If an employee fails to give the required notice or having given, or been given, such notice leaves before the notice expires, the employee forfeits the entitlement to any moneys owing to the employee under this Agreement except to the extent that those moneys exceed the ordinary wages for the required period of notice.

An employee may terminate their employment by giving the same notice as required to be given by the employer, save for the additional weeks notice required for employees aged 45 or over. Should an employee fail to give the required notice, they may forfeit the entitlement to any monies owing equal to the amount of notice not given. Nothing in this agreement affects our right to dismiss you without notice for serious misconduct and if so dismissed shall only be entitled to be paid for the time worked up to the time of dismissal and any entitlements accrued to such time. On termination of an employee's employment, deductions from final pay will be made in respect of monies owing to the Employer (if applicable). On termination, an employee shall not take up employment in, own or operate a business in competition with Brewers Choice for a period of 6 months. An Employee shall not disclose any information about the operations of the Employer, recipes used, or documentation used in the operation of the company.

All employees upon cessation of employment are required to return to the Company's office, all uniforms, badges, keys and equipment issued to them by the Company and/or by the Company's client. Final payment of termination entitlements will only be made once the above property has been returned. Company property which is found to be damaged or is not returned will result in the value of the property being deducted from final termination payment (excluding fair wear and tear). All items of uniform shall be laundered to a professional standard or the cost of such laundering shall be deducted from the employee's termination entitlements. The Company reserves the right to terminate any employee without notice (summary dismissal) for a serious breach of company policy and/or other forms of serious and wilful misconduct. Breaches of company policy which may form grounds for disciplinary action and/or termination include but are not limited to: O Smoking in non designated areas. O Sleeping whilst on duty. O Dangerous driving whilst on duty. O Misuse of company vehicles or property. O Wilful damage O Theft O Any criminal offence. O Incapacity due to loss of Security Industry License O Use or possession or sale of Alcohol or Illicit Drugs whilst on duty or breaches of clause 24 of this agreement. O Loss or suspension of any relevant license, clearance or certificate eg Security Industry license, security clearance, drivers licence or First Aid Certificate. O Unauthorised use of company or client property or equipment including phone and internet. O Aggressive behaviour including but not limited to sexual harassment. O Failing to advice of inability to attend for duty. O Consuming alcohol prior to the commencement of a shift O Failure to comply with W, H & S policies and work procedures.
