COMPENSATING TIME. Compensating time earned by an employee may be accumulated up to two hundred forty (240) hours. Except where operational needs require otherwise, employees shall be entitled to use compensating time at times of their choice. Upon mutual agreement between an employee and an agency and with approval of the Commissioner or a designee, an agency may at any time pay an employee for up to two hundred forty (240) hours of that employee's accumulated compensating time. Such payment shall be made at the employee's hourly rate of pay in effect at the time of payment.
COMPENSATING TIME. The maximum accumulation of compensating time shall not exceed two hundred forty (240) hours. It shall be the employee’s responsibility to ensure that his/her accumulation does not exceed two hundred forty (240) hours. The following procedure shall be used regarding the maximum accumulation of compensating time:
1. If an employee earns compensating time which puts him/her above the maximum, it shall be scheduled by mutual agreement by the end of the next fourteen (14) day cycle.
2. If it cannot be scheduled by mutual agreement, it shall be scheduled by management by the end of the next twenty-eight (28) day cycle.
3. If it cannot be scheduled by management, it shall be paid by the end of the next fourteen (14) day cycle. Payment for time made pursuant to this section will not be made in an arbitrary and capricious manner.
COMPENSATING TIME. Compensating time earned by an employee may be accumulated up to one hundred eighty (180) hours. Accumulated compensating time shall be reduced to one hundred eighty (180) hours by June 30, 2002. Except where operational needs require otherwise, employees shall be entitled to use compensating time at times of their choice. If an employee is denied use of compensating time which exceeds the allowable accumulation, he/she shall, at the employer's option, be paid for the time or be entitled to carry it over until a suitable time for use is approved.
COMPENSATING TIME. To be eligible for holiday pay an employee must be in pay status or an approved leave of absence the last hour of his/her scheduled work day prior to the holiday and in pay status the first hour of his or her scheduled work day after the holiday.

COMPENSATING TIME. The parties agree to follow Article 9, Compensating Time as currently stated in the Supervisory Services Bargaining Unit and Operations, Maintenance and Support Services Bargaining Unit contracts.
COMPENSATING TIME. A. The maximum accumulation of compensating time shall not exceed two hundred forty

B. Employees, at their option, shall be eligible to earn up to forty (40) hours of compensating time in lieu of overtime compensation, at the appropriate rate, each calendar year.
C. So long as there is mutual agreement between the employee and management, an employee may convert up to forty (40) hours of compensating time for pay in September and/or March of each fiscal year.
COMPENSATING TIME. Any employee may choose compensating time off in lieu of overtime pay. Subject to the requirements and limitations of any law or regulation, compensating time off shall be granted 1 ½ hours for each hour of overtime worked. The use of compensating time requires the prior approval of the employee's immediate supervisor. Accumulation of compensating time off shall be limited to 160 hours.

Upon mutual agreement, an agency may at any time pay an employee for up to one-half (1/2) of that employee's accumulated time. Such payment shall be made at the employee's base hourly rate in effect at the time of payment. Payments may be made from funds other than those allocated pursuant to Section 3b.
