Availability Pay. Pilots, Sergeants, Pilot Supervisors and Polygraph Examiner Supervisors shall be eligible to receive $3,800 annually, as they are required, during their ‘on call time’, to take calls of pending complaints or questions and answer those questions or assign the question or call for service to staff as appropriate. This availability pay also covers the times when Pilots, Sergeants, Pilot Supervisors and Polygraph Examiner Supervisors field similar calls during their off time.
Availability Pay. Employees who are exempt from receiving overtime shall receive availability pay as they can be expected to be called out occasionally during off duty times to perform duties associated with their assignment and for occasionally being required to work extended shifts. This article shall not apply to Sergeants covered by the Fair Labor Standards Act (FLSA).
Availability Pay. Due to the unique nature of the home support industry, the need to travel between diverse client locations and to respond to last minute schedule changes, staff are required to be available for a period of unpaid time during each shift which often results in split shifts. In recognition of such requirements, each employee has received an availability pay. Since April 1, 2009 the rate has been $0.272 per hour for all hours paid. This availability pay is incorporated into the Home Support Worker Probationary and Regular Rates shown in Appendix “A”, effective April 1, 2010.

In recognition of the unique on-call availability requirement of Law Enforcement, availability pay of eighty-five cents ($.85) per hour shall be added to the base hourly rate for all members of the association. Effective until June 30, 2022, Pilots, Sergeants, Pilot Supervisors and Polygraph Examiner Supervisors shall be eligible to receive $3,800 annually, as they are required, during their ‘on call time’, to take calls of pending complaints or questions and answer those questions or assign the question or call for service to staff as appropriate. Members receiving this payment who are covered by the FLSA will have any stipend paid on an hourly basis rather than annually or semi-annually. Members who are exempt from the FLSA will receive this payment on a semi-annual basis, with half paid in January and half paid in July to eligible employees on the payroll at the time of the payment.
Availability Pay. It is expected that Maine State Police Lieutenants will be called out during off duty times and will extend their shifts when required to perform duties associated with their assignments. Because of this need to be flexible, they will receive Availability Pay of five thousand dollars ($5,000.00) annually.

In recognition of such requirements, each employee has received since April 1, 2007 an availability pay. Since March 31, 2012 the rate has been twenty-seven and one-half cents ($0.275) per hour for all hours paid. This availability pay is incorporated into the probationary and regular rates of pay shown in Appendix “A” effective the date of ratification (July 3, 2012).
Availability Pay. 16.1 An Employee, who at the direction of QVM, is required to be continuously available outside ordinary hours for recall to work for:
16.1.1 seven consecutive days in a pay period, shall be paid an availability allowance equivalent to 27 per cent of the weekly ordinary time rate of pay prescribed for an Employee Class 4A of Schedule 1;
16.1.2 a period of less than seven consecutive days, shall be paid 1/5th of the availability allowance for each day or part thereof he/she is directed to be continuously available, provided that:
a) he/she shall not be entitled to receive the call back payment under clause 35 if called back to work after leaving QVM's premises, but shall be paid at the appropriate overtime rate for a minimum of one hour;
b) an Employee who is required to be available to work on a public holiday prescribed by clause 35 shall be paid at the rate prescribed by clause 35.4 or a minimum of four hours, if required to work on such public holiday;
c) work performed pursuant to this clause shall not entitle the Employee to a rest period pursuant to clauses 32.4, if the actual time worked is less than three hours;
d) work performed pursuant to this clause shall not entitle the Employee to a meal allowance pursuant to clause 32.7, if the actual time worked is less than three hours;
e) time spent in travelling to and from work shall be regarded as time worked.
16.2 For the purposes of this clause:
Availability Pay. Sergeants will be provided a monthly stipend of$111.48 in 1016 and $114.82 in 2017 as compensation for being available to take phone calls and emails related to department business during off duty hours. This stipend will increase in subsequent years by any wage adjustment in accordance with the 2011 collective bargaining agreement.
