WORK BY EXCLUDED PERSONS Sample Clauses

WORK BY EXCLUDED PERSONSThe Union and Employer recognize that supervisors are excluded from the provisions of the Labour Contract and accordingly, it is improper for supervisors to do the kind of work which is done by those defined as Employees in the Contract. It is also recognized that for the practical and efficient operation of the plant, there are occasions when a supervisor may instruct by demonstration. Such occasions must be temporary in nature and must not result in the displacement or exclusion of Employees under the Contract. Supervisory Employees may instruct plant personnel by demonstration when running-in new equipment, trouble shooting equipment or production problems and in training of new Employees. Supervisory Employees may work on equipment for any of the following reasons: 1. Everyday repair work, involving equipment breakdown when plant maintenance personnel are not immediately available. 2. To operate equipment for production purposes but only if capable plant personnel are not available. Supervisory Employees will only perform the work in items 1 and 2 above if steps have been taken to call in a maintenance or production person. The Company will not contract out any repairs or maintenance work which is regularly performed by the Employees, for which the plant is equipped, for which crews are available, and which Employees are capable of doing.
WORK BY EXCLUDED PERSONS. Persons whose regular jobs are not in the bargaining unit will not work on any jobs for which rates are established by this Agree- ment, except for purposes of instruction, experimenting, or for the purpose of re- storing or maintaining production when regular employees are not available. Such trainees are not under the scope of this Agreement, but may during their course of training perform work in any classification covered by the bargaining unit. An employee who would otherwise be working on the job being performed by a Supervisory Trainee will “stand by” while his job is being performed. If the regular employee is assigned by Management to instruct the Supervisory Trainee, the Instructors rate will apply during the shift he is assigned to work as an Instructor. The Union will be notified of all Supervisory Trainees in the plant and their schedules. Grievances arising over an alleged xxxxx- tion of this clause must be filed within five workdays of the occurrence and will be heard initially in the Second Step of the Grievance Procedure. If the Company agrees at any step of the Grievance Proce- dure that there has been a violation of this Section by management or supervisory personnel or if the arbitration board so determines, the employee who would have performed the work will receive a just award. In any event the award will be no less than four hours pay.
