ACCIDENT MAKE-UP PAY. 28.1 The employer will pay an employee accident pay, as defined in clause 9 – Definitions, where the employee receives an injury for which weekly payments of compensation are payable by or on behalf of the employer pursuant to the provisions of the relevant workers’ compensation legislation as amended from time to time.
28.2 The employer shall pay accident pay as defined in this clause, during the incapacity of their employee/s arising from any one work-related injury, for a total of fifty-two (52) weeks - irrespective of whether such incapacity is in one (1) continuous period or not.
28.3 The provisions of this Clause will not result in any ‘double dipping’ in respect to benefits payable to an employee.
28.4 The liability of the employer to pay accident pay in accordance with this Clause will arise as at the date of the injury or accident in respect of which compensation is payable under the said relevant workers’ compensation legislation and the termination of the employee’s employment for any reason during the period of any incapacity will in no way affect the liability of the employer to pay accident pay as provided in this clause.
28.5 In the event that an employee receives a lump sum in redemption of weekly payments under the relevant legislation, the liability of the employer to pay accident pay as herein provided will cease from the date of such redemption.
28.6 The employer may at any time apply to the FWC for exemption from the terms of this Clause on the grounds that an accident pay scheme proposed or implemented by the employer contains provisions generally not less favourable to the employees than the provisions of this clause.
ACCIDENT MAKE-UP PAY. The enterprise shall pay accident pay as defined in the Award, during the incapacity of their employee/s arising from any one injury, for a total of fifty-two (52) weeks – irrespective of whether such incapacity is in one continuous period or not.
ACCIDENT MAKE-UP PAY. An employee on being absent from work due to an injury shall be entitled to accident make up pay, being a weekly payment of an amount representing any shortfall between the total weekly amount payable under the Accident Compensation Act 1985 at the date from which liability is accepted under that Act and the weekly amount that would have been paid to the employee at ordinary time rates as of that same date as per clause 9.1, 9.2 & 9.
ACCIDENT MAKE-UP PAY. The employer will extend their cover of Workplace Accident Make up pay from the current Award entitlement to a period of 39 weeks.
ACCIDENT MAKE-UP PAY. The Company will provide accident make up payments to 100% of pre injury average weekly earnings where the employee receives an injury for which weekly payments of compensation are payable by or on behalf of the Company pursuant to the provisions of the relevant workers’ compensation legislation as amended from time to time, where the company fail to maintain a valid income protection policy as outlined in clause 46. The Company shall pay accident pay as defined in this clause, during the incapacity of their employee/s arising from any one work – related injury, for a total of one hundred and four (104) weeks – irrespective of whether such incapacity is in one continuous period or not. The provisions of this clause will not result in any ‘double dipping’ in respect to benefits payable to an employee. The liability of the Company to pay accident pay in accordance with this Clause will arise as at the date of the injury or accident in respect of which compensation is payable under the said relevant workers’ compensation legislation and the termination of the Employee’s employment (other than for the reason of genuine redundancy due to Project completion) during the period of incapacity will in no way affect the liability of the Company to pay accident pay as provided in this clause. PURPOSE
(a) The primary aim of this clause is to return ill and injured workers to their full working potential at the job for which they were originally employed, or such other job as is within their capacity, as soon as it is safe to do so.
(b) If a dispute arises over any matter dealt with in this clause, either party has recourse to conciliation and arbitration under the dispute settlement procedure. In recognition of the importance of the proper rehabilitation of ill or injured workers, anything arising under this clause that is the subject of a dispute will not be implemented until the dispute is resolved
(a) Where an employee is receiving income protection or worker’s compensation payments, the employee will not be dismissed by the Company before the expiry of a period of 104 weeks from the date the employee last attended work unless by genuine redundancy eg. Redundancy due to project completion.

ACCIDENT MAKE-UP PAY. The parties agree that the accident make up pay provisions in the Plumbing Trades (Southern States) Construction Award 1999 will be extended from 26 weeks to 52 weeks.
ACCIDENT MAKE-UP PAY. ACCIDENT MAKE-UP PAY. 23.1. The employer shall pay an employee accident make-up payment where the employee receives an injury for which weekly payment of compensation is payable by or on behalf of the employer pursuant to the provisions of the appropriate Workers’ Compensation Act or Ordinance as amended from time to time.
23.2. Accident make-up payment means a weekly payment of an amount being the difference between the weekly amount of compensation paid to the employee pursuant to the said appropriate Workers’ Compensation Act or Ordinance and the employee’s appropriate Agreement rate, or, where the incapacity is for a lesser period than one week, the difference between the amount of compensation and the said Agreement rate for that period.
23.3. The employer shall pay, or cause to be paid, accident make-up payment during the incapacity of the employee within the meaning of the said appropriate Act or Ordinance until such incapacity ceases or until the expiration of a period of thirty-nine (39) weeks from the date of injury, payment prescribed shall apply only in respect of an incapacity which results from an injury which is current during the first pay period commencing on or after or which occurs subsequent to that pay period.
23.4. The liability of the employer to pay make-up payment in accordance with this clause shall arise as at the date of the injury or accident in respect of which compensation is payable under the said appropriate Act or Ordinance, and the termination of the employee’s employment for any reason during the period of any incapacity shall in no way affect the liability of the employer to pay accident make-up payment as
23.5. In the event that the employee receives a lump sum in redemption of weekly payments under the appropriate Act or Ordinance, the liability of the employer to pay accident make-up payment as herein provided shall cease from the date of such redemption.
