XXXXXXX / GENERAL XXXXXXX. The Employer shall be the sole judge of the need for the number of and the responsibilities of supervisory personnel and the Union shall in no way interfere with the performance of the Xxxxxxx/General Xxxxxxx in carrying out his responsibilities as directed by the Employer. There will be no restrictions in crafts to be supervised by the Xxxxxxx/General Xxxxxxx. Transportation will be provided to Xxxxxxx at the option of the Employer.

SECTION 1. Recognizing the need for an adequate supply of qualified carpenters, the contractor and the Union mutually agree to actively promote, and partic- ipate in, joint apprenticeship and retraining programs designed to meet this need.
SECTION 2. Such programs which exist or are devel- oped to achieve this end and are supported in whole or in part from funds derived from this Agreement shall:
A. Be jointly administered by equal representa- tion of Management, as appointed by the contractor, and labor as appointed by the Union.
B. Comply with all applicable State and Federal regulations governing same.
C. Issue certification of achievement to each person satisfactorily completing the programs’ uni- form standards as established by parties to this Agree- ment.
D. Predicate an applicant’s entrance of advance- ment in the program solely upon results of placement examinations designed to reflect the minimum level of ability necessary to satisfactorily perform the require- ments of any given level. The Apprentice will be removed from the job for just cause by his Employer upon receipt of request from appropriate apprenticeship and/or training committee. Also for non-payment of dues or initiation fees.
E. A separate Out-of-Work List for Apprentices shall be maintained at each hiring hall. The method of selection and dispatching of apprentices shall be deter- mined by each local J.A.T.C. and shall become part of this Agreement.
XXXXXXX / GENERAL XXXXXXX. Section 1. When two Millwrights are employed, one shall be the Xxxxxxx and he/she shall receive not less than the amount per hour, as noted on the Wage and Fringe Schedule (by county), over the journeyman's rate, with a minimum of eight (8) hours per day guarantee, Monday through Friday, while on the payroll of the Employer and continuing to serve in that capacity.
Section 2. Section 3. When a Xxxxxxx or General Xxxxxxx is employed, he/she shall be recognized as the only representatives of the Employer who shall issue instructions to the workers.
Section 4. No Xxxxxxx shall have more than twelve (12) Millwrights under his/her jurisdiction. Upon mutual agreement between the Union and the Employer, the maximum number of Millwrights per Xxxxxxx may be adjusted.
Section 5. All Foremen and General Foremen shall be journeyman members of the craft.
Section 6. When more than Fifty (50) Millwrights are employed on a single project a general xxxxxxx shall be employed.

5. APPRENTICESHIP & TRAINING

XXXXXXX / GENERAL XXXXXXX. On jobs where six (6) or more men are employed, a Plumber Laborer shall be employed as a Plumber Laborer Xxxxxxx. Foremen shall receive not less than $.50 per hour more than the regular hourly plumber laborer rate. When the Employer determines that a xxxxxxx is required to direct the work of other foremen, he shall be designated as a General Xxxxxxx. Designation as a General Xxxxxxx shall not relieve employee of his duties as a xxxxxxx. A General Xxxxxxx shall receive not less that $1.00 per hour more than the regular hourly plumber laborer rate.
XXXXXXX / GENERAL XXXXXXX. 1701 The selection of the Cement Xxxxx employee who will be Cement Xxxxx Xxxxxxx is at the sole discretion of the Contractor. It is understood that a Cement Xxxxx Xxxxxxx shall be an employee of his craft and shall receive the Cement Xxxxx Xxxxxxx’x wage rate. Such Cement Xxxxx Xxxxxxx may work with the tools of the trade. Only Cement Mason Foremen who normally work with the tools of the craft during straight-time periods, in addition to the performance of Cement Xxxxx Xxxxxxx duties, may work with the tools of the craft during overtime periods. It is understood that in certain cases, by reason of custom and practice established by the parties hereto, a craft xxxxxxx may be xxxxxxx over the work and workmen of more than one craft. If a dispute arises with respect to the application of this understanding, such dispute shall be determined according to the procedure set forth in Article VI of this Agreement on the basis of such custom and practice. 1702 Employees not covered by this Agreement, as set forth in Paragraph 201 of this Agreement, such as superintendents, assistant superintendents or master mechanics, shall not act in the capacity of a craft xxxxxxx or work with the tools of the Union signatory to this Agreement, except in case of emergency.
1702.1 Any person working with the tools of the trade shall be covered by all terms and conditions of this Agreement including the provisions of Paragraph 201 of this Agreement as is legally permissible (or) except for Trust Fund restrictions on participation. 1704 General Xxxxxxx may receive no less than one dollar ($1.00) an hour more than hourly Cement Xxxxx Xxxxxxx rate. Nothing herein shall require the employment by an Individual Employer of a General Xxxxxxx either generally or on specific projects.
