, 26 will not be cause for discipline. 27 ii. When the intermittent use of accrued sick leave or other 28 paid or unpaid leave used in lieu of sick leave interferes significantly with an employee’s 29 ability to perform the duties of his or her job, management may do the following (subject to the 30 requirements of law, including, but not limited to, the FMLA):

Use of Accrued Sick Leave. Employees’ accrued sick leave balances will be charged for the actual time of any sick leave used. Accrued sick leave may be used only for: 30.2.1 An absence resulting from an employee’s mental or physical illness, injury, or health condition; to accommodate the employee’s need for medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; an employee’s need for preventative medical care; medical, dental or optical appointments and for reasons allowed under the Minimum Wage Requirements and Labor Standards, RCW 49.46.210. 30.2.2 A period of quarantine following the exposure to a contagious disease during the period when attendance on duty would jeopardize the health of others; 30.2.3 For reasons allowed under the Minimum Wage Requirements and Labor Standards, RCW 49.46.210, and for absences qualifying for leave under the Family Care Act, WAC 296-130. This includes providing care for a family member with a mental or physical illness, injury, or health condition; care of a family member who needs medical diagnosis, care, or treatment of a mental or physical illness, injury or health condition; care for a family member who needs preventative medical care; or medical, dental or optical appointments. For purposes of this Article, the definition of a family member is defined as follows: (a) A child, including a biological, adopted, or xxxxxx child, stepchild, or a child whom the employee stands in loco parentis, is a legal guardian, or is a de facto parent, regardless of age or dependency; (b) A biological, adoptive, de facto, or xxxxxx parent, stepparent, or legal guardian of an employee or the employee’s spouse or registered domestic partner, or a person who stood in loco parentis when the employee was a minor child; (c) A spouse (d) A registered domestic partner; (e) A grandparent; (f) A grandchild; or (g) A sibling.

When the intermittent use of accrued sick leave or 31 other paid or unpaid leave used in lieu of sick leave interferes significantly with an 1 employee’s ability to perform the duties of their job, management may do the following 2 (subject to the requirements of law, including, but not limited to, the FMLA, OFLA, 3 Oregon Sick Leave Law, and Paid Leave Oregon): 4 (a) require the employee to take continuous leave; 5 or 6 (b) change the employee’s work assignment for six 7 (6) months or until use of intermittent leave ends, whichever comes sooner.

When the intermittent use of accrued sick 25 leave or other paid or unpaid leave used in lieu of sick leave interferes 26 significantly with an employee’s ability to perform the duties of his or her job, 27 management may do the following (subject to the requirements of law, including, 28 but not limited to, the FMLA): (a) Require the employee to take 30 continuous leave; or 31 (b) Change the employee’s work 1 assignment for six (6) months or until use of intermittent leave ends, whichever 2 comes sooner.

Unused sick leave may be accrued indefinitely and, upon retirement, may or may not be added to retirement benefits depending upon PERS regulations in effect upon retirement. 9.1.2.1 Absence(s) which are chargeable to sick leave are the actual hours which the employee would have worked had the employee served during the day. 9.1.2.2 An employee with more than six (6) months' service who has used all accrued sick leave will be advanced as much sick leave as the person could earn during the remainder of the fiscal year. An employee with six (6) or less months of service will be advanced the remainder of six (6) days of earnable sick leave. 9.1.2.3 An employee who at the time of termination has taken more sick leave than he/she has accrued shall reimburse the District for the value of the difference. Whenever an employee is reemployed within a twelve- month period following termination of services, unused sick leave from the prior period of employment shall be reinstated.
