Appeal to Chief. If the grievance is not settled at Step 1, and the grievant and/or the Council wishes to appeal the decision to Step 2, the grievance shall be submitted in writing to the Chief of Police within ten (10) calendar days after receipt of the response at Step 1. The grievance shall set forth the facts and circumstances and shall state the reason for believing that the grievance was improperly denied at Step 1. The Chief of Police shall then investigate the grievance, and may hold a discussion with the involved parties if he deems it necessary. The Chief shall respond to the grievance, in writing, ten (10) days after its receipt.

The Chief or his/her designee will contact a member of the Employee Committee within ten (10) calendar days of the filing of the appeal, in order to schedule a meeting to discuss the grievance. The Employee Committee and the Chief or his/her designee will discuss the grievance at a mutually agreeable time. The bargaining unit member and a representative of the Union will meet with the Village Manager or his designee to discuss the grievance within ten (10) calendar days of receipt of the officer’s appeal. If no agreement is reached in such meeting, the Village Manager or his designee will give his answer in writing within ten (10) calendar days of the date of the meeting. Step Four: Arbitration If the grievance is not settled in accordance with the foregoing procedure or if a timely answer is not given, the Union may refer the grievance to arbitration by giving written notice to the Village Manager within twenty-one (21) calendar days after receipt of the answer of the Village Manager or his designee in Step Three. If the parties are unable to agree upon an arbitrator within ten (10) working days after the Village receives the notice of referral, they shall jointly request the Federal Mediation and Conciliation Service to submit a panel of seven (7) arbitrators, all of whom shall be members in good standing of the National Academy of Arbitrators, and all of whom shall maintain business offices in the States of Illinois. No grievant shall be required to attend such meeting scheduled to commence more than one hour before or one hour after the grievant's regularly assigned work shift.
