ACCIDENT MAKE-UP PAY. 28.1 The employer will pay an employee accident pay, as defined in clause 9 – Definitions, where the employee receives an injury for which weekly payments of compensation are payable by or on behalf of the employer pursuant to the provisions of the relevant workers’ compensation legislation as amended from time to time. 28.2 The employer shall pay accident pay as defined in this clause, during the incapacity of their employee/s arising from any one work-related injury, for a total of fifty-two (52) weeks - irrespective of whether such incapacity is in one (1) continuous period or not. 28.3 The provisions of this Clause will not result in any ‘double dippingin respect to benefits payable to an employee. 28.4 The liability of the employer to pay accident pay in accordance with this Clause will arise as at the date of the injury or accident in respect of which compensation is payable under the said relevant workers’ compensation legislation and the termination of the employee’s employment for any reason during the period of any incapacity will in no way affect the liability of the employer to pay accident pay as provided in this clause. 28.5 In the event that an employee receives a lump sum in redemption of weekly payments under the relevant legislation, the liability of the employer to pay accident pay as herein provided will cease from the date of such redemption. 28.6 The employer may at any time apply to the FWC for exemption from the terms of this Clause on the grounds that an accident pay scheme proposed or implemented by the employer contains provisions generally not less favourable to the employees than the provisions of this clause.

ACCIDENT MAKE-UP PAY. An employee on being absent from work due to an injury shall be entitled to accident make up pay, being a weekly payment of an amount representing any shortfall between the total weekly amount payable under the Accident Compensation Act 1985 at the date from which liability is accepted under that Act and the weekly amount that would have been paid to the employee at ordinary time rates as of that same date as per clause 9.1, 9.2 & 9.

ACCIDENT MAKE-UP PAY. 23.1. The employer shall pay an employee accident make-up payment where the employee receives an injury for which weekly payment of compensation is payable by or on behalf of the employer pursuant to the provisions of the appropriate Workers’ Compensation Act or Ordinance as amended from time to time. 23.2. Accident make-up payment means a weekly payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the said appropriate Workers’ Compensation Act or Ordinance and the employee’s appropriate Agreement rate, or, where the incapacity is for a lesser period than one week, the difference between the amount of compensation and the said Agreement rate for that period. 23.3. The employer shall pay, or cause to be paid, accident make-up payment during the incapacity of the employee within the meaning of the said appropriate Act or Ordinance until such incapacity ceases or until the expiration of a period of thirty-nine (39) weeks from the date of injury, payment prescribed shall 23.4. The liability of the employer to pay make-up payment in accordance with this clause shall arise as at the date of the injury or accident in respect of which compensation is payable under the said appropriate Act or Ordinance, and the termination of the employee’s employment for any reason during the period of any incapacity shall in no way affect the liability of the employer to pay accident make-up payment as 23.5. In the event that the employee receives a lump sum in redemption of weekly payments under the appropriate Act or Ordinance, the liability of the employer to pay accident make-up payment as herein provided shall cease from the date of such redemption.

ACCIDENT MAKE-UP PAY. City West Water shall pay an employee accident make-up pay where an employee receives an injury for which weekly payments of compensation are payable by or on behalf of the Company pursuant to the provisions of the Accident Compensation Act 1985. 31.1 Accident make-up pay means a payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the Accident Compensation Act 1985 and the employee's ordinary rate of pay as defined, or where the incapacity is for a lesser period than one week the difference between the amount of such compensation and the rate of pay for that period. 31.2 City West Water shall pay or cause to be paid make-up pay during the incapacity of the employee within the meaning of the Accident Compensation Act 1985. Such payment shall not be paid: 31.2.1 in excess of a continuous period of 52 weeks; or 31.2.2 in excess of an aggregate period of 52 weeks in respect of a particular injury or incapacity. 31.3 At the expiration of 52 weeks on accident make-up pay an employee who is in receipt of a weekly amount pursuant to the Accident Compensation Act 1985 may use accrued leave entitlements to make up the difference between such payments and his/her ordinary rate of pay as defined. Provided that this provision shall not apply where WorkCover payments have been reduced in accordance with the said Act. 31.4 In the event that the employee receives a lump sum in redemption of weekly payments under relevant legislation, the liability of the Company to pay make-up pay in relation to that injury shall cease from the date of such redemption. The employee may repay any payments made in settlement of a claim for civil damages in connection with the injury to the extent that the judgment or settlement specifically compensates the injured employee for make-up payments made under this clause. 31.5 Where an employee is off duty as a result of an injury or accident for which the Company is liable for make-up pay under this clause, such an employee shall be entitled to return to duty on suitable alternate duties should the employee's treating medical practitioner so recommend for the purposes of rehabilitation, and provided suitable work is available without prejudice to other employees.
