Utility Requirements. A. Make notification to utilities during conceptual phase of preliminary design process. Communication to be made in a specific, documented format. (As detailed in item D).
B. Based on specific utility feedback, and field observation, identify potential high expense utility relocation issues.
C. Prepare and present plan for city review, detailing significant utility conflicts, proposed pothole locations, and associated costs for verifying existing utilities. Potholing process to include horizontal and vertical alignment and depth details. Details will be included in 30 percent plan completion, final right of way plans, and final construction plans. Necessary corrective action to address incomplete or inaccurate details may be subject to errors and omissions insurance claim.
D. Submit utility report at 30 percent submittal and close out of project. Utility report to include representatives contacted, meeting dates, and a summary of discussions, requests, observations and/or concerns. (See City of Joplin utility notification form)
Utility Requirements. All Services and Work shall be done in accordance with this Agreement, all Legal Requirements and all warranty requirements. The EPC Contractor shall give any and all notices required and comply with all Legal Requirements and Utility Requirements bearing on safety of persons or property or their protection from damage, injury or loss. EPC Contractor represents and warrants that any Subcontractor(s) will comply with the standards set forth in this section 3.5 and covenants that EPC Contractor shall (i) ensure that any Subcontractors comply with this Section 3.5 and (ii) be liable for the failure of any Subcontractor(s) to comply with any Legal Requirements or warranty requirements.
Utility Requirements. The Project shall be serviced solely by Ocala Electric Utility for electricity after the date on which a certificate of occupancy is issued for the Project.

Utility Requirements. 3 1.6 Payment Issuance and Processing 5
Utility Requirements. A utility easement agreement is a contract in which a landowner grants a municipality or a utility company the right to install lines or ditches on part of the landowner's property. The granted part is usually called a "right-of- way." A utility easement agreement can be registered on the title to land as a permanent interest. Utility companies are asked to comment on extending and protecting service lines. Line locations must be shown on a plan of proposed subdivision. Utility companies may ask subdivision applicants to enter into easement, installation or relocation agreements. Assistance is available by calling Sask1stCall at 0-000-000-0000 or visiting the Sask1stCall website. Residential development must be served by acceptable water, sewer and garbage systems. Multiple lots should be connected to communal systems. In the case of a rural or isolated site, health regulations require a residence using a sewage lagoon, seepage pit or jet disposal to have a minimum parcel size of four hectares. A lagoon must be 30 metres from property lines, a pit three metres and a jet 60 metres. Otherwise, a mound or buried absorption system must be installed or sewage must be hauled to an approved disposal site. Ministry of Highways permits are required to build highway approaches or other development within 90 metres of a highway. Land may be required for highway widening or service roads. Landowners are responsible for road and/or driveway construction.
Utility Requirements. A. Utility shall review and reconcile the Direct Payment Summaries as necessary to ensure that undelivered LIHEAP benefits have been returned to CSD within 30 calendar days of receipt of warrant.
B. Utility shall track the liquidation of applied LIHEAP benefit or credit for a period of 12 months or until credit is fully liquidated, whichever occurs first.

C. If a LIHEAP benefit or credit is not fully liquidated and the client’s account is closed within twelve (12) months from the date of the LIHEAP benefit or credit, the Utility shall treat the credit as an overpayment and shall return the credit to CSD within 30 days of the account closure. Utility shall identify the account holder’s name, the account number, account address, amount of credit returned and date the original credit posted to the account.
D. If a LIHEAP benefit or credit is not fully liquidated and the client’s account is closed after twelve (12) months from the date of the LIHEAP benefit or credit, the Utility shall treat the credit as a customer overpayment and shall return the credit to the account holder(s) within 30 days of the account closure.
E. To enable CSD to effectively monitor the pledge process is working as intended and payment on LIHEAP pledges are made timely, CSD requires Utility to report specific information on broken and cancelled LIHEAP benefit pledges. Utility will establish a process to report “broken” or “cancelled” pledges” as defined in Article 1.8.
F. Utility shall charge the eligible household, in the normal billing process, an amount not to exceed the difference between the actual cost of the home energy usage and the LIHEAP benefit amount. The actual costs of the home energy usage shall be consistent with appropriate utility company tariffs as approved by the CPUC, if applicable.
G. No customer receiving LIHEAP assistance pursuant to this Agreement will be subjected to disparate or adverse treatment by Utility due to receipt of such assistance, in accordance with applicable state laws.
H. CSD will notify Utility, via a phone call and following up with an e-mail, when a submission error has occurred that resulted in a payment to the wrong account or wrong Utility, etc. and request a refund of the LIHEAP benefit. Utility shall respond within two business days and refund the LIHEAP benefit to CSD within ten days from the date of CSD’s e-mail.
